Decision: The Committee discussed the case in light of written comments of D/o C&PC OM No. 46011/107/2008-PC.II dated 10.02.2011 handed over in the Meeting and observed that the item of export is Polystyrene Plastic Trays and the firm has applied for the import of Polystyrene Plastic Scrap. The import of Plastic waste/scrap is governed by Public Notice No. 392(PN)/92-97 dated 01.01.1997 and Policy Circular No. 20/2002-2007 dated 12.03.2003. As per these guidelines mentioned in Pubic Notice and Policy Circular, the import of plastic waste/scrap is allowed to those units, who are actual users and have set up their units prior to 19.06.1998. In the present case the firm is holding the Entrepreneur Memorandum No. 330031200465 Part II-Small dated 20.06.2008 issued from District Industries Centre, Kanchipuram.

                    The firm is not eligible for the plastic waste/scrap in accordance with the Guidelines indicated in Public Notice

No. 392 (PN)/92-97 dated 01.01.1997 and Policy Circular No. 20/2002-2007 dated 12.03.2003 specifically as unit has been set up after 19.06.1998. In view of above, the Committee decided to reject the case.

Decision: The Committee deliberated this case in detail and felt that the export product simply indicated Industrial Solid Tyres, whereas the firm intends to import Used Industrial Solid Tyres, carrying out retrading activity and then re-export the same.
