Decision :- After deliberation, the Committee deferred the
proposal of M/s. Accex Supply Chain and Warehousing Private
Limited for Addition (Broad Banding) and asked the unit to submit
the following from the developer:-
i. Land use pattern
ii. Whether manufacturing activities can be allowed in warehousing
premises.

ए(से(स सलाई चेन एंड वेयरहाउNसग Vाइवेट !लिमटेड।
वष 2019-2020 से 2023-24 के !लए वाGषक Vदशन Cरपोट इकाई ारा V:तुत क गई। इकाई ने िव3 वष
2019-2020 से 2023-24 के दौरान संचयी आधार पर 1135.86/- लाख Zपये का सकारा[मक एनएफई
हासल िकया है।
 
Agenda Item No. 3 : Monitoring performance for the FY 2019-20
to FY 2023-24 - M/s. Accex Supply Chain and Warehousing
Private Limited.
               The Annual Performance Report for the years 2019-2020 to
2023-24 were submitted by the unit. The unit has achieved positive NFE
of Rs. 1135.86/- lakh on cumulative basis during the F.Y. 2019-2020 to
2023-24.
िनणय:- िवचार-िवमश के बाद, सिम.त ने एसईजेड िनयम, 2006 के िनयम 54 के संदभ म वष 2019-
2020 से 2023-24 के !लए मेसस ए(से(स सलाई चेन एंड वेयरहाउNसग Vाइवेट !लिमटेड के Vदशन
को नोट िकया और वष 2019-20, 2020-21, 2021-22, 2022-23 और 2023-24 के !लए
एपीआर जमा करने म देरी के !लए कारण बताओ नोिटस जारी करने का िनद\श िदया।

और देनदाCरय; को Vाइवेट !लिमटेड फम मेसस शां.तलाल सी मेहता शानपा^स Vाइवेट
!लिमटेड को ह:तांतCरत करने और :लLप सेल म नाम बदलने के संबंध म अनुमोदन -
मेसस शां.तलाल सी मेहता।
                                 इकाई ने साझेदारी फम मेसस शां.तलाल सी मेहता क सभी
पCरसंप!3य; और देनदाCरय; को Vाइवेट !लिमटेड फम मेसस शां.तलाल सी मेहता शानपा^स
Vाइवेट !लिमटेड को ह:तांतCरत करने और :लLप सेल म नाम बदलने के संबंध म अनुमोदन

to the Slump Sale and transfer of all the Assets and
Liabilities of the Partnership firm M/s. Shantilal C.
Mehta to the Private Limited firm M/s. Shantilal C
Mehta Shanparts Private Limited - M/s. Shantilal C.
Mehta.
                                The Unit requested for approval
w.r.t. Change in name to the Slump Sale and transfer of all
the Assets and Liabilities of the Partnership firm M/s.
Shantilal C. Mehta to the Private Limited firm M/s.
Shantilal C Mehta Shanparts Private Limited. The unit has
stated that there will be no revision in the projections on
conversion of Partnership Firm to Private Limited.

िनणय:- िवचार-िवमश के बाद, सिम.त ने मेसस के V:ताव को मंजूरी दे दी। शां.तलाल सी. मेहता को मंदी
िब_ी समझौते के मायम से उ`मी बदलने, नाम म पCरवतन से मंदी िब_ी और साझेदारी फम मेसस
शां.तलाल सी. मेहता क सभी पCरसंप!3य; और देनदाCरय; को िनजी !लिमटेड फम मेसस शां.तलाल सी.
मेहता शानपा^स Vाइवेट !लिमटेड को एसईजेड िनयम, 2006 के िनयम 19 (2) के Vावधान और
एसईजेड िनयम, 2006 के िनयम 74 ए के संदभ म एमओसीएंडआई के िनद\श संKया 109 के साथ
पढ़ने के अनुसार :थानांतCरत करने के !लए।
इसके अलावा, सिम.त ने िनLन!ल!खत को भी मंजूरी दी:
i. कंपनी का नाम मेसस शां.तलाल सी मेहता शानपा^स Vाइवेट !लिमटेड पढ़ा जाएगा।
ii. कंपनी के िनदेशक; क सूची और शेयरधाCरता पैटन मेसस शां.तलाल सी मेहता शानपा^स Vाइवेट
!लिमटेड के अनुसार िनLनानुसार ह;गे:
 
