MINUTES OF EPCG COMMITTEE MEETING HELD UNDER THE CHAIRMANSHIP OF SHRI V.K. GUPTA, ADGFT AT 11.00 A.M. ON 30.01.2012   Following officers attended the meeting:   (a)      Shri K. K. Tiwari, Industrial Adviser, Department of Heavy Industry. capacity  to analyse  diamonds  only  in rough  condition  or  it  can analyse  cut  and  polished diamonds also.  Shri Kiran Mehta appeared before the Committee and distributed the  catalogue  of  the Capital  Goods (Machinery.  The technical members  perused  the same  and  confirmed  that the  Capital  Goods imported  by  the  firm against  the  said  licence  is for  evaluation  of  the Marked  Rough  Diamonds only and it has no role in production  of  Cut  and Polished  Diamonds.    The export  product  initially endorsed  on  the  licence was  Cut  and  Polished Diamonds  which  was trading  activity  of  the firm.    They  had  applied for  the  import  of DIAMOND  EVALUATION ANALYSIS  SYSTEM  WITH THREE  LENSES,  the  end use  of  which  is  mapping of grooves, holes and any other concave area on the Rough  Diamond  Surface.  Th l fi d th t

Mr.  Soumendra  Chatterjee appeared  before  the Committee  for  PH  and confirmed  that  the  Spares were imported against the EPCG Authorization issued for  their  Unit  at  ‘Rajpura Dariba  Mines’  which  has been  split  into  two  units viz. ‘Rajpura Dariba Mines’ and  ‘Sindesar  Khurad Mines’ on the direction of Central  Excise.  The physical  distance  between the  two  mines  is  more than  5  Km.  He  also produced  the  details  of the  spares  to  be  installed at  both  the  units.  The technical  member  of  the Committee  scrutinized  the both the list of spares and confirmed  the  use  of  the same  for  two  units  of  the firm.    The  Committee, therefore,  decided  to allow  to  install  spares imported  under  EPCG scheme to the unit created by  way  of  splitting  the existing  unit  with  the condition that the firm will produce  CEC  in  terms  of provisions  of  Para  5.3.3 (ii)  of  HBP  to  RA  at  the time of redemption. 3 M/s  AAR  ESS  International Pvt. Ltd F. No. 18/26/AM­06/EPCG­I 0530134037 Dated 02.04.2003 50%  Waiver  of export obligation and  permission for  issuance  of fresh Authorization  for import  of another  car under  EPCG Scheme  in replenishment  to a  totally  lost  car for  fulfilling  the remaining  50% export obligation in respect of the lost  car  in addition to Shri  S.  K.  Poddar appeared  before  the Committee  and  informed that  they  are  now  not interested  in  replacement of  the  Car  and  only interested  in  waiver  of 100%  Export  Obligation.

The  Committee  observed that  after  import  the  Car was attached to the group company  (viz.  M/s  Manu Mahindra  Hotel)  of  the firm for 8 months when it had an accident. The Representative  of  the  firm also  informed  that  no Foreign exchange was

The  case  was  placed before  the  Committee  in its  meeting  held  on 17.11.2011  wherein  it was  deferred  to  call  for the  technical  person  of the firm for PH in the next meeting  who  can  explain the  whole  manufacturing process.    Shri  N.  N.  Malhotra, General  Manager   appeared  before  the Committee  and  showed the  schematic  process diagram  and    indicated that the 6 items(Sl. No. 4 to  9  of  import  list attached  with  EPCG Licence),  for  which  nexus was  withdrawn  by  EPCG Committee  in  its  meeting held  on  04.05.2011  for want  of  requisite  details, are  essential  for  Raw Material  Feeding  System which  are  required  in  the process  of  production.  The  technical  members scrutinized  the  Schematic Diagram  and  confirmed that  these  items  are essentially  required  in  the

y q production  process.    The Committee,  therefore, approved the nexus.  6 M/s Riddhi Siddhi Gluco Biols Ltd, F. No.18/78/AM­12/EPCG­II 03501102 Dated 11.02.1999 and 0111224 Dated 11.06.1999 The  firm  has requested  for  (i) Change  of  name from M/s Bhavari Starch Ltd (BSL) to  M/s  Riddhi Siddhi  Gluco Biols  Ltd;  &  (ii) Extension  in export obligation period  for  2 years  against EPCG authorization No.03501102 dated 11.02.1999  & No.  0111224 dated 11.06.1999, (iii) Transfer  of  both the  EPCG authorizations from  RA, Mumbai  to  RA, Ahmadabad. that  there  is  no  evidence that  M/s  Bhavari  Starch Ltd. have been taken over

