Aeenda for the meetins of the Board of Aooroval scheduled to be held on Item No. L: Requeot of lVVs Adarsh Prime Projects Pvt. Ltd. for convereion of in-principle to formal approval for ITITES at Banglore, Karnataka In-principle approval was Slanted for sethng up of IT/ITES SEZ at Banglore, Karnataka by M/s Adarsll Projects Pvt. Ltd. over an arca of 468.62 hectares, in the meeting of the Board o{ Approval held on 12th June 2006. LoA was issued on 3'd July 2006. The developer has now submitted a proposal seeking formal approval to the proposal on an area of "17 .84 hectares. The developer has stated that the company has the possession of land on lease basis and the area is contiguous. The request of the developer is submitted for consideration of the BoA Item No. 2: Requests for co-developer (i) Request of Nokia Telecom SEZ Park Society for co-developer in the Nokia Telecom SEZ at Sriperumbudur, Tamil Nadu SEZ for manufacture and assembling of electronics telecommunication and IT hardware and development of software, R&D activities and other services in telecommunication sectol at Sriperumbudure, Kancheepuram Distirct, Tamil Nadu proposed to be developed by Nokia India Private Lirnited was nohfied ort 19tt' ;uly, 2006, on an area of 85.37.5 hectares. The deveioper has inlormed that Nokia Telecom SEZ Park Society, an independent "not for profit" entity has been formed by all the resident ur-rits as its member, for their welfare within the processing area of the Nokia Telecom SF-Z, and with a view to develop, operate and maintain Nokia Telecom SEZ. .The Nokia f'elecom SEZ Park Society, is as a co-developer shall provide platform for the resident units to oPerate, administrator and maintain the common use facilities and share setvices on mutual association basis. An agreement dated 26th lune, 2007, between the developer and co-developer has been provided, to develop, maintain and preserve the agreed irr{rastructural assets in the processing area of the SEZ spreading across 68.47 hectares. 1 (ii) Requeot of I\4/8 ToPnotch Projects Private Limited for co-developer in IT(TES SEZ at Hyderabad, Andhra Pradesh proposed to be developed by \M/s Topnotch Infrastructure Private Limited The above mentioned SEZ was notiJied on 18th May 2007, on an area of 1'4.5 hectares. M/s Topnotch Projects Private Limited has submitted a proposal for co- developer in the aforesaid SEZ for development of the SEZ area. A Memorandum of Understanding between the developer and co-developer has been provided. (iii) Requeot of \rl/s. TAPP Semiconductor lndia Pvt. Ltd. for co-developer in the electronicy'telecom hardware SEZ at Sriperumbudur, Tamil Nadu propoeed to be developed by SIPCOT The above mentioned SEZ was notilied on 22"d December 2006, on an area of 1.89.77 hectares. M/s. TAPP Semiconductor India Pvt. Ltd. has submitted a proposal for co-developing an area of 20.243 hectares. It is stated that SIPCOT is the owner and in possession of the proposed side. Necessary land as per the proposal in being leased by SIPCOT to TAPP Semiconductor Pvt. Ltd. A Memorandum of Understanding between the developer and co-developer has been provided. (i") Request of MPSEZ Utilities Pvt. Ltd. for co-developer in the multi product SEZ at Mundra, Gujarat proposed to be developed by Mundra Port and Special Economic Zone Ltd. (MPSEZL) Multi product SEZ at Mundra, Gujarat proposed to be developed by MISEZL was notified in the Gazette of India, vide notifications dated'23.6.2006 atd 3.7.2007, over an area of 2658.19 hectares. MPSEZ Utilities Pvt. Ltd. has submitted a request for co-developer in the said SEZ for developrng infrastructure facilities. An agreement dated 14th July 2007, between the developer and co-developer has been provided. The request is submitted for consideration of BOA. Item No.3: Request for increasing/decreasing the area of the existing SEZ (i) Request of I\4/s Suzlon Infrastructure Limited for increasing the area of the sector specific SEZ fot hi-tech engineering products at Manglore, Karnataka Formal approval was granted for setting up the sector specific SEZ {or hi-tech engineering products, primarily non-co.ventional energy at Manglore, Karnataka, over an area of 175 hectares, in the meeting BoA held on 9th May 2007. The approval letter was issued 23'd May 2007 . The deveroper rras submitted a request for increasing the area o{ the sEZ fuom 175 hectares to 2s9.64 hectares. The developer has stated that the e.tire land is fully conbiguous a^d is in the possession ol ihe developer. State Government has also recommended the proposal ?or increasrng the area.

