Agenda for the meeting of the Board of Approval to be held on 18th )uly 2008 Item No. 1: Issue relatin g to withdraw al of SEZ proposals / notified SEZs in Goa. In case of formally approved SEZ in Goa, show cause notices dated 31.3.2008 were issued to the developers concerned statinS as to why the formal approvals granted should not be cancelled. The developers were given a personal hearing in the meeting of the Board of Approval held on 4tr' June 2008. After hearing the submissions made by the developers in the meeting of the Board of Approval held on 4s June 2008, it was decided to refer the submissions made by the developers to the State Government for their comments as no rePresentative of the State Government was present in the meeting. It was also decided that the matter would be discussed at the next meeting of the BoA after the cornments of the State Govemment are received. The matter, along with the representations and submissions made by the developers, has been referred to the State Government for comments, vide this Department's letter dated 17ft June 20008. A copy of this Department's letter is at Annexure - 1. The issue is submitted before the BoA for decision. Item No. 2: Proposals for conversion of in-principle to formal approval S. Formal approval was granted for setting up of multi product sEZ at Nashik, Maharashtra uy lvrTs Indiabulls Industrial Inlrastructure Ltd on an area ol L023 43 hectares. The proposal was approved in the meeting of the BOA h"]9-T lth lune 2007.The uppro"ut letter wii issued on 25th June, 2007. DC, SEEPZ sEZ has submitted a.r inspection report. While processing the proposal {or notification, it has been noticed that there is one viilage road passing tfuough the sEZ area of survey no. 1094, which cuts the boundary of sEZ and therefore, breaks the contiguity at one point. ihe developer has given an undertaking that they will -provide Lnderpass/ overpass passing under/over the road, thereby connectingthe SE7 arca' a *up oI the -SEZ - area ihowing the position of the road, which breaks the contigulty, is enclosed at Annexure - 3. The request of the developer is submitted for consideration of the BoA Item No.4: Requests for change in name/ transfer of approvals in the name of new comPany { (i) Request of l\4/s. DLF Limited for changing the name to l\4/s' DLF Haryana SEZ (Amba1a) Ltd. In-principle approval was granted for setting up of multi Product SEZ at Ambaia, Haryana ay v1 s DLF Universal Ltd. over an alea of 1,012 hectares, in the meeting of the Board of Approval held on 17h March 2006. The ietter of approval was isslued on 3'd April 2006. Vide ietter dated 11th september 2007, the name of the developer was changed from M/s. DLF Universal Ltd. to M/s. DLF Ltd The developer has again requested for changing the name of the developer M/s. DLF Ltd. toM/s. DLF Haryana SEZ (Ambala) Ltd. The share holding pattem of \4/s. DLF Haryana SEZ (Ambala) Ltd. is at Annexure - 4' Accordingly, the developer has requested to traasfer the approval in the name of new company The request of the developer is submitted for consideration of the BoA. The developer has now submitted that they are irrtheadvanced stage of negotiations for funding of the proposedProject.ThedeveloperhasfurtherStatedthattheirinvestorsarenotvery .o.nJottrbi" in investing in the subsidiary comPany. The investors are insisting on developing the project in an sPV company. Accordingly, the developer hasjormed a ,.pur"t" S"pV ,nder the name and style of 'Parsvnath Knowledge Pvt. Ltd'. The share holding pattern of both the companies is at Annexure - 5. Accordingly, the developer ha"s requested to transfer the approval in the name of SPV company i'e' ,Parsvnath Knowledge Park Pvt. Ltd. The lequest of the developer is submitted for consideration of the BoA. (iii)RequestofM/s.ParsvnathSEZLimitedfortransferofformalapprovalin the name of l,I/s. Parsvnath Biotech Pvt. Ltd. FormalapprovalwasgrantedforsettingupofBiotechSEZinRangaReddy District, Andhra Pradesh by M/s Parsvnath sEZ Ltd. over an area of 10.11 hectares, in the meeting of the Board of Approval held on 126 JuIy 2007. The letter of approval was issued oi 22"0 August 2007. The developer has now submitted that the formal approval may be transferred in the name of sPV i.e. Parsvnath Biotech Pvt. Ltd. In thii regard tire developer has inJormed that the land has been transferred by the APIIC ln favour of the SPV company. The formal transfer of the title of land in favour of the SPV company wiil be done only alter the transfer