Decision:- After deliberation, the Committee approved the
proposal of M/s. Shantilal C. Mehta for Change of Entrepreneur by
way of Slump Sale Agreement, from Change in name to the Slump
Sale and transfer of all the Assets and Liabilities of the Partnership
firm M/s. Shantilal C. Mehta to the Private Limited firm M/s.
Shantilal C Mehta Shanparts Private Limited as going concern
basis in accordance to the provision of Rule 19(2) of SEZ Rules,
2006 and in terms of Rule 74A of SEZ Rules, 2006 read with
Instruction No.109 of MOC&I.
Further, the Committee also approved the following :
i. The name of the company to be read as M/s. Shantilal C Mehta
Shanparts Private Limited.
ii. The list of Directors and Shareholding Patterns of the Company will
be of M/s. Shantilal C Mehta Shanparts Private Limited as under :

इसके अलावा, सिम.त ने इकाई को िनद\श संKया 109, िदनांक 18.10.2021 के अनुसार िनLन!ल!खत सुरा
उपाय; का अनुपालन करने का भी िनद\श िदया:-
1. पCरवbतत इकाई के !लए अपCरवbतत जLमेदाCरय; और दा.य[व; के साथ एसईजेड ग.तिव.धय; क िनबाध
िनरंतरता।
2. पCरवbतत इकाई और उसके घटक; ारा सुरा मंजूरी आिद सिहत सभी लागू पा)ता मानदंड; को पूरा
करना।
3. सभी राज:व/कंपनी मामले/सेबी आिद अ.धिनयम;/िनयम; क Vयोdयता और उनका अनुपालन जो
पूंजीगत लाभ, इ9(वटी पCरवतन, ह:तांतरण, कर देयता आिद जैसे मुe; को िविनयिमत करते हS।
4. इ9(वटी म पCरवतन/िवलय, िवभाजन, समामेलन या :वािम[व म ह:तांतरण आिद से संबं.धत पूण िव3ीय
िववरण तुरंत सद:य (आईटी एंड आर), सीबीडीटी, राज:व िवभाग और े)ा.धकार Vा.धकरण को
V:तुत िकया जाएगा।
5. मू'यांकन अ.धकारी को इ9(वटी के ह:तांतरण या िवलय, िवभाजन, एककरण, ह:तांतरण और :वािम[व
आिद से उ[पf लाभ/हािन क करदेयता का आकलन करने का अ.धकार होगा, जैसा भी लागू हो और
आयकर अ.धिनयम, 1961 क Vासंिगक धाराओं के तहत कटौती के !लए पा)ता होगी।
6. आवेदक को राdय सरकार के Vासंिगक कानून; का पालन करना होगा, जसम भूिम के पgे से संबं.धत
कानून भी शािमल हS, जो लागू ह;।
7. आवेदक को सीबीडीटी को इकाई के पैन और े)ा.धकार वाले मू'यांकन अ.धकारी का िववरण V:तुत
करना होगा।
8. आवेदक को सभी अ>भलेख; म नए नाम या ऐसी Fयव:था से पहचाना जाएगा।
 
Further, the Committee also directed the unit to comply with the
following safeguards in terms of Instruction no. 109, dated 18.10.2021:-
1. Seamless 
continuity 
of 
the 
SEZ 
activities 
with 
unaltered
responsibilities and obligations for the altered entity.
2. Fulfillment of all eligibility criteria applicable, including security
clearances etc, by the altered entity and its constituents..
3. Applicability of and compliance with all Revenue/Company
Affairs/SEBI etc. Acts/Rules which regulate issues like capital
gains, equity change, transfer, taxability etc.
4. Full financial details relating to change in equity/merger,
demerger, amalgamation or transfer in ownership etc. shall be
furnished immediately to Member (IT&R), CBDT, Department of
Revenue and to the jurisdictional Authority.
5. The Assessing Officer shall have the right to assess the taxability
of the gain/loss arising out of the transfer of equity or merger
demerger, amalgamation, transfer and ownerships etc. as may be
applicable and eligibility for deduction under relevant sections of
the Income Tax Act, 1961.
6. The applicant shall comply with relevant State Government laws,
including those relating to lease of land, as applicable.
7. The applicant shall furnish details of PAN and jurisdictional
assessing officer of the unit to CBDT.
8. The applicant shall be recognized by the new name or such
arrangement in all the records..

Agenda Item No. 5 : Approval w.r.t. Inter-FTWZ transfer of Goods
by M/s. Sympatex Technologies GmbH, a client of M/s. Arshiya
Panvel Logistics Services Pvt. Ltd. located at Arshiya FTWZ to
M/s. Sympatex Technologies GmbH, a client of M/s. Sarveshwar
Logistics Pvt. Ltd. located at JNPA-SEZ - M/s. Sympatex
TechnologiesGmbH.    
                           M/s. Sympatex Technologies GmbH has proposed the
Inter-FTWZ transfer of goods from a client of M/s. Arshiya Panvel Logistics
Services Pvt. Ltd. located at Arshiya FTWZ to M/s. Sympatex Technologies
GmbH, a client of M/s. Sarveshwar Logistics Pvt. Ltd. located at JNPA-SEZ.

