    The Committee noted that the firm have made less than 50% exports during the valid EOP and, therefore, decided to reject the case on account of low exports made both quantity and value wise in the valid EOP. Also the grounds cited can not be construed as genuine hardship under Para 2.5 of FTP warranting relaxation.

Subject:­  Request for EOP extension of advance licence No. 1110017004 dt. 25.3.2008 issued under PC­9 condition.

  The Committee decided to extend EOP against the aforesaid advance authorization for 5 months i.e. total 11 months from the date of first import for the purpose of regularization and closure. RA should verify the EO claimed to be fulfilled by the firm within the valid EOP. The relaxation is subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is also directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding  value  addition  of  minimum  15%  or  as  stipulated  in  the  authorization  whichever  is  higher.  The  Committee  also  decided    that  the condition of re­export/destruction of imported raw material as stipulated in Policy Circular 18 dt. 30.10.2007 be waived as the firm has stated to have already utilized the imported material fully by exporting the product manufactured from these.  However, the default in terms of duty saving proportionate to the default in export outside the EO period of 12 months from the date of 1st import as stated above may be paid by the firm in accordance  with  the  stipulated  policy  provisions.    RA  to  check  and  verify  the  aspect  of  raw  material  utilization  and  evaluate  the  duty­saving default and take necessary action as per the policy provisions.

Subject:­  Request for EOP extension of advance licence No. 1110015834 dt. 10.8.2007 issued under PC­9 condition.

Subject:­  Request for clubbing of two authorizations 0510130262 dt. 25.6.2004  (ii) 0510131255 dt. 6.7.2004.

  The  committee  noted  the  request  from  RA  regarding  clarification  of  PRC  decision  taken  in  PRC  meeting  no.  08/AM10  dt.  29.1.2010.  It  was clarified that export obligation extension is only from the date of expiry of the authorization no. 0510130262 dt. 25.6.2004  and it was only for the purpose of regularization and no prospective EOP extension was granted. RLA may implement the earlier PRC decision and report compliance.  

Case No.12. M/s. Limtex India Limited

F.No. 01/60/162/1159/AM12/EFGC(PRC) Subject:­  Request for   clubbing of two advance licence Nos. (i) 0210127159 dt. 1.06.2009 (ii) 0210127558 dt. 11.6.2009.

The  committee  noted  that  since  one  of  the  authorizations  has  already  been  redeemed,    the  request  for  clubbing  at  this  stage  can  not  be considered and was rejected.  

Case No.13. M/s. Alkem Laboratories Limited Mumbai

F.No. 01/60/162/1150/AM12/EFGC(PRC) Subject:­  Request for clubbing of 4 advance licence  no. i) 0310222069 dt. 1.9.2003, ii) 0310232905 dt. 24.1.2003, iii) 0310245921 dt. 6.1.2004 and iv) 0310262870 dt. 7.4.2004 issued under PC­9 condition.   The committee decided to allow clubbing of the above   4  advance authorizations for the purpose of regularization.  RA may grant necessary extension in EO required with the stipulated composition fee for clubbing and regularization not exceeding 6 months from the expiry of 6 months of  EOP  from  the  date  of  first  import.  RA  is  also  directed  to  examine  the  case  in  terms  of  Public  Notice  No.    23  dated  4.12.2009  and  make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorization. RA should ensure proper accounting of the duty free inputs with reference to the export product while clubbing the authorizations. RA may ensure that all the imported material from the unregistered source  is fully accounted for either by way of exports or through destruction as  stipulated in the  Policy Circular 18 dt. 30.10.2007.    

Case No.14. M/s. V R Woodart Limited Mumbai

F.No. F.No.18/129/AM12/EPCG. Subject:­  Request for acceptance of payment through book transaction from SEZ unit to DTA units against the supply of goods from DTA units to SEZ unit.   The committee noted the views of Deemed Export Division of DGFT and noted that in view of the book transaction can not be construed as a complete commercial transaction thereby being eligible for the exports benefit. The case was  therefore rejected.

    The Committee considered the request and decided to extend EOP against the aforesaid advance authorizations for 6 months from the date of communication, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to exports beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher.

Subject:­  Request for revalidation for advance licence No. 0810079790 dt. 6.5.2009

  The committee noted that the firm has stated that delay took place in Customs. It was decided that a revalidation of minimum period of 3 months or higher (maximum 6 months) depending on the extent of delay may be granted to the firm. However the details regarding the delay need to be first  produced  by  the  firm  by  way  of  a  speaking  letter  from  Customs  stating  the  nature  and  extent  of  delay  in  respect  of  the  aforesaid authorization, to avail the benefit of the decision.

