Addendum to the Minutes of the meeting of Board of Approval held on 28th September, 2006 (Supplementary agenda)

Item No. 1: Deferred proposals from the meeting of the Board of Approval held on 21st September 2006

(I) Additions/Modification pertaining to existing SEZs

Approval for conversion of Reliance, Jamnagar notified sector specific zone as SEZ for multi product and contiguity relaxation

It was noted that M/s Reliance Infrastructure Limited were granted approval for setting up of an SEZ in an area of 440.08 hectares and notified as an SEZ on 19.4.06. The Board, in its meeting on 17th March, 06 had also granted in principle approval to the Developer for expansion of the sector-specific SEZ as and when the minimum area of 1000 hectares is acquired by the Developer.

It was informed that M/s. RIFL are now in possession of the additional land of 784 hectares and had sought formal approval for a Multi product SEZ. However,
since there was a thoroughfare comprising of two rail lines and two roads on the area under possession, the Developer had sought relaxation of the contiguity principle, for which they had agreed to make requisite arrangements, to the satisfaction of the Board.

The representatives of the Department of Revenue raised the issue whether the Board is authorized to grant relaxation under the SEZ Rule 5.2 (a) – 3rd provision.
The Ministry of Law representative who was present in the meeting requested that the matter by referred to them on file and a reply would be given by them by the next Board of Approval meeting. Accordingly it was decided to refer the matter to the Ministry of Law for their views.

Request from M/s. Quest Machining and Manufacturing Private Limited for changing the sector from “Auto, Aerospace and Industrial Engineering” to “Manufacture of Precision Engineering Products”

The Board of Approval noted the clarification provided by M/s. Quest Machining and Manufacturing Private Limited that the proposed SEZ is for Manufacture of Precision Engineering Products instead of Auto, Aerospace and Industrial Engineering for which in-principle approval was granted to them and approved the change of sector.

Request from M/s. Viraj Profiles Limited for change of sector from Stainless Steel Engineering Products to Engineering Products

The Board considered the clarification provided by M/s. Viraj Profiles Limited for change of the Formal approval granted to them for setting up of Stainless Steel Engineering Products to sector specific SEZ for Engineering Products as indicated in their Checklist and approved the change in sector.

Request of MIDC for changing the area and sector of SEZ at Shendre, Maharashtra

The Board considered and approved the requests of MIDC for modification of the area in the approval granted to them for setting up of SEZ for automobile industry at Shendre Aurangabad District, Maharashtra from 210 hectares to 118.13 hectares and changing the sector from automobile industry to Aluminium and Aluminium related industry.

Proposal for changing the area of sector specific SEZ for textile sector at Nagpur, Maharashtra by MIDC

The Board considered and approved the request of MIDC for change in the area for the SEZ to be set up by them for textiles sector at Nagpur, Maharashtra for which formal approval was granted, from 383 hectares to 147.04 hectares.

II. Proposals deferred in the third meeting of BOA held on 8.8.2006

Authorized activities in respect of DLF Akruti Info Parks (Pune) Limited

At the behest of the State Government, the Board deferred the decision on the authorised activities requested for by the Developer.

III. Decisions taken on file

Authorised operations in respect of sector specific SEZ for engineering products at Hazira, Gujarat by M/s Essar Hazira SEZ (Developer) Limited.

The request of M/s Essar Hazira SEZ (Developer) Limited, Hazira, Gujarat, for approval of the authorized activities which was approved on file on account of urgency of matter was placed before the Board of Approval for ratification. Board ratified the approval granted on file.

2 Authorised operations in respect of sector specific SEZ for Gems by M/s Hyderabad Gems SEZ Limited.

The request of M/s Hyderabad Gems SEZ Limited for approval of the authorized activities under the head “processing Area”, which was approved on file on account of urgency was placed before the Board of Approval for ratification.
Board ratified the approval granted on file.

The request for authorized operations under the “Non-processing Area” was deferred and would be considered after receipt of comments from the Department of Revenue on the list of authorized operations to be notified.

3 Authorised operations in respect of sector specific SEZ for IT/ITES by M/s A.P. Techno Projects Private Limited.

The request of M/s A.P. Techno Projects Private Limited, for approval of the authorized activities which was approved on file on account of urgency was placed before the Board of Approval for ratification. Board ratified the approval granted on file.

Authorised operations in respect of sector specific SEZ for Non Conventional Energy by M/s. Moser Baer India Limited

The request of M/s. Moser Baer India Limited, for approval of the authorized activities which was approved on file on account of urgency was placed before the Board of Approval for ratification. Board ratified the approval granted on file.

Request of MP Audyogik Kendra Vikas Nigam (Indore) Limited for approval of the activity of water supply of apparel park, SEZ, Phase – II.

