It is seen from the list of export item in the Advanced Authorisaon that only one export item has been given namely Nitrogen Plant 350 nm3/hr. Hence the commi⟀�ee can allow duty free import item in respect of the export item which is menoned in the AA only. Export item No. 2 i.e., Nitrogen plant 250 nm3/hr purity 99.995% is not prescribed as an export item in the AA. Hence no duty free import can be allowed against this item. This AA was issued on 8.8.2006 i.e. about 7 years back, hence no amendment in this AA is possible at present. 2. As regards the descripon of export item No. 1, the representave of the firm informed during the PH dated 19.2.2013 that there is only one item of import i.e., Carbon Molecular Sieves. The quanty of this item depends upon the purity of Nitrogen Gas produced by the Nitrogen Gas Generator Plant. The present quanty of import item allowed as 2016 kgs. as against the export item, namely , 250 Nm3/hr Nitrogen Plant with ammonia cracker as applied for informaon given by the firm that they will produced the export item with 99.5% purity. The export has already been made prior to the fixaon of norms by the Norms Commi⟀�ee. Hence, the request to delete purity from the descripon of export product cannot be made and the firm may be asked to provide the informaon as under : (a) Date of export of the Nitrogen Plant; (b) Corroborave evidence from the firm that the Nitrogen Plant exported by the firm is for producing Nitrogen with 99.5% purity. The corroborave evidence in the form of AREI and documents related with Central Excise Authories. Case is deferred to 24.12.2013. S.No.397
