In response, the applicant has submitted the copy of LOI vide letter dt. 26.07.2024. ADC’s Recommendation Proposal of M/s. Faran Exim Private Limited for setting up a New Warehousing unit in Arshiya Panvel FTWZ Services Private Limited at M/s. Arshiya-SEZ is submitted to Approval Committee for consideration in terms of Rule 17 & 18 of SEZ Rules, 2006.

Marketing strategy/buy back plan
Ṭhe applicant has stated that their company employs a backward
integration strategy to promulgate FTWZ and logistics services for
their global clients. With a focus on first mile and last mile
connectivity, as a part of their marketing strategy, they offer their
clients with end to end solutions by providing a market free trade
zone and other warehousing solutions in the form of just in time
supply of goods. They plan to follow systematic approach in
marketing for usage of FTWZ for turnkey projects, stock and sell,
spares,
raw
material/consumables,
consolidation,
packing/repacking, quality checking and testing etc vertical also.
Their marketing staff shall focus on their FTWZ Services.
AIPL will contract foreign and domestic clients for storage
of their goods in FTWZ and can hold until they fetch a better price.
AIPL will import, export or re-export the goods as per the

instruction of their foreign and DTA buyers and suppliers. Other information The applicant has stated that as their prime target is to provide warehousing facility for import, export and re-export the cargo from this FTWZ facility by DTA and foreign clients they find substantial possibility to earn NFE by servicing these clients. They shall offer end to end warehousing solutions for store of clients cargo including LCL, FCL and Air shipments. As an expert logistics player and FTWZ unit they can provide cost effective solutions for all import and export cargo. There in house expertise offers end to end service through the FTWS. Further they stated that they will be able to effectively compete with traders operating out of Dubai/Singapore as they will have the large Indian manufacturers to whom they can supply do and also do hassle free re-export to cater to the regional markets. Further their foreign clients can source their global requirement from the DTA thereby giving boost to the make in Indian concept of Govt. of India. The DTA suppliers will also benefit in supplying to the FTWZ as they will be able to claim the incentives much faster. Proposed Business model through Trading business will be as under. Warehousing of all items mentioned under ITC(HS) classification of Import and Export except prohibited, canalized & goods under chapter 71. Packing or re-packing, Labelling, Re-Labelling Quality Checking and Testing Consolidation of cargo Observations It is to mention here that, the said proposal for setting up a New Unit in Arshiya-SEZ was placed before the 160th Approval Committee meeting held on 18.07.2024, wherein, the Committee had observed that as the applicant failed to submit the confirmation on available space with the Co-Developer as on date of application. Further, on a representation by another Co-Developer, viz. M/s. Arshiya Panvel FTWZ Services Private Limited regarding the occupation of the said place, the committee directed the office to examine the matter in detail. The Committee thus deferred the proposal.

The applicant has stated that Ascendas Panvel FTWZ Private
Limited (‘APFPL’) was incorporated in February, 2010 for the purpose
of carrying out activity in the nature of Developing, Operating and
maintaining
SEZs/FTWZ,
Industrial
Parks,
Logistics
Parks,
Warehouses, Infrastructure or infrastructure projects; and for
carrying out real estate Development activities and leasing the same
in SEZs/FTWZ, Warehouses, and other ancillary and/or allied
activities, on the land of the company or other land or any immovable
property whether belonging to the company or not.
Ascendas Panvel FTWZ Private Limited is a CapitaLand group
company promoted by Ascendas Property Fund (India) Pte. Ltd. Since
Ascendas Panvel FTWZ Private Limited (‘APFPL’) is an approved
codeveloper vide formal approval No. F.2./172/2007-SEZ Dated:
05.12.2016 as amended from time to time for total of 6 warehouses
Customers:
APFPL shall be providing said services to its existing and past

customers as Co-developer since 2018, and they have deal with many of the clients who have set up FTWZ unit in our SEZ project and which are into same line of business of warehousing. From many years they have monitored and have come across many FTWZ units very closely. Additionally, they will recruit the Employees who would be having adequate experience of Warehousing Business for their proposed unit. Therefore, day to day operations of unit shall be taken care of. Observations It is to mention here that, the said proposal for setting up a New Unit in Arshiya-SEZ was placed before the 160th Approval Committee meeting held on 18.07.2024, wherein, the Committee had observed that as the applicant failed to submit the confirmation on available space with the Co-Developer as on date of application. Further, on a representation by another Co-Developer, viz. M/s. Arshiya Lifestyle Limited regarding the occupation of the said place, the committee directed the office to examine the matter in detail. The Committee thus deferred the proposal.
- In response the Co-Developer has submitted the application i.r.o. Additional Representation Objecting to the AIPL and the Asscendas.
- M/s. Arshiya Lifestyle Limited (Co-Developer) have filed Writ
Petition No. 24167 of 2024 in High Court with following
praying –
a. Respondent No.4 is not eligible to be registered and/or approved as an Unit, and therefore the application made by Respondent No.4 is ab initio null and void; b. Issue a writ of certiorari calling for the records of the Respondent No.4’s application for setting up of a new unit for warehousing in the Free Trade Warehousing Zone (SEZs) at Village Sai, Taluka Panvel, District Raigad, Maharashtra filed with the office of the Respondent No.2 and after going into the legality thereof quash and set aside the same as not maintainable. c. Issue a Writ of Mandamus or any other appropriate writ, order or direction, directing the Respondent No.3 to reject the Respondent No.4’s application for setting up of a new unit for warehousing in the Free Trade Warehousing Zone (SEZs) at Village Sai, Taluka Panvel, District Raigad, Maharashtra developer by the Respondent No.5. d. Issue a Writ of Mandamus or any other appropriate Writ, order or direction, directing the Respondent No.3 to reject the Respondent No.4’s approval as a Co- Developer in term of Section 10 of the Special Economic 149
Zone Act, 2005 and Instruction No. 50 bearing reference
no. F.5/1/2010-SEZ dated 15.01.2010 issued by the

e. Issue a Writ of Mandamus or any other appropriate
quashing and setting aside the Respondent No.2’s

Rule 17 and 18 of the SEZ Rules.

