MINUTES OF THE MEETING NO. 01 (2018-19) OF EXPORT FACILITATION COMMITTEE (EFC) HELD ON 27.04.2018 AT 03.00 P.M. AT UDYOG BHAWAN, NEW DELHI UNDER THE CHAIRMANSHIP OF SHRI NIKUNJ KUMAR SRIVASTAVA, ADDITIONAL DIRECTOR GENERAL OF FOREIGN TRADE, DGFT.

Meeting No. 01 (2018-19) of EXIM Facilitation Committee (EFC) was held under the chairmanship of Shri Nikunj Kumar Srivastava, Addl. DGFT on 27.04.2018 at 03.00 P.M. in Room No. 04, H-Wing, Udyog Bhavan, New Delhi to consider the applications for export of ‘restricted’ items.

Altogether 29 applications (including 23 deferred cases) were considered by the EFC, out of which 08 cases were approved (including 02 post-facto approvals), 02 cases dropped and remaining 19 cases deferred due to want of comments/NOC from the concerned administrative Ministry / Department or in await of information from the applicants. The decision of the Committee is indicated in the tabulated statement given below:

The EFC noted that similar case for export of Strychnos Whole (Strychnos Nux Vomica) was allowed in July, 2017 with the permission of Ministry of AYUSH, vide O.M. No. K1103/01/2017-DCC (Ayush) dated 28.07.2017. The Ministry of AYUSH had stated that ‘Strychnos Nux Vomica Semen’ does not fall under the Prohibited list of 29 plants notified by DGFT on 14.10.1998 and is part of list of 242 highly traded medicinal plants. Therefore, they have no objection to the proposed export.

Ozone Cell vide email dated 25.04.2018 has informed that the registration of Enterprise under ODS Rules, 2000 is under process and the case is being resolved within the domestic and international statutory obligation of the intended item (1,1,1 trochloroethane), a globally phased out chemical. The EFC noted that the time taken by Ozone Cell of MOEF&CC in finalizing their comments / recommendation on various cases is considerably on higher side and it was decided to make a reference to Secretary, MOEF&CC from Secretary Commerce / DGFT.

EFC decided to seek inputs of Import Division of DGFT for clearance of the case for re-import of exported vehicles after Bullet Proofing work and other value addition if any, in Israel

(i) Deferred cases : Cases shown as deferred imply that approval is pending for want of comments/NOC from the concerned Technical Agencies or requirement of additional information/clarification from the applicant firm.

(ii) Approved cases: Written permissions for cases approved by EFC is issued by DGFT(Hqrs.) to the firm(s) with a copy to Regional Authority (RA) concerned, for issue of export license. The applicant are required to submit their application in e-Com system with Regional Authority concerned alongwith permission letter of DGFT(Hqrs), if not applied earlier, for obtaining export license. No fresh fee is required to be paid. Please note, as per Appendix 2K of FTP-2015-20, the fee for obtaining export license is Rs. 1000/- only (per application) irrespective of item / quantity / FOB value etc.

(iii) Approved post-facto : Cases shown as Approved post-facto implies that approval against those cases have already been issued by DGFT (Hqrs), with the approval of Chairman, EFC in terms of Para 2.51(c) of HBP (Handbook of Procedure 2015-20). In order to facilitate export, Para 2.51 gives power to Chairman, EFC to issue authorization in those cases, which have been discussed by EFC at least once in previous meeting and got deferred, and where NOCs / recommendations have been received subsequently from the concerned agency(ies) with no divergence in views. However, such cases, shall be brought before EFC in its subsequent meeting for approval on ex-post facto basis.
