No. 0310002380 dated 27.07.1999 Shri Kaushik Banerjee, Head‐Supply Chain Management appeared for personal hearing before the Committee and explained that they have already submitted Batch Records giving details of batches vis. Quantity manufactured per batch alongwith Central Excise Certificate confirming the quantity of import of raw material and final export product. He informed the Committee that they have already fulfilled the export obligation within the validity period and they have obtained the said Advance licence on one 奱�me basis. Committee perused the documents in detail and observed that as per Certificate certified by Central Excise Authority, the firm has imported 400 kgs. of import item Cis 2,6‐Dimethylpiperidine and produced 218 kgs. of final export product 1 Amino Cis 2,6 Dimethyl Piperidine (Aminlupe奱�奱�n). Committee a䬀er detailed deliberations and in consultation with representative of technical authority present in meeting decided to allow 366.972 kgs. (400/218x200) of import item against Advance licence No. 0310002380 dated 27.07.1999 for regularization purpose only. It was also decided that repeat licence shall not be issued for the above said export product 1 Amino Cis 2,6 Dimethyl Piperidine (Aminlupe奱�奱�n) by any RA based on the above ad‐hoc norms. RA concerned may take further necessary action as per above decision of NC and earlier decision may be treated as withdrawn.

Biopharma and in consultation with technical authority present in meeting decided to enhance the quality of input i.e. Prednisolone Sodium Phosphate to 46.017 mg/Vial for export product Prednisolone Sodium Phosphate Injection 30mg/ml BP in respect of Advance licences issued for export item Prednisolone Sodium Phosphate Injection 30mg/ml BP per vial (Each ml. contains Prednisolone Sodium Phosphate equivalent to 30 mg of Prednisolone on Anhydrous basis) only. However, the enhancement in the quantity for Advance licences issued for export product Prednisolone Sodium Phosphate Injection 30mg/ml USP was not allowed as the same contained Prednisolone Sodium Phosphate equivalent to 30 mg. of Prednisolone Phosphate and not Prednisolone base. RA concerned may take further necessary action in respect of the following Advance licences subject to the condition that the quantity so enhanced will not be more than the quantity applied for by the applicant at the 奱�me of issue of these Advance licences. No. 0510203948 dated 22.06.2007 Committee considered the case as per agenda and observed that the case file has been transferred from DES‐6 Section since export product falls under Chapter 30 of ITC(HS) Classification. NC‐3 in its 5/82 meeting held on 29.04.2008 has allowed 2% wastage treating the export product as Tablet (Sl.No.A‐412 of SION) since the firm has declared in their application that the export product comes under Chapter 30 of ITC(HS) Classification. Committee perused the representation of the firm submitted on 24.08.2008 and observed that the firm has now classified the export product falling under Chapter 17 of ITC(HS) Classification. Committee decided (a) to transfer the case file to DES‐6 section for taking further necessary action and (b) to refer the matter to Policy Division, Jt. DG(OPH) for seeking clarification regarding classification of export product “White Sugar Globuli (Unarzneiliche Globuli)” in the relevant ITC Chapter.
