Process Wastage Data for the last three years duly certified by Central Excise to Office of Development Commissioner, Kandla Special Economic Zone, Ministry of Commerce & Industry, Gandhidham – Kutch – 370230 for certification at their end.

  1.     The Committee noted that the response in this regard is still awaited from SEZ, Kandla.

Hence, the Committee decided to issue a reminder to Office of Development Commissioner, Kandla Special Economic Zone, Ministry of Commerce & Industry, Gandhidham – Kutch – 370230 with a copy to EOU Division, Department of Commerce.

Decision: This case was discussed in detail with the representative of D/o C&PC. The Committee noted that the firm obtained a number of advance licences as per SION H-444 with the description of export product ‘Aseptic packaging of Aluminium Foil of thickness less than 0.2 mm backed by paper, LDPE, with/without Polypropylene/MPM Strips’ and the description of Import Item No. 4 was ‘LLDPE/ HDPE/MLLDPE Granules’ and L.K. Film was not an input applied for. The firm’s request for amending the SION was acceded to w.e.f. 13.07.2010 vide Public Notice No. 80/2009-2014 dated 13.07.2010.

  1.     Therefore, the firm’s request for retrospective application of Public Notice No.          80/2009-2014 dated 13.07.2010 from

22.08.2008 was considered and rejected as the Public Notices etc. are made effective from the date of issuance only. Committee also noted that applicant had made application under SION H-444 and in this norms, ‘L.K. Film’ was not permitted and applicant was clearly aware of same.
