(ii) Central Excise Data duly certified from 2006 to 2013 for above four inputs.

In response to above D/L, the requisite information has been received from Central Excise on 28.06.2013. The Committee noted that the information from Development Commissioner is still awaited. Decision: D/o C&PC vide their OM No. 46011/51/2013-PC.II dated 08.07.2013 has stated that the request of firm was examined by their office and they have recommended to reject the request of firm for fixation of adhoc norms on following grounds:

(i) It is observed from the above details that ITC (HS) Code of both the export product and import product has been indicated as 39159042 which falls under the category of Plastic Waste/Scrap. As per details indicated in the proposal, it is indicated that upon prior import of factory lot of belting, belts are to be cut to make of even sizes as factory lot consist of variety of length. Thus sizable wastage of 7% to 8% stands occurred on account of availability of odd size length under factory lot at an economical price. Every piece of belt is to be stitched separately attaching accessories to make construction belt.

(ii) The proposal involves import of factory lot of belting which is basically factory waste and the item of import and export has been classified under category of Plastic Waste/Scrap under ITC (HS) Code 39159042. The proposal is not very specific and clear. In addition the import of Plastic Waste/Scrap is covered under Restricted Category of Import and is allowed for Import subject to actual user condition and units set up prior on 19.6.1998 as per Public notice No. 392 (PN)/92-9: dated the 1st January, 1997 and Policy Circular No. 20/2002-2007 dated 12.3.2003. In the present case the firm is holding IEM dated 8.2.2007 for the manufacture of plastic cleaning items/brushes/ brooms etc which is not related with the current manufacturing activities in the proposal.

(iii) In addition the ITC HS code indicated 39159042 pertains to PET bottle waste/scrap, which will not cover Export

                 The Committee in light of above written comments of D/o C&PC decided to  reject the case with direction to firm

to pay the Customs duty and applicable interest for regularization of the licence.