The Board considered request of MPAKVN, Developer of the Indore SEZ
for creating infrastructure such as water treatment plant, clear water gravity main, clear water sump and part of raw water main pipeline within the periphery of the SEZ and infrastructure such as pump house, raw water main pipeline, valves, specials, panels etc. outside the periphery of the SEZ for meeting the water requirement of industrial units from Sanjay Jalashay located around 6.5 Km. away from the SEZ, Phase – II. The representatives of Department of Revenue raised the issue that the permissions for duty free goods can be given only for facilities within the SEZ and not for operations to be carried out outside the SEZ. It was argued by some of the members that water will have to be drawn from some source and therefore the pipeline and other equipment used for dedicated pipe line upto source should be granted. The Board ratified the approval granted on file on the condition that the water supply scheme is dedicated only for SEZ and that the exemption shall be limited to goods procured/imported for facilities within the SEZ.

Request of M/s. Bharat Forge Limited for increasing the land area from 2000 hectares to 5000 hectares.

The Board considered the request for of M/s. Bharat Forge Limited for increasing the land area from 2000 hectares to 5000 hectares for the in principle approval granted to them for setting up of multi product SEZ in Pune, Maharashtra and ratified the approval granted on file stating that earlier in-

principle approval stands amended in regard to land area and other terms and conditions would remain unchanged.

(IV) Requests for authorized operations

All the requests for authorized operations by the following Developers which were listed at Annexures 7 to 19 of the Supplementary Agenda were deferred till receipt of comments from the Department of Revenue on the list of authorized operations to be notified:

1. M/s. Zydus Infrastructure Private Limited in respect of sector specific SEZ for Pharmaceuticals at Village Matoda, National Highway No. 8A, Taluka Sanand, District Ahmedabad, Gujarat

2. M/s. Maharashtra Industrial Development Corporation in respect of sector specific SEZ for Pharmaceuticals at Krushnor District- Nanded, Maharashtra.

3. M/s. Maharashtra Industrial Development Corporation in respect of sector specific SEZ for Textile at Yavatmal District-Yavatmal, Maharashtra

4. M/s. Maharashtra Industrial Development Corporation in respect of sector specific SEZ for Textile at Kagal District-Kolhapur, Maharashtra.

5. M/s. Maharashtra Industrial Development Corporation in respect of sector specific SEZ for Textile at Chincholi, District-Solapur, Maharashtra.

6. M/s. Maharashtra Industrial Development Corporation in respect of sector specific SEZ for Textile at Butibori District-Nagpur

7. M/s. Maharashtra Industrial Development Corporation in respect of sector specific SEZ for Agro Products at Latur, District-Latur, Maharashtra

8. M/s. Maharashtra Industrial Development Corporation in respect of sector specific SEZ for Aluminium and Aluminium related industry at Shendre Industrial Area, District Aurangabad, Maharashtra

9. M/s. Satyam Computers Services Limited in respect of sector specific SEZ for IT/ITES at Kancheepuram District, Chennai

13. M/s. Magarpatta Township Developer and Construction Company Limited in respect of sector specific SEZ for Electronic Hardware and Software including ITES at Hadapsar, Pune, Maharashtra

Item No. 2: Approvals granted and decisions for deferment in respect of the six proposals listed in the Supplementary agenda are duly reflected in the main minutes of the meeting already issued.

Item No. 3: Request of Government of Maharashtra for transferring the approval given to MIDC for Pharmaceuticals SEZ at Aurangabad, Maharashtra, to M/s. Wockhardt Infrastructure Development Limited.

The request of M/s MIDC for transfer of the Formal approval granted to them for setting up of a sector specific SEZ for Pharmaceuticals sector at Shendre Industrial Area, District Aurangabad, and Maharashtra to M/s. Wockhardt Infrastructure Development Limited was considered by the Board. The Board decided that M/s Wockhardt Infrastructure Development Limited may apply in Form A which would be then considered appropriately.

Item No. 4 Request of M/s. Marathon Realty Limited for conversion of in- principle approval to formal approval.

The Board decided to defer the consideration of the proposal.

Item No. 5 Request of Claridges Hotel Private Limited for changing the formal approval granted to multi services SEZ, to multi product SEZ

The Board examined the request of Claridges Hotel Private Limited for permission to extend the SEZ area of the present formal approval granted to them for Multi Services SEZ at Raigad District Maharashtra from 108 hectares to a multi product SEZ of 1600 hectares and permission to subsume a multi services SEZ into the multi product SEZ. However, it was found that the entire land for a multi product SEZ is not in their possession. The Board decided to defer the consideration of the proposal till the required minimum land of 1000 hectares is in possession of the developer.

Item No. 6 Setting up of Special Economic Zone at Amritsar

The Board took note of the information provided by the Government of Punjab that the proposal by Punjab Small Industries and Export Corporation, for setting up of SEZ at Amritsar, which was listed in the Agenda at No. 25 is now being developed by M/s. DLF Universal Limited and not by Punjab Small Industries and Export Corporation and that the Government of India has already granted “in-principle” approval to M/s. DLF Universal Limited vide letter dated 7th April, 2006 for the setting up of Sector specific SEZs for Engineering, Textile and Food Processing Sectors and also for setting up of Free Trade and Warehousing Zone at Amritsar.

Item No. 7 and Item No. 8: Decisions taken on these two items are reflected in the main minutes of the BoA.
