It was seen from the Firm’s letter dated 25.8.2007 that the process of converting Whole Squid to Whole Cleaned Squid involves deskinning of Squid from the body, and cleaning the body and tentacles as one whole portion without the head and tentacles getting severed from the body. Depending on customer’s preference, the product is exported as one piece OR tentacles with head severed from the body & tubes (body) packed separately. The same item of Whole Cleaned Squid is converted into Tantacles and H&G Squid. Product is one and same, only presentation and packing is different. MPEDA vide their letter dated 9.1.2008 that has confirmed that Squid whole cleaned (consisting of squid tubes, wings and tentacles) and stuffed squid with wings and tentacles are the same products but presented in different form. Export qty. =9030.24kgs. Import item @73% yield, required for producing export item (9030.24x.73)=12370kgs Import items applied for (6492+6050)=12542Kgs. Difference of 172Kgs is equally adjusted as under to arrive at qty. of import items: Frozen whole squid: 649286=6406Kgs Frozen squid head & tentacles: 605086=5964Kgs 12370Kgs It was also noted that as per MPEA letter No. 11(7)/200607/MSHO dated 31.7.08 the recoverable wastage from squid processing waste is 1314% on dry weight basis and cost of recoverable waste material on dry weight basis is Rs. 25 to Rs. 30 per Kg. Cost of recoverable wastage works out as under: Total waste generated(123709030)=3340Kg. It was noted that water content of Squid is generally 74% Waste generated on dry weight basis (3340x.26)=868Kg. Recoverable waste@14%(868x.14)=121Kg. Cost of recoverable waste @ Rs. 30per Kg(121x30)=Rs. 3630.00 CIF Value: 286892÷6492 =Rs. 44.19per Kg 267359÷6050 Qty. of recoverable wastage to be adjusted from import input (3630÷44.19) =82Kgs Adjusted as under Frozen whole squid: 640641=6365 Kgs. It was seen from the Firm’s letter dated 25.8.2007 that the process of converting Whole Squid to Whole Cleaned Squid involves deskinning of Squid from the body, and cleaning the body and tentacles as one whole portion without the head and tentacles getting severed from the body. Depending on customer’s preference, the product is exported as one piece OR tentacles with head severed from the body & tubes (body) packed separately. The same item of Whole Cleaned Squid is converted into Tantacles and H&G (headless and gutted) Squid. Product is one and same, only presentation and packing is different. MPEDA vide their letter dated 9.1.2008 that has confirmed that Squid whole cleaned (consisting of squid tubes, wings and tentacles) and stuffed squid with wings and tentacles are the same products but presented in different form. It was also noted that as per MPEA letter No. 11(7)/200607/MSHO dated 31.7.08 the recoverable wastage from squid processing waste is 1314% on dry weight basis and cost of recoverable waste material on dry weight basis is Rs. 25 to Rs. 30 per Kg. Committee decided to adjust the recoverable waste while fixing input output norms as under: Total waste generated({69496(31039+19693)} =18764Kg.. It was noted that water content of Squid is generally 74% Waste generated on dry weight basis (18764x.26) =4878Kg. Recoverable waste@14%(4878x.14) =683Kg. Cost of recoverable waste @ Rs. 30per Kg(683x30) =Rs. 20490.00 CIF Value per Kg of frozen whole squid (6412700÷74880) =Rs. 85.63 CIF Value of 69496 Kg of frozen whole squid =Rs. 5950942.00 CIF Value after adjusting cost of recoverable waste (595094220490)=Rs. 5930452 Frozen whole squid to be allowed for import (5930452÷85.63) = 69256Kg. Cost of recoverable waste @ Rs. 30per Kg(1705x30) =Rs. 51150.00 CIF Value per Kg of frozen whole squid (173564x78.12)=Rs. 13558819.00 CIF Value after adjusting cost of recoverable waste (1355881951150)=Rs. 13507669.00 Frozen whole squid to be allowed for import (13507669÷78.12)=Rs. 172909Kg. As regards, conversion of advance licenc from norms to no norms category, Policy Division has conveyed vide their I.D.Note 01/94/180/292/PC4 dated 26.8.2008 that as this case involves fixation/modification of product norms the request may be routed to PRC vide Para 2.5 of FTP 200409. In this regard it was noted that the import item in this case and in SION D26 is the same. Committee decided that the case may be moved on file and submitted to DGFT for decision through JDG™ who deals with policy under Chapter 4 of FTP.
