Minutes of the Meeting NC-V held on 27.11.2008

The Meeting No. 35/AM-09 for the licensing year 2008-09 to consider the cases under Duty Exemption Schemes (Chapter-4) of 27.11.2008 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting No. 33/AM09 dated 13.11.2008 and NC Meeting No. 34/AM09 dated 20.11.2008 were ratified. However, the following amendment was made in the Minutes of NC meeting No. 30/09 dated 23.10.2008 as under: -

In the minutes of NC meeting No. 30/AM09 dated 23.10.2008, as regards outside agenda case No. 1 of M/s Eastern Silk Industries Ltd., inadvertently the total wastage was allowed with 15%, whereas the actual total wastage of 10% was recommended by O/o DC (MSME) vide their U.O No. 37(5)/33/2007-08/Hosy. dated

PRO version 21.10.2008 in this case for manufacturing of finished silk yarn (Gassed) from Grey silk yarn on the basis of their report of visit. It was therefore decided to allow the total wastage of 10% instead of 15% by amending the Minutes of NC No. 30/AM09 dated 23.10.2008.

Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case by amending the earlier decision as detailed below: -

Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case by amending the earlier decision as detailed below: -

Case No. 4 M/s Richa & Co., New Delhi F.NO.1/84/162/492/AM09-DES-V Clarification regarding exported item under Target Plus Licence as to whether Pillow cover is covered under SION, J -169. The Committee considered this case as per agenda. It is seen that in this case the export of Pillow Cover has been made against which the exporter has earned the duty credit scrip issued under Target Plus Scheme and now the applicant firm has imported 100% Linen dyed woven fabric. In this case, Applicant is seeking a clarification as to whether “Pillow Cover” is covered under SION, S.No. J-169. The Committee observed that in the SION, S.No. J-169, export product is described as under: - SION entry Export product SION, S.No. J-169 Dyed placemat, Napkin, Table Cloth, Cushion
Cover and Comfort Cover, etc.

           The representatives of technical authorities present in the meeting observed that Cushion Cover/Comfort

Cover are similar to Pillow Covers and since the words ‘etc’. are used in this SION, Pillow Covers are covered by this SION entry. This may be transferred to PC-3 Section for giving necessary clarification on nexus on import of inputs in Target Plus Scheme.

Case No. 5 M/s Vanasthali, Textile Industries, ltd. Mumbai NC 35/09 dt. 27.11.2008 F.NO.1/84/162/1038/AM08-DES-V Ratification of input output norms in respect of Advance Authorization No.0510212555 dt. 26.11.2007 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith relevant papers while Sh. Raghuram, an authorized representative of firm alongwith other representatives was also present in the meeting for personal hearing. They explained the case alongwith relevant details/information pertaining to this case. The Committee after