of formal approval of the sEZ from 'Parsvnath sEZ Ltd.', to ',Parsvnath Biotech Pvt. Ltd.' The all0tment letter of APIIC and the share holding patteln of both the companies is at Annexure -6, The request of the developer is submitted for consideration of the BoA. (i") Request of M/s. RNB Infrastructure Private Limited for kansfer of in- principle approval in the name of I\4/s. RNB SEZ Coimbatore Pvt. Ltd. In-principle approval was granted {or setting up of sector speciJic SEZ for textile sector in Coimbatore, Tamil Nadu by M/s RNB Infrastructure Private Ltd. over an area oI 707.24 hectares, in the meeting of the Board of Approval held on 12s June 2006. The letter of approval was issued on 26th June 2006. The developer has now requested that.the in-principle approval granted to M/s RNB Infrastructure Private Limited may be translerred in the name of SPV i.e. M/ s. RNB SEZ Coimbatore Pvt. Ltd. The request of the developer is submitted for consideration of the BoA. 3

(r) Request of I\4/s. G.P. Realtors Private Limited for transfer of formal approval itt th" t u-" of l'I/s. Windsome Propbuild Private Limited Formal approval was granted for setting up of sector specific SFZ- lor Electronics Hardware and IT/ITES sector in Gurgaon, Haryana by M/ s G.P. Realtors private Limited over an area o{ 11.03 hectares, in the meeting of the Board of Approval held on 22nd June 2007. The letter of approval was issued on 26ft Juiy 2007. The developer has now submitted that M/s G.P. Realtors Private Limited is a 100% chain subsidiary of IREO Investment Holding III Ltd., through AZCO Ltd', a company incorporated under the rules of Mauritius. The deve'loper has requested that the formal approval granted to M/s G.P. Realtors Private Limited may be transferred in the name of SPV i.e. M/s. Windsome Propbuild Private Limited, which is a 100% chain subsidiary of IREO Investment Hodling III Ltd through Rakel Ltd, a company incorporated under the laws oI Mauritius. The SPV company has been incorporated in India. The lequest of the developer is submitted for consideration of the BoA. ("i) Request of I,I/s. APIIC for transfer of formal approval in the name of I'I/s. Bhartiya International SEZ Limited Formal approval was granted for setting up of sector specilic sEZ tor Leather sector in Nellore District, Andhra Pradesh by M/s APIIC over an area of 107.49 hectares, in the meeting of the Board of Approval held on 12h J]u.ly 2007. The letter of approval was issued on 30h July 2007. The developer has now submitted that an SPV has been constituted with the name 'Bhartiya International SEZ Limited', for the development of the SEZ. APIIC has inlormed that they hold 26'/o of the share holding of the SPV. The physical possession of 1'07.42 hectares of land has been transferred to the SPV company. The developer has requested that the formal approval may be translerred in the name of the SPV comPany i.e. 'M/s. Bhartiya Intemational SEZ Limited'. The request of the developer is submitted for consideration of the BoA. (vii) Request of I,I/s. Xansa India Limited for transfer of formal approval in the name of I\tI/s. Xansa (India) SEZ Development Pvt. (i0 Request of I\4/s Tapp Semiconductor India Private Limited, co-developer in the Electronics Hardware SEZ in Sriperumbudur by SIPCOT, for increasing area SEZ for Electronics / Telecom Hardware and support services including trading and logistics activities in Sriperumbudur, Tamil Nadu proposed to be developed by SIPCOT was notified on 31"tJuly 2007, over an area ol 4L.36.9 hectares. M/s Tapp Semiconductor India Private Limited was approved as a co-developer in the SEZ for developing an area of 20.243 hectares, in the meeting of the BoA held on 18h September 2007. The approval Ietter in this regard was issued on 12ft October 2007. The co-developer company i.e. M/s Tapp Semiconductor India Private Limited has submitted a proposal for increasing the area under their operations from 20.243 hectares to 21..457 hectares by adding an area of 1.2L4 hectares, which is now under their possession by way of leasehold rights for 99 years. An MoU dated 4ft July 2007 between co-developer and developer has been provided. A lease deed dated 11ft April 2008 has also been submitted. The request of the co-developer company is submitted for consideration of the Board of Approval. (iii) Request of I\tI/s Velankani Technology Parks Private Limited for de- notification of a survey no. in the sector specific SEZ for Electronic Hardware & Software including ITES at Sriperumbudur, Tamil