Request: Fixation of adhoc norms for the Export Product ‘Plastic Trays’.

Decision: The Committee discussed the case in light of written comments furnished by D/o C&PC vide OM No. 46011/107/2008-PC.II dated 05.05.2011 and following things were observed:

(i) The case was earlier rejected by NC in its Meeting No. 46/87-ALC1/2010 held on 21.02.2011 on the ground that the firm is importing plastic waste / scrap and Public Notice No. 392(PN/92-97 dated 01.01.1997 and Policy Circular No. 20/2002-2007 dated 12.03.2003 allow import of plastic waste/scrap to those units, which are actual users and have set up their units prior to 19.06.1998, but the firm is holding the Entrepreneur Memorandum No. 330031200465 Part II-Small dated 20.06.2008 issued from District Industries Centre, Kanchipuram. Hence, the firm is not eligible for Plastic Waste/Scrap.

(ii) The firm vide their representation dated 09.03.2011 has stated that they will not import plastic waste directly from foreign countries and will purchase it from SEZ Units. It is clarified that the guidelines indicated in Public Notice No. 392(PN/92-97 dated 01.01.1997 and Policy Circular No. 20/2002-2007 dated 12.03.2003 are also applicable to EOU / SEZ units for the import of plastic waste / scrap except some relaxation to size / shape of plastic waste/scrap.

(iii) As per present Policy, the firm (DTA) can not take / procure plastic waste / scrap directly from any EOU / SEZ unit directly without processing / conversion of plastic scrap into Granules / Agglomerates from SEZ unit. If the firm intends to take scrap generated out of the manufacturing process, they can always take as per the relevant policy and procedure and not under Duty Exemption Scheme.

(iv) In the present case, the firm intends to procure Polystyrene Scrap from the SEZ unit under Duty Exemption Scheme. The firm has never indicated in its initial application that it will take it from SEZ unit and only after rejection they have given these reasons.

        In view of above, the Committee decided to reiterate its decision taken in earlier NC Meeting No. 46/87-ALC1/2010 held

on 21.02.2011.
