The Meeting No. 07/AM-11 for the licensing year 2010-11 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 13.05.2010 in Room No. 108 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting No. 06/AM11 held on 06.05.2010 were ratified. Thereafter, Agenda for individual cases for Meeting No. 07/AM11 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

In view of this Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case as detailed below: - (i) The item of import No.1 i.e Acrylic Fibre (5-7 D) may be allowed as applied by the firm; (ii) The item of import No.2 i.e Cationic dyes may be allowed as applied by the firm; (iii) The item of import No.3 may be disallowed. The Regional Authority shall be advised to take necessary action subject to compliance of other usual conditions.

The Regional Authority shall be advised to take necessary action subject to compliance of other usual conditions.

Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case on the basis of report of team, who visited the similar unit of another firm by allowing 3% wastage. Weight of Plastisole should match in the export and import item. A copy of report is attached for ready reference. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 63 M/s A.S.Marimuthu, TamilNadu

PRO version NC07/11 dt. 13.05.2010 F.NO.1/84/162/365/AM10 -DES-V Ratification of input output norms in respect of Advance Authorization No. 3210027635 dt. 09.09.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to call for the following information/documents from the applicant firm: - (i) Technical literature of all Chemicals asked for in this case alongwith recipe & justification of quantitative requirement; (ii) Coating composition of all Chemicals. It was decided to defer the case for re-listing on 10.06.2010.

Case No. 64 M/s Neelkanth Fibres Pvt. Ltd., Panipat NC07/11 dt. 13.05.2010 F.NO.1/84/50/191/AM10 -DES-V Ratification of input output norms in respect of Advance Authorization No. 3310014388 dt. 04.12.2009. Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting felt that Viscose Tow waste have no more than 5% extraneous materials. In view of this Committee decided to ratify the Advance Authorization issued in this case by allowing 5% wastage on item of import i.e 26250 Kgs. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 65 M/s Krishna Overseas, Kolkata NC07/11 dt. 13.05.2010 F.NO.1/84/162/416/AM10 -DES-V Clarification in respect of export product 100% Natural Silk Floor Covering (Silk Made-ups) – regarding. Decision: The Committee considered the case as per agenda and went through all the relevant details pertaining to this case including the ISEPC letter dated 26th April, 2010 & FIEO letter dated 30th April, 2010. The sample test

PRO version report No. 448 dated 25th February, 2010 certified by Central Silk Board, Kolkata was also inter-alia discussed. It was observed that in the DFIA licence in question export item is 100% Natural Silk made-ups (other than those covered under SION, J-123) containing Mulberry Raw Silk. The Committee also noted that the invoice/packing list etc clearly mentioned the ITC (HS) code as 57023920 which pertains to Floor covering of silk and made-ups, whereas customs generated shipping bills mentioned the ITC (HS) code as 63079012. In view of this Committee after detailed deliberations in consultation with the representatives of technical authorities present in the meeting felt that the DFIA licence in question for export of 100% Natural Silk made-ups (other than those covered under SION, J- 123) containing Mulberry Raw Silk is certainly covered under SION, J -124 irrespective of ITC (HS) code used in shipping bills in this case.

The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 66 M/s A.S.Marimuthu, Kochi NC07/11 dt. 13.05.2010 F.NO.1/84/50/288/AM10 -DES-V Ratification of input output norms in respect of Advance Authorization No. 3510029336 dt. 02.03.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to call for the following information/documents from the applicant firm: - (i) Technical literature of all Chemicals asked for in this case alongwith recipe & justification of quantitative requirement; (ii) Coating composition of all Chemicals.

     It was decided to defer the case for re-listing on 10.06.2010.