Nadu. Sector specific SEZ lor Electronic Hardware & Software including ITES at Sriperumbudur, Tamil Nadu proposed to be developed by M/ s. Velankani Technology Parks Private Limited was notified on 11th December 2007, over an area of 57 .46715 hectares. The developer has now submitted a proposal for de-notification of a survey no. 160/7C'l for an extent oI 0.206397 hectares from the SEZ. After exclusion of the survey no., the area of the SEZ would be 57 .2608 hectares. This piece of iand is sought to be exchanged with land bearing survey no. 160/5 so as to straighten out this part of the boundary. The exclusion of the survey no. will not disturb the contiguity of the SEZ. The Development Commissioner, MEPZ SEZ has a-1so recommended the proposal. Ltd. has submitted a proposal for co-developer in the aforesaid SEZ for developing IT Technology Park on an area o111.271. hectares. The iand is allotted to the co-developer on lease basis for a period of 99 years. Co-development agreement dated 5ft April 2008 between the developer and co-developer has been provided. Co-development agreement dated 5ft May 2008 between the developer and co-developer has been provided. The request of the co-developer is submitted for consideration of BoA. Item No. 9: Request of 1\4/s. Essar Jamnagar SEZ (Developer) Ltd. for conversion of multi product SEZ at |amnagar to sector specific SEZ for Petrochemicals and Petroleum. Formal approval was granted for setting up of multi product SEZ al Jamnagar, Gujarat by M/s. Essar Jamnagar SEZ (Developer) Ltd. over an atea of 1125 hectares in the meeting of the Board of Approvai held on 8th August 2006. The approval letter was issued on 21st August 2006. The developer has now submitted that land acquisition is yet to be completed and is expected to take some more time. The developer has informed that they are in possession of 165 hectares of iand, which will be taken on iease. The developer has therefore requested that the multi product SEZ may be converted to sector specific SEZ lor Petroleum and Petrochemicals. The request of the developer is submitted for corsideration of BoA. Item No. 10: Request of lWs Oval Developer Pvt. Ltd. for rectification of enor in the nature of SEZ Sector specific SEZ lor electronic hardware and software in District 24 Parganas, West Bengal was notified on 22"d November 2007, over an area of 17.78 hectares. The deveioper has now submitted that in their appiication form, the sector mentioned was electronic hardware and software (including IT/ITES), whereas the notification was only for electronic hardware and software. The developer has, therefore, requested for necessary correctiors in the noti{ication. The request of the deveioper has been approved on {ile and the amended notiJication in this regard is being issued. This is submitted for inlormation of the Board of Approval. Welspun Anjar SEZ Limited for change in sector of the sector specific SEZ for Textile and Garment in Kutch District, Gujarat Sector specific SEZ 6or Textile and Garment in Kutch District, Guiarat proposed to be developed by M/s. Welspun Aniar SEZ Limited was notified over an area of 109-59-07 hectares on 17u, September 2007 . The developer has now submitted a request for changing the sector from 'Textile and Garment' to 'Engineering'. The developer has stated that companies which have proposed to set up units in the SEZ are delaying their decision due to huge depression in the US and other Europen ( ta1

Markets. The developer has mentioned that the lukewarm response of the companies has slowed down the deveiopment of the SEZ. The request of the developer was deferred in the meeting of the Board of Approval held on 4th June 2008 as representative of the State Government sought deferment. The State Government has now sent a reference recommending the proposal. The request of the developer is re-submitted for consideration of the BoA. Item No. 12: Request for extension of validity of formal approvals (i) Request of M/s. Selecto Systems Private Limited for extension of the validify period of formal approval beyond 3 years Formal approval was granted for setting up of IT/ITES SEZ in Faridabad, Haryana by M/s. Haryana Technology Park (name now changed to M/s. Selecto Systems Private Limited), in the meeting of the BoA held on 17s March 2006 over an area of 3 hectares. The letter of formal approval was issued on 16s June 2005 This is one of the cases covered under Rule 5(3) and Annexure II of the SEZ Rules 2006. The SEZ was notified on 17h April 2007 