Marketing strategy/buy back plan
Ṭhe applicant has stated that their company employs
a backward integration strategy to promulgate FTWZ and logistics services for their global clients. With a focus on first mile and last mile connectivity, as a part of their marketing strategy, they offer their clients with end to end solutions by providing a market free trade zone and other warehousing solutions in the form of just in time supply of goods. They plan to follow systematic approach in marketing for usage of FTWZ for turnkey projects, stock and sell, spares, raw material/consumables, consolidation, packing/repacking, quality checking and testing etc vertical also. Their marketing staff shall focus on their FTWZ Services. APFPL will contract foreign and domestic clients for storage of their goods in FTWZ and can hold until they fetch a better price. APFPL will import, export or re-export the goods as per the instruction of their foreign and DTA buyers and suppliers. Other information The applicant has stated that as their prime target is to provide warehousing facility for import, export and re-export the cargo from this FTWZ facility by DTA and foreign clients they find substantial possibility to earn NFE by servicing these clients. They shall offer end to end warehousing solutions for store of clients cargo including LCL, FCL and Air shipments. As an expert logistics player and FTWZ unit they can provide cost effective solutions for all import and export cargo. There in house expertise offers end to end service through the FTWS. Further they stated that they will be able to effectively compete with traders operating out of Dubai/Singapore as they will have the large Indian manufacturers to whom they can supply do and also do hassle free re-export to cater to the regional markets. Further their foreign clients can source their global requirement from the DTA thereby giving boost to the make in Indian concept of Govt. of India. The DTA suppliers will also benefit in supplying to the FTWZ as they will be able to claim the incentives much faster. Proposed Business model through Trading business will be as under

setting up a New Unit in Arshiya-SEZ was placed before the 160th Approval Committee meeting held on 170
Observations 18.07.2024, wherein, the Committee had observed that as the applicant failed to submit the confirmation on available space with the Co-Developer as on date of application. Further, on a representation by another Co- Developer, viz. M/s. Arshiya Lifestyle Limited regarding the occupation of the said place, the committee directed the office to examine the matter in detail. The Committee thus deferred the proposal.
- In response the Co-Developer has submitted the application i.r.o. Additional Representation Objecting to the AIPL and the Asscendas.
- M/s. Arshiya Lifestyle Limited (Co-Developer) have filed Writ Petition No. 24167 of 2024 in High Court with following praying – a. Respondent No.4 is not eligible to be registered and/or approved as an Unit, and therefore the application made by Respondent No.4 is ab initio null and void; b. Issue a writ of certiorari calling for the records of the Respondent No.4’s application for setting up of a new unit for warehousing in the Free Trade Warehousing Zone (SEZs) at Village Sai, Taluka Panvel, District Raigad, Maharashtra filed with the office of the Respondent No.2 and after going into the legality thereof quash and set aside the same as not maintainable. c. Issue a Writ of Mandamus or any other appropriate writ, order or direction, directing the Respondent No.3 to reject the Respondent No.4’s application for setting up of a new unit for warehousing in the Free Trade Warehousing Zone (SEZs) at Village Sai, Taluka Panvel, District Raigad, Maharashtra developer by the Respondent No.5. d. Issue a Writ of Mandamus or any other appropriate Writ, order or direction, directing the Respondent No.3 to reject the Respondent No.4’s approval as a Co-Developer in term of Section 10 of the Special Economic Zone Act, 2005 and Instruction No. 50 bearing reference no. F.5/1/2010-SEZ dated 15.01.2010 issued by the Respondent No.1. e. Issue a Writ of Mandamus or any other appropriate quashing and setting aside the Respondent No.2’s recommendation to the Approval Committee chaired by the Respondent No.3 for consideration in terms of Rule 17 and 18 171
of the SEZ Rules. f. Pending the hearing and disposal of the present Petition, this Hon’ble Court may be pleased to suspend the Respondent No.3 and all other authorities to refrain from taking a decision on the Respondent No. 4’s application for setting up of a new unit for warehousing in the Free Trade Warehousing Zone (SEZs) at Village Sai, Taluka Panvel, District Raigad, Maharashtra developer by the Respondent No.5. g. Pending the hearing and final disposal of the present Petition, this Hon’ble Court may be pleased to suspend the Respondent No.4’s appointment as a Co-Developer for the Free Trade Warehousing Zone (SEZs) at Village Sai, Taluka Panvel, District Raigad, Maharashtra developer by the Respondent No.4 approved vide letter of approval dated 05.12.2016 issued by the Respondent No.1. h. Interim and as-interim reliefs in terms of prayer clause d, e, and f. i. Award costs; Pass such further orders as this Hon’ble Court may deem fit and proper to pass in the facts and circumstances of the case.