-z- 1 (ii) Request of Reliance Jamnagar lnfraatructure Limited for increaeing the area of the multi product SEZ Sector specific SEZ for peholeum and petrochemicais at Jamnagar', Guiarat was notiJied on 19 ' APril 2O06 on an arca o{ 440.08 irectares. The SEZ was converted into multi produc|SEZbt'adding an additional area 784.02 hect.ues, thereby making total area oI L224.70 hectares. Developers have now submitted a request for adding 850 hectares of additional land in the r-rotified multi-product SEZ. A developer has stated that the major porfion of the land is already in their possession The developer has further informed that, for the balance land, all the formalities have been completed and it is expected that this will be in Possession by mid July 2007. The land is stated to contiguous, vacant and there are no thoroughfares requiring contiguity relaxation. (iii) Request of W6. Chandigarh Administration for re-notification of the notified SEZ for ITITES Sector at Chandigarh. Sector specific SEZ for Electronic Hardware, IT/ITES at Chandigarh was notified on 29th lr1ray 2006 over an area of 31.4966 Hectares. There has been an anomaly in regard to allotment of land to the companies in the SEZ area in as much as the land was allotted to 14 companies on freehold basis prior to the enactment of the SEZ Act/Rules. In order to rectiJy the anomaly, an amendment was made in the allotment rules wherein an option was given to the allottee to change their allotments from freehold to leasehold. Even after the amendment, the allottees felt that the option was not feasible. After deliberations, the allottees have requested that their respective areas may be released from the SEZ area so that they do not have complications with respect to their respective titles in the land. Similarly, an area of 0.61 Hectares has been earmarked for construction of Entrepreneurs Development Centres (EDC), which is stated to be the incubation space for IT Entrepreneurs. The Developer has inlormed that this area has been erroneousiy included in the SEZ. Accordingly, the Developer has requested that the area of RGCTP under Phase I, which has been notified vide notification dated 29th May 2006 may be re-notified with area under Infosys Technologies Ltd. (12.22 Hectares only) to be the SEZ and the remaining area may be released from the SEZ. In this cormection, the Developer has inJormed that no other utrit except Infosys Technologies has started operations. (iv) Request of IVI/s Luxor Cyber City Private Ltd. fot increasing the area of the Eleckonic Hardware including ITITES SEZ Sector specific SEZ lor Electronic Hardware including IT/ITES SEZ at /illage Sikohpur, Tesil Sohna, District Gurgaon, Haryana was notified on 27.04.07 an area of 27.0785 hectares. Developer has now submitted a request for additron of 7.904 lrectares of additional land, therebl, making a total area o{ 34.9825. The developer has stated that the entire land is full1, contiguous and is in the possession of the developer.

_a- (") Request of the MIDC for decreaaing area of the sector sPecific SEZ for power generation sector at Bhadravati, Chandrapur, Maharashtra Formal approval wa6 granted for sefting up of sector specific SEZ for power generation sector at Bhadravati, Chandrapur, Maharashtra by MIDC over an area of 1100 hectares, in the meeting of the Board of Approval held on 28th September 2006. LoA was issued on 25d. October 2006. MIDC has now submitted a request Ior revising the area of the said SEZ fuom 1100 hectares to 637.48 hectares and accordingly an amendment to the letter of the formal approval. The request of the developer is subnritted for consideration. Item No. 4: Request of Maharashtra Indushial Development Corporation (MIDC) for relaxation of contiguity in Amravati, Maharashka the multi-product SEZ at Nandangagnpeth, Formal approval was granted for setting up of multi-product SEZ at Nandangaonpeth, Amravati, Maharashtra by MIDC in the meeting of the BoA held on 17th March 2006, on an area of 1010 hectares. Letter of Approval was issued on 3'd April 2006. MIDC has sought relaxation from the provision of contiguity in the aforesaid SEZ. The request of the developer is submitted {or consideration Item No. 5: Request for Authorized operations (i) Request of l\4/s Wockhardt Ltd. in the Sector Specific SEZ for Pharmaceuticals at Shendre Five Star Industrial Ares, Aurangabad District, Maharashtta The above SEZ was notified on 17-04-2007 on an area of 1-07.06 hectares. The request of the Developer for 'Authorized Operations' in Processing and Non- processing Area was considered and deferred in the BoA meeting held on 22-06-07 for want of size and quantum along with detailed justification. The Developer has been invited in the meelrng to give a brief presentation on the subiect. The written request of the Developer is placed {or consideration of BOA at Annexure -1, (ii) Request of Maharashtra Airport Development Corporation for multi- product Special Economic Zone at Mihan, Nagpur, Maharashtra. The above SEZ was notified on 29-05-2007 on an area oI 1-,5L7.5L Hectares. The request of the Developer for'Authorized Operatiors' in processing and Non- processrng Area was considered and deferred in the BoA meeting held on 22-06-07 for want of size and quantum along with detailed justification. The Developer has