The  case  was  placed before  the  Committee  in its  last  meeting  held  on 17.11.2011  wherein  the case  was  deferred  to  call the  representative  of  the firm  for  PH.    No  one appeared  for  PH  before the  Committee.    The technical members were of the  view  that  no machinery  is  required  for Slag  and  Ash.    The  firm have  also  not  indicated the  name  of  the  Ore.  Therefore,  the  Committee rejected  the  request  of the  firm  for  change  of export product.    The  Committee  also decided  to  accede  to  the request  of  the  firm  for condonation of block­wise export  obligation  as  per the  provisions  of  Para 5.8.3  of  HBP  (Vol.  I) subject  to  payment  of composition fee of 2% on duty  saved  amount  in proportion to the shortfall at the end of each block. 8

supporting manufacturer  in EPCG authorization No.  033008322 dated 31.03.2005. was  deferred  for  PH  with the  request  to  the  firm  to submit details.  RA’s report is  also  awaited.    The Company  have  not  given justification for shifting of machinery to the premises of  Joint  Venture  Partner M/s  Tata  Cummins  Ltd., Jamshedpur.    The  firm neither  submitted  the details  nor  attended  the PH.    The  Committee observed  that  the  firm have  shifted  the  Capital Goods  without  taking necessary  permission  of Excise  Authorities  and RA.      Therefore,  the Committee  rejected  the request.  9 M/s.  Supreme  Art  Works Chennai F.No.18/24/AM­09/EPCG­II 0430000605 Dated 17.04.2002 Fulfillment  of annual  average EO by third party (Group Company)  in respect  of  EPCG licence  No. 0430000605 dated 17.04.2002. The  case  was  placed before  the  Committee  in its  last  meeting  held  on 17.11.2011  wherein  it was  decided  to  call  the representative  of  the  firm for PH.      Shri  Umesh  Chandra  Dalai appeared  before  the Committee  and  tried  to explain  the  matter.  However,  the  Committee

it was  decided  to  call  the representative  of  the  firm for PH.      Shri  Umesh  Chandra  Dalai appeared  before  the Committee  and  tried  to explain  the  matter.  However,  the  Committee observed  that  the  benefit of Group Company cannot be  granted  to  a Proprietary/Partnership firm  as  per  Para  9.28  of FTP.  Moreover, the export claimed to be made by the firm towards the fulfilment of  EO  was  not  covered  under  the  definition  of third  party  and  hence, rejected  the  request  of the firm.    The  representative  of  the firm  further  informed  that the  Minutes  issued  in respect  of  the  earlier requests  of  the  firm  are not clearly mentioning the benefit  regarding condonation of the block­ wise  EO  and  extension  in EOP  granted  to  the  firm.  The  Committee  clarified that the firm is allowed for Extension  in  EOP  for  2 years  and  condonation  of blockwise  EO  subject  to payment  of  requisite extension/composition  fee interms of provision

F.No.18/37/AM­12/EPCG­II   The  firm  has requested  for waiver  of execution  of Bank Guarantee. The  Committee  in  its meeting  held  on 29.09.2011  had  decided as under: “The  Committee  noted that  M/s  Vidyut  Metallic Private  Ltd.,  the  recipient of EPCG authorization, has been  taken  over  by  M/s Supermax  Personal  Care Private Ltd. with all assets and liabilities under slump sale  agreement.  The applicant  firm  has undertaken  to  fulfil  the export obligation imposed on  the  subject  licences using the Capital Goods at the  original  place  of installation. Therefore, the Committee  decided  to allow  transfer  of  EPCG Authorization  issued  to M/s Vidyut Metallic Private Ltd.  to  M/s  Supermax Personal  Care  Pvt.  Ltd. subject  to  the  condition that  the  latter  would furnish  fresh  Bank Guarantee.” The  Committee  clarified that  BG/LUT  is  to  be submitted by the applicant as  per  Para  2.20  of Handbook  of  Procedure read  with  Custom  Circular No.  58  dated  21.10.2004 amended  from  time  to time.  11 M/s. Wadhawan Holdings Pvt Ltd. Mumbai F.No.18/152/AM­12/EPCG­II   To  allow  import of  cars  under EPCG Scheme. that  the  firm  are  coming up  with  a  4  Star  business hotel  and  are  seeking exemption

Ltd. Jaipur F.No.18/148/AM­12/EPCG­II 1330002590 Dated 19.05.2010 Change  of factory  address against  EPCG authorization No. 1330002590 dated 19.05.2010. that  both  the  factory addresses  are  mentioned in the IEC.  The firm is not covered  under  Central Excise  and,  therefore, have furnished CEC as the proof  of  installation,    and,  therefore,  allowed change  of  factory  address from  SP­6&7,  Riico Industrial  Area, Mansarovar, Jaipur to H­1­ 77,  Mansarovar  Industrial Area,  Jaipur.    Installation Certificate  is  to  be furnished    to  RA  by  the exporter within 3 months. 14 M/s.  Tijaria  Polypipes  Ltd.
