MEETING NUMBER : 37/82ALC4/2011 MEETING DATE : 13.12.2011 The Meeting No.37/82 in the year 201112 to consider the cases under Duty Exemption Scheme (Chapter4) of Foreign Trade Policy, 200914 pertaining to products falling in Chapter 29 and 30 was held on 13.12.2011 under the Chairmanship of Addl DGFT, Shri V.K. Shri Suresh Karnani, Partner of the company appeared before the Committee for personal hearing and explained the case. He explained that the assay of Noscapine Crude is 9596% and the import item does not comply with the pharmacopoeial i.e. BP and has got to be purified. He further explained that purification process causes loss in yield and the NC has not taken into account the loss in yield involved in the purification process and also active ingredient actually present in the input. As regards advance authorization No.0210164425 dated 24.11.2010, he informed the Committee that the actual moisture content is 32% w/w and therefore the norms approved by NC requires revision. He also informed the Committee that the norms for the export product Noscapine BP/Noscapine Hcl have been ratified by NC in 9/82 meeting held on 27.05.2008 allowing the import with 10% wastage in the net content of import item.
After detailed deliberations and in consultation with technical authority present in meeting, Committee decided to revise the norms against advance authorizations mentioned at Sl.No.1 to 5 allowing 10% wastage in the net content of import item. He informed the Committee that they have made supply to EOU and shown certificate of analysis for the export and import item in respect of Norfloxacin Crystalline Powder and informed that the chemical process of product during final reaction when the compound is being precipitated from the final solution while adjusting pH, crystalline material are formed and then the product is dried. He also explained the difference between the purity and impurity factor of the import and export items. He also informed that the company has been closed in 2007 and the norms are required for regularization of both the advance authorizations.
A similar process of manufacture is adopted in case of Ofloxacin Crystalline Powder where the COA for import and export items are also furnished to show the difference in purity and impurity profile. After detailed deliberations and in consultation with technical authority present in meeting, Committee decided to ratify norms under para 4.7 of HBP for regularization purpose as per details below.