-5- been invited rn lhe meeting to give a brief presentation on the subiect The written request of the Developer is placed for consideration of BOA at Annexure 2' (iii) Request of l\rVs Mundra SEZ lntegrated Textile and Apparel Park for authorized operations as co-developer of Mundra SEZ. Approval was granted to M/s Mundra SEZ lntegrated Textile and Apparel Park for authorized operations as a co-developer in the multi-Product SEZ at Mundra proposed to be developed by Mundra Port and Special Economic Zorle Limited. The developer has now sought approval to the following:- Workers' hostel / dormitories (with a built up area of 16,500 square meter ) Factory buildings/ Work Shed (i") Request of M/s. SEZ Biotech Services Pvt. Ltd. for authorized operations in Serum Bio-pharma park at Hadapsar, Pune, Maharashtra. The request of SEZ Biotech Services Pvt. Ltd for co-developer in the Serum Bio- pharma park at Pune, Maharashtra, was approved in the meeting of the BOA held on 12th JuIy 2007. The co-developer has now submitted requested for authorized operations, alongwith quantum and iustification, which is available at Annexure 3' The request of the co-developer is submitted for consideration. Item No. 6: Request of l\zl/s. Maruti Exports seeking permission for broad banding for services to overseas entity. A representation has been received from M/s. Maruti Exports, Kandla SEZ, stating that they have a unit in the Kandla SEZ with letter of perrnission for Made-up sets, co(rforter, pillow, ready made woven garments. Later on, they have been permitted to manufacture rags, and used clothing, agro-products. The export hrnover for the year 2005-06 was Rs.7.59 crores and Rs.15.25 crores in the current year. The company sought from Kandta SEZ for broad banding for service to overseas entity. The proposal for providing service to one of the American companies and the product of working is used shoes. The company has inlormed that the Kandla SEZ has rejected their proposal. The company has now represented to this Department seeking pernission for the same. The request of the companf is submitted for consideration of the BoA. Item No. 7: Appeal filed by M/s Glitz Global against rejection of their application by the Unit Approval Committee of Noida SEZ M/ s Glitz Global was issued Letter of Approval ot'r '14.12.2005 fol setting up of a urilt in the Noida SEZ for manufacture and export of Glibter and Fano, Yarn subiect to the condition that the unit would achieve positive Net Foreign Exchange during five years period. The validiq, of LoA expired on 13.12.2006. The unit was ) I (i (i I

t- issued the show cause nohce by the Noida SEZ and their LoA was cancelled on 11,."1.2007. The request of the unit for revocation of their LoA was considered in the meeting of the Unit Approval Committee and was rejected. The Company has filed an appeal against the rejection of their application by the Unit Approval Cornmittee of Noida SEZ. The appeal filed by the Unit is at Annexure -{ and comments of Noida SEZ on the Appeal of the Unit is at Annexure -5, The request of the company is submitted for consideration of the BoA. Item No.8: Request of Delhi Metro Rail Corporation for conversion of STPI to SEZ Formal approval was granted for setting up of sector specific SEZ {or IT sector at Shastri Park, New Delhi, over an area of 6 hectares, in the meeting of the BoA held on 12th June 2006. LoA was issued on 27th June 2006. The proposal for increase in the area of SEZ from 6 hectares to 12 hectares was approved in the meeting of the BoA held on 31,r May 2007 . The approval letter was issued on 21'r 1:uu.e 2007. DMRC has informed that work on setting up the park was started after submission of the formal application for approval of the SEZ on 126 May, 2003 During this process, one IT building was set up in this park between December, 2003-March, 2005. Construction of the second building in this park ra'as taken uP in end 2005 which is nearing completion. The tenants, to whom building was rented, started functioning under the STPI Rules. DMRC has requested for permrssion for changing the working lrom STPI to SEZ. The request of the developer is submitted for consideration of BOA. Item No. 9: Request of I\tI/s Sameer Industries, a unit in Kandla SEZ of extension of the Letter of Approval. M/s Sameer Industries, a unit in Kandla SEZ was granted a letter of permission on'23.9.1995Ior setting up of a new unit in Kandla Free Trade Zone (now Kandla SEZ) for manufacturing of rerycled items from imported scrap/ old and used machinery items. They started the commercial production in the year 1996. The Gujarat Pollution Control Board had issued them shut down notice on 10.2.2005 for not obtaining their consolidated consent and authorization from GPCB. The consent order expired on 30.1.2003. It was alleged in the SCN that the unit's import consisting of PVC coated copper cables athacted Hazardous Waste Rules provisions and their import required regishation with Central Pollution Control Board. On the basis of the GPCB objection, the Development Commissioner had issued notice on 23.6.2005 for cancellation oI the LOA. M/ s Sameer Industries denied all tire charges stating that the Ministry of Environment and Forests had intimated that the metal scrap imported by them in KASEZ were not hazardous and therefore, did not attract the provisions of the Hazardous Wastes Rules, 1989 /2000. They refuted the allegations made by the I