  The Committee decided to extend EOP against the aforesaid advance authorization for 4 months i.e. total 16 months from the date of first import for the purpose of regularization and closure. RA should verify the EO claimed to be fulfilled by the firm within the valid EOP. The relaxation is subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is also directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding  value  addition  of  minimum  15%  or  as  stipulated  in  the  authorization  whichever  is  higher.  The  Committee  also  decided    that  the

Subject:­  Request for revalidation of DEPB scrip no. 3110023469 dt. 30.12.2005 and 3110021785 dt. 26.8.2005 & grant of DEPB claims declared as time barred.   The  committee  discussed  the  case  and  decided  that  the  necessary  corrections  may  be  carried  out  in  the  minutes  and  as  regards  the  other requests the reasons for delay in filling to DEPB application may be examined on file for consideration of the DGFT.    

Case No.24. M/s. Reference from Modern Pet Centre, Kolkata

Subject:­  Request for import of ornamental Fishes for Stock & sales purpose.

  The Committee noted that no objection certificate has been provided by D/o AHD&F  for import of 374,110 Nos. Live Ornamental Fishes from Thailand and Malaysia   for stock and sales. In view of the aforesaid recommendations, PRC agreed to the request of the applicant for grant of import licence for stock and sale purpose. It was also decided that case may be processed on file with regard to the bank guarantee to be submitted by the firm in accordance with the conditions stipulated by Deptt. Of AHD&F, to examine the same from the aspect of  relevance and incidence of transaction costs.    

Case No.25. M/s. Machdar Motorsports Pvt Limited Bangalore

F.No. 01/89/180/32/AM­12/PC­2(A) Subject:­  Request for permission of restricted/regulated items required for the purpose of i1 super Series­ race event.   The committee decided to grant ex­post facto approval relaxation of the provisions under ILN no. 1(II) (d) (i) (ii) (iii) of Chapter 87 of ITC (HS) classification of export and import items.    

Case No.26. M/s. Prag Bosimi Synthetics Ltd, Assam

Subject:­  Request for extension of EOP for Advance license no.2146674 dated 7.7.1994.

  The committee was apprised that the firm was requested for a PH on 6th March also. The committee noted the same and the inability of the firm to come on 6th March and decided that a personal hearing may be granted again to the firm and that the matter may be then examined on file and place before PRC also.

Case No.27. M/s. Global Calcuium Pvt Ltd, Bangalore

Subject:­  Request for clubbing of 2 advance authorization no. 0710045975 dt. 11.7.2006 (2) 0710048576 dt. 22.11.2006.

    The committee noted that the firm has imported half of the inputs in one advance authorization no. 0710045975 dt. 16.7.2006 and other half in another advance authorization no. 0710048576 dt. 22.11.2006. The firm has stated that for items included in the 2 advance authorization, they have not claimed any CENVAT benefit. However for additional items out side the scope of the authorizations, they have taken the CENVAT benefit. The committee noted that the request of the firm was slightly different from clubbing since in the instant case, the firm has requested to combine the two authorizations restricting the EO as that stipulated on a single authorization only since the import items have been distributed in two authorizations. The committee on the basis of the clarification and declaration by the firm  agreed to the request of the firm and directed RA to consider the EO regularization accordingly.  

Case No.28. M/s. Eagle Flask Industries Pune

F.No. 01/60/162/1551 &1331/AM11/EFGC(PRC) Subject:­  Request for clubbing of 4 advance license no.3489905 dt.30.01.1995 (2) 3489908 dt.1.2.1995 (3) 2024425 dt. 8.8.1994 (4) 34899909 dt. 1.2.1995.                                              The committee decided to  allow clubbing of  the above   4  advance authorizations for the purpose of regularization.  RA may grant necessary extension in EO required with the stipulated composition fee for clubbing and regularization. RA is also directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization  whichever  is  higher.  The  15%  value  addition  for  evaluating  entitlement  is  to  be  applied  on  the  entire  FOB  and  CIF  of  the authorization and to grant them the benefit of public notice 79 dt. 2.1.2006 subject to the condition that MODVAT benefit claimed by the firm on indigenous raw material may be first refunded. RA should ensure proper accounting of the duty free inputs with reference to the export product while  clubbing  the  authorizations.  No  further  imports  and  export  will  be  undertaken.  RA  may  do  clubbing  subject  to  the  condition  that  the adjudication process for the above authorizations has not been initiated.    

Case No.29. M/s. Ajanta Pharma Ltd, Mumabi

Subject:­  Request for regularization of shipping advance license no. 0310265356 dt. 23.4.2004.

  The committee decided to regularized the exports made till 28.12.2006 as already extended and granted by RA. The Committee also decided  that the condition of re­export/destruction of imported raw material as stipulated in Policy Circular 18 dt. 30.10.2007 be waived as the firm has stated to have already utilized the imported material fully by exporting the product manufactured from these.  However, the default in terms of duty saving proportionate to the default in export outside the EO period of 12 months from the date of 1st import as stated above may be paid by

the firm in accordance with the stipulated policy provisions.  RA to check and verify the aspect of raw material utilization and evaluate the duty­ saving default and take necessary action as per the policy provisions.  

Case No.30. M/s. Vardhman Exports Mumbai
