Request: Fixation of adhoc norms for the export product ‘Lay Flat Tubing made out of LLDPE/LDPE Scrap’ under Para 4.4.2 of HBP Vol.I.

Decision: D/o C&PC vide its OM No. 46011/132/2007-PC.II dated 24.01.2011 has recommended as follows:

(i) The advance Authorization applications of M/s VHCL Industries Ltd. for the export of Lay flat Tubing were earlier examined in accordance with Public Notice No.392 (PN)/92-97 dated 01.01.1997 and Policy Circular No. 20/2002-2007 dated 12.03.2003. The earlier comments dated 22.04.2010

PRO version still holds good.

(ii) The present request of firm is for the export of 200MT of Lay Flat Tubing and made out of LLDPE/LDPE scrap. Total installed capacity of the plant & machinery is 6600MT against which the firm is being issued import license for the import of 3300MT p.a. i.e. 50% of the installed capacity. Thus, the present Advance Authorization application will be within the installed capacity of the firm. Accordingly, D/o C&PC has recommended to issue two licences of 100 MT each as follows:

The above recommendations is subject to the following conditions:

(i) The above recommendations are only for the above Advance Authorization applications submitted by the firm and no repeat licence either to this unit or any other unit may be issued as the above recommendations are in accordance with the Public Notice No. 392 dated 01.01.1997 and Policy Circular No. 20/2002-2007 dated 12.03.2003. The import of plastic waste/scrap is under Restricted Category of import and is allowed only to the eligible unit as per above guidelines.

(ii) The import of LDPE/LLDPE Scrap will be in accordance with Public Notice No. 392 dated 01.01.1997.

(iii) There may not be any pro-rata increase in the quantity of export and import against the above advance authorization application.

The Committee observed that as per orders of Chairman of NC earlier, reference has been made to M/o Environment & Forests (MOEF) on 02.07.2010 and 29.07.2010 to Ozone Cell & HSMD Division. MOEF(Ozone Cell) vide letter dated 02.09.2010 informed that since “Lay Flat Tubing from LLDPE/LDPE scrap” is not an ozone depleting substance, therefore, Ozone Cell has no comments to offer in this regard. However, no comments have been received so far from MOEF (HSMD Division). The Committee decided that the concerned division on the issue is HSMD Division of MOEF and as per the decision of earlier Chairman of NC, the comments of MOEF is required. Hence, a reminder may be sent to MOEF (HSMD Division).

Decision: D/o C&PC vide its OM No. 46011/132/2007-PC.II dated 24.01.2011 has recommended as follows:

(i) The advance Authorization applications of M/s VHCL Industries Ltd. for the export of Reprocessed Plastic Granules were earlier examined in accordance with Public Notice No.392 (PN)/92-97 dated 01.01.1997 and Policy Circular No. 20/2002-2007 dated 12.03.2003. The earlier comments dated 22.04.2010 still holds good.

(ii) The present request of firm is for the export of 300MT of Reporcessed Plastic Granules made out of LLDPE/LDPE scrap. Total installed capacity of the plant & machinery is 6600MT against which the firm is being issued import license for the import of 3300MT p.a. i.e. 50% of the installed capacity. Thus, the present Advance Authorization application will be within the installed capacity of the firm. Accordingly, D/o C&PC has recommended to issue three licences of 100 MT each as follows:
