(iii)             The firm’s representa៝�ve, Shri Krishan Kumar aោ�ended before the Norms Commiោ�ee and explained that they have imported 1 set “60 MW Steam Turbine Generator” and the value of this item is approximately Rs.38 crores and it is being supplied with a value addi៝�on and approximately FOB value of total supply is Rs. 49 crores. (iv)            The Commiោ�ee observed that firm is impor៝�ng en៝�rely the Generator and supplying as it is and simply supplying the same  cannot  be  considered  as  manufacturing  ac៝�vity.  This  is  an  Advance  Authoriza៝�on  against  Deemed  Export  and Deemed Export benefit is available as per Para 8.2 of FTP if goods are manufactured in India. Advance Authoriza៝�on would have been admissible if Generator would have been manufactured in India and applicant would have imported inputs for manufacture of Generator. Here Generator is being imported and is being supplied. Hence, in terms of Policy Circular  No.50  dated  28.12.2011,  Advance  Authoriza៝�on  cannot  be  issued.    Accordingly,  the  Commiោ�ee  decided  to reject the request of the firm for supply under the subject Advance Authoriza៝�on as per provisions of Policy Circular No.50 dated 28.12.2011.  RLA may take necessary ac៝�on accordingly immediately.