1 GPCB and stated that they have fulfilled all the conditions of the LOA and had not violated any of the conditions of the LOA. Their arguments were considered by the Approval Comrnittee who had also considered tl-re earlier recomrnendations of the Supreme Court Monitoring Committee which had visited the unit on 21,.3.2005 and noted foliowing observations:- "The unit was basically a segregation unit, braking down waste equipments and selling the same in the international market. Considerable quantities of waste were left behind. The SCMC directed SEZ authorities to cancel the LOP issued to Sameer Industries, clear the Zone of materials and shut down the industry permanently". The Approval Committee was oI the opinion that the Monitoring Committee recommendations had no legal binding and was in the form of an advice. The Committee did not favour cancellation of the LOA in view of their satisfactory export performance and employment (more than 200 persons) Under sub-rule (a) (d) of Rule 18 of the SEZ Rules, 2006, no proposal shall be considered for import of used goods for recycling provided that an extension of letter of Approval for an existing unit shall be decided by the Board. The case of the unit for an extension/renewal of its LOA is, therefore, placed before the Board for consideration subject to their obtainhg required statutory clearances from the Pollution Control authorities. Item No. 10: Requeat of l\4/s. Essar SEZ Hazira Limited for relaxation of contiguity and inclusion of 35 hectares in the sector specific SEZ for engineering sector at Hazira, Guiarat. Formal approval was granted on 21 June 2006 for setting up of sector specilic SEZ fior engineering at Hazi:a, Gujarat by M/s. Essar SEZ Hazira Limited. The developer submitted a proposal for notification of an area of 282 hectares. Ot of 282 hectales, an area of 35 hectares was considered to be non contiguous as there was a state highway dissecting this portion of land. Due to contiguib, aspect, an area of 35 hectares was excluded from final notificabion. Therefore SEZ was notified on 28d' September 2006 on an area of 247-52-22 hectares. Later on, the developer submitted that they have acquired additional area of 17.7961 hectares and intend to cover the same ir the notified SEZ. They also proposed to delete an area of 39.031 hectares (29.9590 hectales plus 9.0717 hectares) from the notified SEZ. Pursuant to these amendments, the total area of the SEZ will be 226.3476 hectares, as against 247.5222 hectares notified earlier. The developer has also requested that 35 hectares, which was left out earlier because of contiguity aspect be included in the SEZ notificatiory thereby making the area of the SEZ as 261, hectares, bJ, relaxing the contiguiq, criteria. The developer l-ras urJormed that the entire area will be used as processing area. The requests of the developer are submitted for consideration

Glitz Globai Inc. were issued LOA No.09/19l2005_ Proj/558 dated 14.12.2005 for setting up a unil in Noida Special Economic Zone for the manufactue and export of Glitter and Fancy yam subject to the condition inter-alia that the unit would achieve positive Ner foreign Exchange ffiE) during five years period. For implementation of the pro.joct, the unlt had not exeouted Bond cum Legal Undertaking. The unit has been allotted plot No.129Gl45 measuring 645 sq. mtrs, for implementation of the project. As per condition No_3. the LOA is valid for one year from its date of issue within which the unit is required to implement the project and commence production. The validity of LOa huO expired on 13.12.2006 and the unit had not taken aay step to implement the project. The unit had not even started construction of building on the allotted piot. In view of the position explained above, the unit was issued notice dated 18.12.20O6 to show oause as to why LOA dated 14.12.2005 should not be oancelled for non implementation of the project within the validity period of LOA. The unit did not submit the reply of show cause notice within the stipulated time period. During past one year, the unit has not taken any step for implementation of the project and the LOA dated 14.12.2005 was cancelled vide lener dated I 1.01.07. . The Proprietor of the unit met Development Commissioner and 16.01.07 and requested to revoke the cancellation