The case was placed before the Committee and after deliberating the case in length the following decision was taken: i) Export obligation period is extended from 12 months to 18 months from the date of first import. ii) This is only for regularization and closure purpose not for any further exports. iii) This is subject to payment of composition fee @6% on unutilized duty saved value and minimum value addition of 15% as prescribed and para 4.1.6 of FTP.

The Committee noted that the firm had faced problem on account of non transmission of DEPB due to error code ‘62’ and ‘96’ which persisted for almost 6 months. The committee on the basis of the technical records decided to revalidate the aforesaid supplementary DEPB for 6 months from the date of communication.

The Committee noted that the firm had faced problem on account of non transmission of DEPB on account of certain error code ‘107’, ‘94’ and ‘93’. The committee on the basis of the technical records decided to revalidate the aforesaid supplementary DEPB for 3 months from the date of endorsement. The applicant is directed to get the endorsement from RA within one month from the date of uploadation of PRC minutes.

The Committee noted that the firm had faced problem on account of non transmission of advance authorization and therefore decided to revalidate the aforesaid advance authorization for a period of 5 months from the date of endorsement, subject to payment of composition fee @ 1% of the unutilized CIF value of the authorization and also subject to verification by RA of EO fulfillment status, as claimed by the firm. RA is directed to examine the case in terms of Para 4.1.6 of FTP and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher at the time of revalidation at the time of revalidation.