over an area of 3.34 hectares. The developer has now submitted that they have appiied to the State Government of Haryana for approval of the zoning plans. It is stated that Haryana SEZ Rules have come into effect after 9 months of their SEZ notification. The developer has further stated that they are still waiting for the approval of zoning plans. In regard to the stePs taken to implement the project, the developer has submitted that they have entered into MOUs with the eminent companies. The developer has also completed the ground water investigation and are conducting phase II for environment site assessment. The developer has mentioned that they plan to start construction in October 2008 subject to timely clearance of EIA and zoning plans. The developer has requested that, since they may not be abie to complete construction within 3 years from the date of notification, they may be granted extension of the validity period of the formal approvai for another 2 years. The formal approval is valid for three years i.e. up to L5ft June 2009. The request of the developer for extension of validity of formal approval for another two years i.e. up to 15ft June 2011 may be considered. (ii) Request of Government of Madhya Pradesh for extension of the validity formal approval granted to ITITES SEZ at Indore, Madhya Pradesh proposed to be developed by MP Audyogik Kendra Vikas Nigam (Indore) Ltd. I ( I Formai approval was granted for setting up of IT/ITES SEZ in Indore, Madhya Pradesh by M/s. MP Audyogik Kendra vikas Nigam (rndore) Ltd., in the meeting of the BoA held on 17ft March 2006 over an area of g hectares. The letter of approval was issued on 22"d June 2006. This is one of the cases covered under Rule 5(3) and Annexure II of the sEZ Rules 2006. The sEZ was notified on 2nd November 2006 over an area of 7.99 hectares. The deveroper has now submitted that they have already constructed the boundary wal and ctnsfuction of two building, ,rld o.r. utility block of approximately 50000 sq. meters is going on. mentioned that on account of some dispute with the construction agencies, the progress of work has been seriously hampered. The developer has requested that, in order to complete the corstruction of 1 lakh sq. meters, extension of formal approval for another two years may be granted. The formal approval is valid for three years i.e. up to 21st June 2009. The request of the developer for extension of validity of {ormal approval for another two years i.e. up to 21st June 2011 may be considered. Item No. 13: Request of I\4/s. Tamil Nadu Industrial Development Corporation Limited for considering N,I/s. AMRL International Tech City Limited as developer in the multi product SEZ in Tirunelveli District, Tamil Nadu. Formal approval was granted for setting up of multi product SEZ in Nanguneri Taluk, Tirunelveli District, Tamil Nadu, over an area of 1020 hectares, vide this Department's letter of approval dated 23 May 2007. The developer informed that the land area of 1020 hectares is jointiy held by TIDCO (399 hectares) and the JV Company vizM/ s. AMRL International Tech City Limited (621 hectares). The developer requested to consider M/s. AMRL International Tech City Limited, the jV Company oI TIDCO aiso as a developer. The proposal of TIDCO was considered in the meeting of the Board of Approval held on 16h May 2008, wherein it was decided that both the parties may apply again for fresh approval or in the alternative, an SPV can be formed by both the parties and the land can be in the name of the SPV which can apply for the status of the developer by way of a fresh application. The developer has now submitted that the land, which was in the name of TIDCO, has now been leased to the |V comPany and the JV company has the possession of entire 1020 hectares of land. The developer has now requested to trarufer the developer status from TIDCO to AMRL International Tech City Limited, the |V company of TIDCO. Accordingly, revised Form - A has also been submitted. Item No. 14: Request of Visakhapatanam SEZ for 100% FDI in a unit viz. l,Vs Pioneer Elastics (India) Pvt. Limited in Sector specific SEZ for texfiles and apparel proposed to be developed by IvI/s Brandix lndia Apparel Pvt. Limited Visakhapatnam SEZ has submitted that they have received an application from M/s Pioneer Elastics (India) Pvt. Ltd. for setting up of a unit in the Sector specilic SEZ for textiles and apparel proposed to be developed by M/s Brandix India Apparel Pvt. Limited, for manufacture of Woven elastic and Crochet