ofLOA. The unit was told that they may apply afiesh for issue ofLOA as Zone does not have the power for revocation of cancelled LOA. Item No. 2: Proposals for conversion of In-principle to formal approvals A list of proposals for conversion of in-principle to formal approvals is at Annexure 2 and is submitted for consideration of the Board of Approval. Item No. 3: Requests for co-developer (i) Request of IBS Softwate Services (P) Ltd. for co-developer in the Electronics Technology Park SEZ, Trivandrum for ITITES IT/ ITES SEZ at Thiruvananthapuram, Keral a by M/s Electronics Technology Park was notified on 30ft November 2006 on an area ol 12.55 hectares. M/s IBS Software Services (P) Ltd. has submitted a request for co- developer in the said SEZ. The company has stated that they are in possession of 2.129 hectares of land on lease for 25 years. An agreement dated 16h February 2007 between the co-developer and developer has been provided. (i0 Request of M/s. SEZ Bio-Tech Services Private Limited as co-developer in Biotech and Pharma SEZ at Hadapsar, Pune, Maharashtra, proposed to be developed by n/r. Serum Bio-Pharma Park SEZ Biotech and Pharma SEZ at Hadapsar, Pune proposed to be developed by M/s. Serum Bio-pharma Park SEZ on an area of 2i.1793 hectares. LoA was issued on 9s June 2006. The said Zone was notified on 18h July 2006. M/s. SEZ Bio-Tech services Private Limited has submitted a proposal for co.developer in the said SEZ. A copy of the agreement dated 23.06.2007 between the developer and co-developer has also been provided. The proposal was considered in the meeting of the BoA held on 12th July 2007 and. was deferred as the net worth of the developer was not known. since the net worth of the developer is now available, the proposal is submitted for consideration of BOA.

-2- Item No. 4: Request of Mahindra World City Chennai for increasing the area of the IT SEZ at Kancheepurma, Tamil Nadu Sector specific SEZ for IT, Hardware and Bio-informatics at Kancheepuram, Tamil Nadu proposed to be developed by Mahindra World City Developers Limited, was notified on 15h December, 2006 on an area of 262.13.8 hectares. The developer has now submitted a request for extending the area of the IT SEZ by an additional 7.13 hectares. The developer has stated that the land required for the same has already been procured by the company and is in their possession. The request of the developer is submitted for consideration of the BOA. Item No. 5: Request of Adani Power Limited for increase in power generation capacity in the SEZ for supply of power at Mundra, Kutch, Gujarat Sector specific SEZ 6or supply of power to SEZs, EOUs and others at Mundra, Kutch, Gujarat, proposed to be developed by Adani Power Private Limited, was notified on 10h May, 2007 on an area of 29348-10 hectares. The developer has now submitted that, in the Phase -I, they would like to increase the capacity of the proposed power generation project in the SEZ from 2000 MW to 2@0 MW, on account of technological advancement. In order cope up with the increased demand estimates arising out of certain power intensive units, the developer, in the Phase-II would be further increasing the capacity of the power generation plant to 5040 MW for supply to SEZs and EOUs. The request of the developer for increasing the capacity of the power generation in the notified SEZ upto 5(X0 MW capacity is submitted for consideration of the BOA. Item No.5: Request of I,I/s. Gujarat Textiles for kansfer of unit from Falta SEZ to Kandla SEZ M/s. Gujarat Textiles is a units in Falta SEZ with letter of permission for manufacture of processed garments/rags. The LoP is valid upto 3L* December, 2N7. The unit has informed that their request for transfer from Falta SEZ to Kandla SEZ may be considered as their unit is not viable at Falta SEZ: (D (ii) (iii) FSEZ is far 60 kms port but KASEZ is only 6 ksm away from port. FSEZ is situated in eastern Region from Eastern Region to ship at Africa and Middle East is much costlier then Western Region of our country. The product is low in value but having Iarge volumes. Request of I\4/s Wockhardt Limited for approval and development of units concurrent with construction and development of boundary wall and other infrastructure a a a t Item No. 9: The above mentioned SEZ was notified on 17e April 2007 on an area of 107.05 hectares. The processing area shall be fully secured by a boundary wall before the approval for units is given. The developer has stated that the boundary wall around their SEZ would be approximately 6 kms long and its construction would take around 6 to 8 months. As per the developer, this would cause delay in approva.l of units and consequent delay in procurement of machinery and thus, corunencement of operation of the units. The developer has therefore requested that the pre-condition of construction of the wall before approval of units may be reviewed and relaxed. In this regard, the developer has assured that a properly fenced bonded warehouse and administrative area with
