The Commi�ee, however, discussed this case and it is seen that the Advance Authoriza�on had been obtained for export of HP Piping System for 1x76 MW cap�ve Power plant for supply against EPCG authoriza�on issued to M/s JSW Steel Ltd. The descrip�on of import item in the EPCG licence clearly indicate that these are items for supply to 1x76 MW cap�ve power plant. Basically in this case, a 3% EPCG licence has been issued for supply to a non‐mega power plant and the export obliga�on is to be discharged, it seem that normally project which are manufactured by the manufacturers like steel project etc. Hence, basically an issue arises whether an EPCG licence for non mega power plant can be issued for export of project manufactured by such manufacturers. This issue had arisen also in the case of M/s. Sterlite Industries Ltd wherein an EPCG licence had been issued for export of phosphoric acid. Another instance had been reported by RA, Hyderabad also wherein the EPCG licence was applied for non‐mega power plant. These issues had been referred to the Policy Cell (EPCG Division) for considera�on. In the light of this, it was decided that this issue may also be referred to EPCG division for sending their advise whether EPCG licence may be issued for import of non‐mega power plant. The Commi�ee also noted that the Deemed Export benefits for supply to non‐mega power plants have been discon�nued. 12
