DIRECTORATE GENERAL OF FOREIGN TRADE DESVI (FOOD & MISC) Minutes of the meeting of NCVI held on 29.04.2010 Meeting No. 05/AM11 for the licensing year 201011 to consider cases under Duty Exemption Schemes (Chapter4) of Foreign Trade Policy 200914 pertaining to Misc. & Food Products was held on 29.04.2010 under the Chairmanship of Shri A.K. FERMENTAPHARMA BIOTECH LTD., THANE M.No. 05/11 Dt. 29.04.2010 Status: Deferred HQ File :01/85/050/223/AM10/ RLA File :03/94/040/0938/AM10/ Lic.No/Date:0310558476 04.02.2010 The case was considered by the committee as per agenda.. It was noted that the applicant Firm has requested for another date for PH in the second week of May, 2010. The Committee accepted the request . To be relisted on 13.05.2010 2 56 M/S. WESTERN INDIA CASHEW CO. (P) LTD M.No. 05/11 Dt. 29.04.2010 Status: Clarified HQ File :01/85/050/154/AM10/ RLA File :32/24/40/0045/AM10 Lic.No/Date:3210041398 05.10.2009 Request for deletion of clause. 1. The case was considered by the committee as per agenda. It was noted that for this export product, no prior import condition has been prescribed in the policy & procedure. The impression from reading the present description in the export product is that there is a prior import condition and that goods cannot be replenished. This is not correct. Goods can be replenished as per policy. 2. In this case, applicant had given a particular description for import and export product and NC in the meeting on 11.2.2010 approved that case as applied for. RA is to implement the NC decision.
3.RA to take consequential action as per Policy/Procedure. 3 57 M/S. WESTERN INDIA CASHEW CO. (P) LTD Status: Clarified HQ File :01/85/050/216/AM10/ RLA File :32/24/40/0030/AM10 Lic.No/Date:3210042417 06.01.2010 Request for deletion of clause. 1. The case was considered by the committee as per agenda. It was noted that for this export product, no prior import condition has been prescribed in the policy & procedure. The impression from reading the present description in the export product is that there is a prior import condition and that goods cannot be replenished. This is not correct. Goods can be replenished as per policy. 2. In this case, in the recording of NC decision dt. 11.2.2010, description on the export side is as per licence given by RA. However it was noted that the applicant had not applied for with this description. Committee decided to amend export product description as per application as “Roasted Cashew Nuts Broken”. 3.RA to take consequential action as per Policy/Procedure. 4 58 M/S. CLIQUE EXPORTS PVT. LTD., MUMBAI Status: Approved HQ File :01/85/162/204/AM10 RLA File :03/94/40/00472/AM10 Request for amendment in import item The case was considered by the committee as per agenda. Committee had approved the case in meeting No. 35/10 held on 07.01.2010. The applicant Firm has now requested to amend description of import item . The Committee decided to modify the description as under: Export item: FUFU (FLOUR) containing minimum 76 % of import item Import item: Natural dehydrated potato flakes/ Dehydrated potato flakes/ Dehydrated potato /powder/ Dehydrated potato granules. Import & export qty remain unchanged. RA to take consequential action as per Policy/Procedure.
5 59 M/S. SWANI CORPORATION M.No. 05/11 Dt. 29.04.2010 Status: Deferred HQ File :01/85/162/274/AM10 Enhancement in wastage. The case was considered by the committee as per agenda. NC in the meeting on 10.12.2009 had ratified norms with 5 % wastage. Applicant has now represented for enhancement of wastage, as applied, to 12 %. It was decided that a technical team comprising of Spice Board, Mumbai & DIPP and FTDO/DESVI may make a field visit on a convenient date and submit a report regarding the production processes and wastages. It was noted that import item is used for preparing honey combs. In an earlier case, certain quantity was allowed for preparing honey combs. Committee observed that the periodicity of replacement of honey comb is not known nor informed by the applicant. It was made clear earlier by NC that no repeat licence to be allowed. It was further noted that no justification has been given for this import item. Accordingly, Committee, rejected the case. RLA to take consequential action as per policy/procedure.
