The representatives of the Developer, namely Arshiya FTWZ (through the Resolution Professional), the Co-developer, M/s Ascendas (CapitaLand Group) and the applicant unit, M/s Swiftlog Shipping Services Private Limited, attended the meeting through physical and virtual mode and were afforded adequate opportunity to present their submissions. The proposal pertained to the setting up of new unit through issuance of a Letter of Intent (LOI) by the Developer (through the Resolution Professional) to M/s Swiftlog Shipping Services Private Limited for undertaking warehousing activities in the container yard/open yard area within the FTWZ. During deliberations, the Committee expressed serious concerns regarding the proposed use of the container yard/open yard area for unit- specific warehousing activities. It was observed that the container yard is primarily a common use area, not duly demarcated or segregated as an independent processing space and does not provide exclusive possession or effective control necessary for carrying out authorised operations by a unit, as envisaged under the SEZ framework. In response, the Developer, through the

एवं Cभावी िनयंRण उपल\ध नह0 कराता है, जैसा िक िवशेष आ@थक QेR (SEZ) ढांचे के अंतग%त पFरकJ8पत है। इसके Cfयु2र म डेवलपर ने Fरज़ॉ8यूशन Cोफेशनल एवं अ6धकृत C6तिन6धयE के मा]यम से CDतुत िकया िक कंटेनर याड% के >लॉLटग एवं सीमांकन से संबं6धत आप2 पहली बार उठाई जा रही है। यह भी CDतुत िकया गया िक िपछले कई महीनE से एसे डास एफटीड\8यूजेड के अंतग%त काय%रत इकाइयE Zारा कंटेनरE, आईएसओ ट^कE एवं ट^कE के संचालन से संबं6धत समान ग6तिव6धयाँ क3 जा रही ह^। डेवलपर ने आगे यह Dप4 िकया िक एम/एस JDवKटलॉग को CDतािवत आवंटन केवल कंटेनरE के भंडारण तक सीिमत है, /जसम िकसी भी Cकार क3 डी-DटLफग अथवा संबg ग6तिव6धयाँ सJ5मलत नह0 ह^, तथा इससे सह-डेवलपर क3 ग6तिव6धयE पर कोई C6तकूल Cभाव नह0 पड़ेगा। यह भी CDतुत िकया गया िक माDटर लीज़ एiीमट के अंतग%त कंटेनर याड% को िवशेष प से एसे डास को अ6धिनMद4 (demised) नह0 िकया गया है तथा सह-डेवलपर Zारा उठाई गई आप2याँ तjयहीन ह^। सह-डेवलपर एम/एस एसे डास पनवेल एफटीड\8यूजेड Cाइवेट लिमटेड ने अपने लखत अयावेदन के मा]यम से Dप4 प से बताया िक एम/एस JDवKटलॉग को एलओआई जारी िकए जाने के संबंध म न तो उ ह कोई सूचना दी गई और न ही उनसे कोई परामश% िकया गया। सह-डेवलपर ने अपने क\जे, Cबंधन अथवा िनयंRणाधीन िकसी भी QेR, साथ ही सामा य QेRE एवं साझा अवसंरचना सुिवधाओं को, पूव% लखत सहम6त के िबना िकसी भी Cकार के लेन-देन या अनुमोदन हेतु सJ5मलत िकए जाने पर आप2 UयT क3। सह-डेवलपर ने इस िवषय म अपने सभी अ6धकार सुर6Qत रखे। सभी िहतधारकE Zारा CDतुत अयावेदनE पर सावधानीपूव%क

It was contended that similar activities involving handling of containers, ISO tanks, and tanks were being carried out units operating under Ascendas FTWZ for the past several months. The Developer further submitted that the proposed allotment to M/s Swiftlog was limited strictly to storage of containers, without any de-stuffing or allied operations and therefore would not prejudice or interfere with the operations of the Co-developer.

Ltd., Khurja FTWZ and to M/s Sarveshwar, a Unit located in JNPA SEZ in terms of MOC&I Instruction No. 117 dated 24.09.2024, subject to following conditions: i. Only one-time permission for transfer of goods/alcoholic beverages falling under Chapter 22 of the Customs Tariff shall be allowed, at the option of the unit, either from Arshiya FTWZ to JNPA SEZ or vice versa, solely for shifting of existing stock under preventive supervision. ii. The Committee observed that in order to optimise logistics cost and meet customer demand in North India, movement of goods from Arshiya FTWZ to M/s Awat Logistics Pvt. Ltd., Khurja FTWZ is justified.
