Monitoring of the performance of M/s. TATA CONSULTANCY SERVICES LIMITED for the FY 2022-23 to FY 2023-24. (मूल एलओए संWया सी ज़-एसईजेड/यूज़एसईजेड/रोमा- टीसीएस/01/2019-20, िदनांक 02.03.2020)

(Original LOA No. SEEPZ-SEZ/NEWSEZ/ ROMA- TCS/01/2019-20, Dated 02.03.2020) इकाई ारा िव@ वष" 2022-23 से िव@ वष" 2023-24 के )लए वाQषक िनOपादन Kरपोट" &+तुत क गई। इकाई ने वष" 2022-23 से 2023-24 के दौरान संचयी आधार पर 6198.80/- करोड़ [पए का सकारा\मक एनएफई हा:सल िकया है।

The Annual Performance Report for the FY 2022-23 to FY 2023-24 was submitted by the unit. The unit has achieved positive NFE of Rs. 6198.80/- Crore cumulative basis during the years 2022-23 to 2023- 24. िनण"य:- िवचार-िवमश" के बाद, सिम<त ने सेज़ िनयम, 2006 के िनयम 54 के संदभ" म मेसस" टाटा कंस$टसी सQवसेज )लिमटेड (मेसस" रोमा िब$डस" &ाइवेट )लिमटेड-एसईजेड) के &दश"न को नोट िकया।

Decision:- After deliberation, the Committee noted the performance of M/s. TATA CONSULTANCY SERVICES LIMITED (M/s. Roma Builders Pvt. Ltd- SEZ) in terms of Rule 54 of SEZ Rules, 2006. अय को धयवाद ^ापन के साथ बैठक समा_ हुई।

a. Proposal : Application of M/s. Tata Consultancy Services Ltd. for permission to setting up of Cafeteria in 1 st and 2nd floors, Olympus B, Roma Builders Pvt. Ltd. –SEZ, Off, Ghodbunder Road, Village Kavesar, Thane, Maharashtra- 400 607.
b. Specific Issue on which decision of AC is required: -
Approval for setting up of Cafeteria in their SEZ Unit at 1 st and 2nd floors, Olympus B, Roma Builders Pvt. Ltd. –SEZ, Off, Ghodbunder Road, Village Kavesar, Thane, Maharashtra- 400 607. Details of Cafeteria are as under: Area (in Sq. Ft.) Floor Seating Capacity 15,228 Sq. Ft. 1st Floor 690 28,876 Sq. Ft. 2nd Floor 1350 c. Relevant provisions of SEZ Act, 2005 & Rules, 2006/Instruction/
Notification :- In terms of Rule 11 (5) of the SEZ Rules, 2006 which stipulates that –
“The Developer may, with the prior approval of the Approval Committee, grant on lease land or built up space, for creating facilities such as canteen, public telephone booths, first aid centres, crèche and such other facilities as may be required use of the unit” MoC&I Instruction No. 95 dated 11.06.2019, item No. 3 (a) which stipulates that – “The facilities as envisaged under the proviso to Rule 11(5) of the SEZ Rules could also be created by a unit for its exclusive use subject to obtaining a NOC from the Developer as well as necessary NOCs / clearances / approvals from the relevant statutory authorities.” d. The applicant has submitted following documents: a. NOC from the Developer b. Copy of Letter of Approval c. Floor plan layout demarcated with cafeteria area d. Food Safety and Standard Act 2006 license No. 11520014000322 (1st Floor) and license No. 11520014000321 (2nd Floor) issued by Food and Drug Administration, Maharashtra State e. Trade license No. 3607 dated 18 th July 2022 issued by Thane Mahanagar Palika Thane f. Fire NOC No. 60/01 dated 04 th July 2022 by Fire Stations Balkum g. Agreement entered between TCS and Cafeteria Services Provider, M/s. Cheftalk Food & Hospitality Services Pvt. Ltd. h. Trade license NO. 3607 & 3608 dated 18 th July 2022 with correct area (in Sq. Ft.) issued by Thane Nagar Palika Thane a. Fire NOC 60/02 dated 04 th July 2022 issued by Fire Station Balkum 8 Other documents Copy of verification report by the Specified Officer, Aurum-SEZ

The unit vide it’s letters dated 26.07.2022 and 16.01.2023 has stated as under: They would like to set up a Cafeteria at 1 st and 2nd floors of the Unit as a part of employee welfare activity and for the wellbeing of their employees working in the above SEZ units. The Cafeteria will be used exclusively for 12,00 employees expected to be working from their SEZ unit. Also, they have entered into an agreement with service provider, M/s. Cheftalk Food & Hospitality Services Private Limited, who will supply hygienic and quality foods/beverages to the employee at an agreed rate. a. Observation :- The above agenda was placed at the Approval Committee Meeting held on 28 th April 2023. The Committee had deferred the proposal of M/s. Tata Consultancy Services for setting up Cafeteria at TCS Olympus B, RBPL-SEZ, Thane in accordance to the provision of Rule 11(5) of SEZ Rules as the Fire NOC for the place was not specific. Further, Committee also directed the unit to re-submit the proposal and directed to Specified Officer to scrutinize the proposal of the unit for verification of all compliance. The Specified Officer, ROMA-SEZ has submitted verification report vide letter dated 28.04.2025 to this office and stated that following documents have been submitted by TCS for the regularization of Cafeteria Facility. All the documents have been verified and found to be in order:

1. Fire NOC (First Floor and Second Floor)

2. Trade License (First Floor and Second Floor)

3. List of Items installed in the Unit which were procured on payment of duty

4. List containing items which were procured with benefit of Duty (After examination of goods by AO and Appraiser unit was asked to pay duty vide office letter F. No.SEZ1-15/6/2024-CUSTOM-SEEPZ/Mumbai dated 21.08.2024. Duty has been recovered from unit (Payment proof of Duty surrendered and interest challan)

5. Canteen Service Agreement Valid till dated 31.03.2026 e. Recommendation:

The application of the unit for Permission to setting up of Cafeteria in permission to setting up of Cafeteria in 1st and 2nd floors, Olympus B, Roma Builders Pvt. Ltd. –SEZ, Off, Ghodbunder Road, Village Kavesar, Thane, Maharashtra- 400 607. Hence, submitted to Approval Committee Meeting for consideration in terms of Rule 11 (5) of the SEZ Rules, 2006 and MoC&I Instruction No. 95 dated 11.06.2019, item no. 3(a).
