MEETING NUMBER : 15/82‐ALC4/2008 MEETING DATE : 08.07.2008 The Meeting No.15/09 in the year 2008‐09 to consider the cases under Duty Exemption Scheme (Chapter‐4) of Foreign Trade Policy, 2004‐09 pertaining to products falling in Chapter 29 and 30 was held on 08.07.2008 under the Chairmanship of Export Commissioner, Shri Sanjay Rastogi in his chamber. Norms Committee Meeting No.15/09 F.No.01/82/050/00272/AM09 Meeting Date: 08.07.2008 RA F.No.03/94/040/01345/AM08 Adv.Lic.No.0310466954 dated 01.04.2008 The case was earlier considered by NC in its 13/82 meeting held on 24.06.2008 vide case No.39/9/82 and following decision was taken:‐ “Committee observed that issue for allowing Ozone Depleting Substance under Advance Authorisation Scheme is under examination of Policy Division. Therefore, it was decided to defer case for comments of Policy Division. Case was deferred for 22.07.2008.” Committee re‐considered the case and revised its decision which may be read as under:‐ Committee observed that the firm has obtained Advance Authorisation for export product Inhalers and sought import of gas against the same in addition to other import items. Committee also observed that issue for allowing Ozone Depleting Substance under Advance Authorisation Scheme is under examination of Policy Division. However, to save 奱�me, it was decided to seek clarification from Ministry of Environment and Forest whether the import item is covered under ODS
and if so, the recommendations for allowing import may be sought. Case stands deferred for 22.07.2008.

Committee considered case as per agenda and observed that Norms Committee in its meeting held on 01.01.2008 had enhanced the quantity of Prednisolone Sodium Phosphate against the five Advance Licences viz. 0310353471 dated 25.10.2005, 0310381026 dated 19.05.2006, 0310423444 dated 16.03.2007, 0310376482 dated 19.04.2006 (01.04.2006) and 0310385834 dated 21.06.2006 based on the written comments of PI Division communicated vide F.No.35011/207/2006‐PI‐III dated 01.01.2008. The wastage for overages was not taken into account since the same were not appearing in the export description. Committee was informed that firm has submitted revised DML dated 30.05.2008 and requested for allowing import item @ 46.444 mg/ml based on Prednisolone base used on anhydrous basis having water content of 4.5% in respect of 20 Advance Licences issued to them during 08.10.2002 to 22.05.2007. Representation of the firm is not within 4 months of the decision of NC. Committee in consultation with representative of technical authority decided to refer the matter to Policy Relaxation Committee for condonation of delay in filing representation for enhancement in the quantity of raw material based on the DML revised on 30.05.2008.
