The Committee after detailed deliberation in consultation with technical authorities present in the meeting felt that there is no wastage involved in this process, hence, decided that import item at S.No.1, 2 & 3 may be allowed on net to net basis with accountability clause. Similarly, the import item at S.No.4, 5 & 6 may also be allowed on net to net basis with accountability clause. The description of import item No.5 may be amended to read as “Relevant Glass Crystals”.

The Style No. ‘123300’ mentioned on the export item may be amended to read as ‘123870’.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that case is under examination of (MSME) and comments are awaited from them. It was therefore decided to await comments from them and defer the case for re-listing on 06.08.2009.

Ltd., New Delhi NC 14/10 dt. 02.07.2009 F.No. 01/84/50/27/AM-10/DES-V Ratification of input output norms against Advance Authorization No. 0510240646 dated 30.04.2009 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the CAD/CAM, Calculation, measurement submitted by the firm. The Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case as applied by the firm.

M/s Florals India, Jaipur NC 14/10 dt. 02.07.2009 F.No. 01/94/180/763/AM-09/PC-4 Regarding grant of DFRC Licence. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case has been received from PC-IV Section. This is a DFRC licence. The Committee observed that the bifurcated Qty. of Silk & backing fabric has been given accordingly, the net content of Silk can be finalized by R.A. As regards type of Silk, applicant firm has stated that type of silk in this case is Dupion Silk Yarn. As per SION at S.No. J-123, there are two options for the description of import item i.e Dupion Silk Yarn may be either gummed and untwisted or degummed and twisted. Further, if the import item sought is gummed and untwisted, the Qty. of Dupion Silk Yarn is 1.39 kg/kg content in the export product and similarly, if the import item sought is degummed and twisted, the Qty. of Dupion Silk Yarn is 1.05 kg/kg content in the export product. Even if the both the items of Dupion Silk Yarn is sought, the Qty. of silk can be bifurcated and such total Qty. of Dupion Silk in the export product be accounted for. On going through the relevant details, it is clear that export product is covered under SION, J-123. In view of this, Committee decided that R.A may decide the DFRC case accordingly. With this observation, case may be referred back to PC-IV Section for their necessary action.