Elastic for export. The promoters of the company are from Sri Lanka and Hong Kong with 100% Foreign Direct Investment. As per Section 9 (Z) (c) of the SEZ Act, 2005, the proposals with 100% FDI are to be approved by the Board of Approval. The detailed request received from the unit is enclosed at Annexure 9. Item No. 15: Request of IVI/s Computerized Numerical Control India Private Limite4 Mumbai for setting uP of manufacturing unit in Kandla SEZ, Gandhidham. Kandla SEZ has submitted a request of M/s Computerized Numerical Control India Private Limited, Mumbai for sebting up of a unit for Precision, Turning parts, Forging, Casting of Metals, Cold casing of Metals etc. for automobile parts, Hydraulic Industry, Aerospace Industry and Sanitary Industry. In the Approval Committee, a difference of opinion has emerged on the interpretation of Rule 18 (4)(d). Deveiopment Commissioner, Kandla SEZ has therefore requested that the proposal of Mr/s Computerized Numerical Control India Private Limited for import of brass scrap as raw material for precision engineering components may be brought before the BoA for consideration. A detailed note on the issue is at Annexure-l0. Item No. 16: Request of l\4/s Precision Polyplast Pvt. Ltd., a unit in Falta SEZ for renewal of LoP Falta SEZ has inJormed that M/s Precision Poiyplast Pvt. Ltd. is a unit for manufacfure and export of plastic flour, reprocessed floor sweeping granules / reprocessed plastic agglomerates / 1ay flat tube etc. The unit has commenced production on 2"d June 1998. The Zone has further inlormed that the unit will be completing five years on 1st June 2008 and therefore has requested for renewal of LoP for a further period of 5 years. A detailed note on the proposal is placed at Annexure -11. In terms of Rule 18(a) (a) of the SEZ Rules, the proposal for extension of the LOA of the units engaged in recycling of plastic scrap/waste shall be decided by the Board of Approval. It may be noted that the issue of renewal of letter of approvals to plastic units in SEZs was discussed in the meeting of the BoA held on 16h May 2008, wherein it was noted that the letter of approvals for these units are being extended taking due account of the fact that thousands of families of employees in these units are dependent on these units. At the same time, it was felt that in future these units should slowly be phased out after giving notice period of 3-5 years. The Board decided to grant extension of one year in all such cases and to place the matter before the EGoM for taking a view on phasing out of these units eventually. The proposal submitted by the Falta SEZ is placed before the Board for consideration. Item No, 17: Appeal of l\zl/s Quest Life Sciences (P) Ltd., Chennai against cancellation of their Letter of Permission (LOP). M/s Quest Life Sciences (P) Ltd., a unit in the MEPZ SEZ was granted letter of permission on 24-11,-2003 for setting up of a unit for generating clinical bio- analytical statistics and data management. They started the commercial production 2t

on 3-l-07 -2004. On obtaining the information that the unit was selling their services in JTA, the Development Commissioner initiated proceeding under the FTDR Act. On completion of the proceedings, a penalty was imposed on the unit. \4lhen the case was brought before the Unit Approval Committee, it decided to cancel the letter of approval. Accordingly the letter of approval was canceled, vide order dated 23.5.2008. An appeal has now been received from M/s Quest Life Sciences (P) Ltd. against the order of the Unit Approval Committee. These Theme Parks will also cater to the international tourists attending varous semrnars/meetings in the MICE facilities created in the processing zone and also as exhibits for the business promotion in the MICE segment. The domestic tourists in the Theme Parks will be allowed subject to their spending free foreign exchange. We are also proposing the activities of mass entertainment llke Amusement Parks and other sports in the non-processing area which will cater to the domestic and intemational tourists without contravening the statutory compliances on the SEZ and foreign exchange regulations. We understand the apprehensions of the Members of the BoA and would like to clarify that it is the first of it's kind project coming up in the country, we are sure that there will be some issues pertaining to the operational complances of the processing zone, which we assure will overcome without compromising on the statutory requirements.
