म भी लाया जा सकता है।
 
 
िनणय:- िवचार-िवमश के बाद सिम&त ने मौजूदा एलओए म
अ&तDर	 व8तुओं को शािमल करने के लए ग&तिव&धय: क
Lयापक बcdडग के अनुमोदन के N8ताव को अ8वीकार कर
िदया। सिम&त ने पाया िक इस ग&तिव&ध के पीछे कोई तक
नह' है और केवल माल क ;ेणी म आने के उYेiय से
इकाई सॉgटवेयर (1जसे मेल के मायम से साझा िकया जा
सकता है) को माल म पDरवjतत कर रही है। इसलए सिम&त
ने N8ताव को अ8वीकार कर िदया।
 
 
         
        The Unit stated that the software’s
will be brought in the hard discs drives
and 
warehoused 
in 
the 
unit.

representative of the unit confirmed that
the said software could be brought in
digital form also.

:- 
After 
deliberation 
the
Committee rejected the proposal for
approval of broad banding of activities to
include additional items into existing of
LOA. The Committee noted that there
seems no rationale behind this activity
and just for the purpose of falling under
the category of goods the unit is
converting the software (which can be
shared through mail) into goods. Hence

सीआईआरपी/डेवलपर को सह-डेवलपस -ारा आवेदक को
यह 8थान आवंिटत करने पर कोई आप, नह' है। इसके

को चुनौती देने वाली उn Qयायालय म एक या&चका है।
 
             
सह-डेवलपर के N&तिन&ध ने मुYा उठाया िक
मेसस अशया लाइफ़8टाइल लिमटेड (एक अQय सह-
डेवलपर) इकाई के संचालन म बाधा डाल रहा है और
एसईजेड म Nवेश क अनुम&त नह' दे रहा है।
 
 
 
 
िनणय:- Dरकॉड पर उपलZध द8तावेज: से 8पI Uप से पता
चलता है िक मेसस एसेQडास पनवेल Nाइवेट लिमटेड ने
उपलZध खाली जगह के लए एलओआई जारी करने का
अ&धकार है। डेवलपर -ारा खाली जगह क इस उपलZधता
का सaयािपत िकया गया है। इसलए, िवचार-िवमश के बाद,
सिम&त 
ने 
सह-डेवलपर, मेसस 
एसेQडास 
पनवेल
एफ़टीडब
यूज़ेड Nाइवेट लिमटेड -ारा िदए गए एलओआई
और डेवलपर (सीआईआरपी) -ारा पुिI के आधार पर

इकाई 8थािपत करने के लए मेसस एसेQडास पनवेल
एफ़टीडब
यूज़ेड Nाइवेट लिमटेड के N8ताव को मंजूरी दे
दी। हालांिक, उ	 मंजूरी मामले म माननीय बॉWबे उn
Qयायालय के सम लंिबत Dरट या&चका के पDरणाम के
अधीन होगी।
warehouse is free and space is available
and CIRP/developer has no objection for
allotting this space to the applicant by
the co-developers. Further, it has been
noted that the other applicant M/s
Arshiya Logistics Services Ltd. has also
asked for same space which reconfirms
the fact that the space is available.
Further it was placed before Committee
that there is a petition in High Court
challenging the co-developer status of
M/s Ascendas Panvel FTWZ Pvt Ltd and
approval of the new unit under the said
Co-Developer.
 
         The Co-Developer’s representative
raised an issue that M/s Arshiya Lifestyle
Ltd.(another Co-Developer) is obstructing
the operations of unit and not allowing
the entry in the SEZ.
 
Decision:- The documents available on
record clearly shows that M/s. Ascendas
Panvel FTWZ Pvt Ltd has right to issue
LOI for the available free space. This
availability of free space is vetted by the
the Developer. Hence, after deliberation,
the Committee approved the proposal
of M/s Ascendas Panvel Pvt Ltd for
setting up of a unit in a space of 30000
sq. Ft. in CODC warehouse on the basis
of LOI given by the Co-Developer, M/s
Ascendas Panvel FTWZ Pvt Ltd and
confirmed 
by 
the 
Developer 
(CIRP).
However, the said approval shall be
subject to the outcome of the Writ
Petition pending before the Hon’ble
Bombay High Court in the matter.

meeting was asked to confirm about the
rights of M/s Arshiya Ltd (as Developer,

Ltd. (Co-Developer) and M/s Arshiya
Lifestyle Ltd. (Co-Developer) to give NOC
for space as it appears that the validity of
lease/agreement between M/s Arshiya
Lifestyle Ltd. (Co-Developer) and M/s
Ascendas Panvel FTWZ Services Pvt. Ltd.
(Co-Developer) is already over.

िनणय: िवचार-िवमश के बाद, सिम&त ने एसईजेड िनयम,
2006 के िनयम 54 के अनुसार वष 2021-22, 2022-
23, 2023-24 के लए इकाई के Nदशन को नोट िकया।

Committee noted the performance of
the unit for the years 2021-22, 2022-23,
2023-24 in terms of Rule 54 of SEZ
Rules, 2006.
