Minutes of NC-V meeting due for 13.12.2012 but actually held on 20.12.2012 The meeting No.36/AM-13 for the licensing year 2012-13 to consider the cases under Duty Exemption Schemes (Chapter- 4) due for 13.12.2012 but actually held on 20.12.2012 in Room No.4 of DGFT under the Chairmanship of Shri K.C. At the outset, the Minutes of NC-V Meeting No.34/AM-13, dated 29.11.2012 were taken for ratification. As there were no amendments to the same, the above referred minutes of 29.11.2012 were adopted for implementation by the Committee without any amendment. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has not send the following in support of their proposal:-

i) Technical literature to substantiate their claim of requirement of 13% of Mass of jute cloth processed and 6% wastage. ii) Supplier’s recipe for rot proofing of jute fabric with compsole.

Accordingly, the Committee after deliberations decided to ask the applicant firm to make available the above information/details for consideration of the proposal. The case stands for re-listing on 17.01.2013.

M/s Raghav Exports, Ludhiana File No.01/(85)84/50/186/AM-12/DES-V Re-fixation of input output norms in respect of Advance Authorisation No.3010081930 dated 21.12.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has not submitted requisite information/details called for vide DC(MSME)’s letter dated 21.11.2012 so far. In view of above, the Committee was unable to finalise the norms and decided to maintain status quo in this case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the applicant firm has been asked for the quantity of import product for Ladies Top @ 2.86 sq. meter per piece whereas in the invoice, the requirement of quantity of import product has been indicated as 2.27 sq. meter per piece. For the Ladies Pant, the quantity of import product has been asked for @ 2.76 sq. meter per piece whereas in the invoice the quantity of import product has been indicated as 2.27 sq. meter per piece. Moreover, the sketch and measurement chart of the Ladies Top has not been provided by the applicant firm. In view of this, the Committee was not in a position to compute the requirement of fabric as asked for and decided to maintain status quo in this case.

PRO version File No.01/84/50/72/AM-13/DES-V Ratification of input output norms in respect of Advance Authorization No.5610000416 dated 30.04.2012. Decision: The Committee considered the case as per agenda alongwith other relevant papers and found that the export product is not produced from manmade fabric. Hence, classification of export product under chapter 63 of ITC(HS) code is not tenable. For subsequent applications, the Committee further felt that export product is plastic item. The applicant firm is advised to treat the export product under chapter 39 of the ITC(HS) code and apply to the concerned Norms Committee.