िनणय:- िवचार-िवमश के बाद, सिम.त ने अंतर-एफटीडh'यूजेड से माल के ह:तांतरण के !लए मेसस
सLपेटे(स टे(नोलॉजीज जीएमबीएच के V:ताव को मंजूरी दे दी। अशया एफटीडh'यूजेड म 9:थत मेसस
अशया पनवेल लॉज9:ट(स सGवसेज Vाइवेट !लिमटेड के एक iाहक से मेसस सLपेटे(स टे(नोलॉजीज
जीएमबीएच, जो िक जेएनपीए-एसईजेड म 9:थत मेसस सव\jर लॉज9:ट(स Vाइवेट !लिमटेड का एक
iाहक है, को एक बार के उपाय के kप म िनLन!ल!खत शतl के अधीन:-
 
(i) माल क 100% जांच क जाएगी; और
(ii) माल को िनवारक अनुरण के तहत :थानांतCरत िकया जाएगा और िनGदH अ.धकारी पयवेण करेगा
और यह सुिन.mत करेगा िक माल जीआईएस Vणाली के साथ लगे जीपीएस सम वाहन टnै5कग स:टम म
:थानांतCरत िकया जाए।
 
सिम.त ने यह भी नोट िकया िक एफटीडh'यूजेड म अoय इकाइय; से भी इसी तरह के अनुरोध ह;गे और
िनGदH अ.धकारी से अनुरोध िकया िक वे यूएसी के िवचार के !लए समेिकत तरीके से ऐसे V:ताव V:तुत
कर।
 
Decision:- After deliberation, the Committee approved the
proposal of M/s Sympatex Technologies GmbH for transfer of
goods from Inter-FTWZ transfer of goods from a client of M/s.
Arshiya Panvel Logistics Services Pvt. Ltd. located at Arshiya
FTWZ to M/s. Sympatex Technologies GmbH, a client of M/s.
Sarveshwar Logistics Pvt. Ltd. located at JNPA-SEZ as a one time
measure subject to the following conditions:-
i. 100% examination of the goods will be carried out; and
ii. the goods will be transferred under preventive escort and
Specified Officer will supervise and will ensure that the goods are
transferred in a GPS enabled vehicle tracking system mounted
with GIS system.
                The Committee also noted that there will be similar
requests from other units in the FTWZ and requested the Specified
Officer to submit such proposals in a consolidated manner for
consideration of the UAC.
कायसूची मद संKया 06: मेसस अशया-एफटीडh'यूजेड - मेसस फरान ए9(जम Vाइवेट !लिमटेड म मेसस
असडास पनवेल एफटीडh'यूजेड Vाइवेट !लिमटेड म एक नई इकाई क :थापना का V:ताव।
               मेसस फरान ए9(जम Vाइवेट !लिमटेड ने फॉम एफ म V:तुत अनुसार वेयरहाउNसग और :टोरेज
ग.तिव.धय; के !लए 1,000 वग फट े) म एक नई एफटीडh'यूजेड इकाई :थािपत करने का अनुरोध िकया है,
जसम 5 वषl क अव.ध म 424.95 करोड़ Zपये के िनयात का एफओबी मू'य, 55.76 करोड़ Zपये का एफई
आउटगो और 369.19 करोड़ Zपये का एनएफई शािमल है, जसम 03 लोग; (02 पुZष और 01 मिहला) को
रोजगार िमलेगा।
 
Agenda Item No. 6 : The proposal for setting up of a new unit in

Limited has requested for setting up of a new FTWZ unit for
Warehousing and Storage activities as per submitted in Form F, in an
area admeasuring 1,000 sq. ft., envisaging FOB value of exports of Rs.
424.95 Crores, FE outgo of Rs. 55.76 Crores and NFE of Rs. 369.19
Crores over a period of 5 years with employment generation of 03
individuals. (02 Men & 01 Women).

िदया और इकाई को अपने िव3ीय/िन.ध के pोत और Fयवसाय मॉqूल V:तुत करने का िनद\श िदया।
 
Decision : After deliberation, the Committee deferred the
proposal of M/s. Faran Exim Private Limited and directed the unit
to submit their financial/source of fund and business module.

has requested for setting up a new FTWZ unit for Manufacturing activities
as per submitted in Form F, after discussion in UAC, they have submitted
revised Form F for Service activities, in an area admeasuring 10,000 sq.
ft., envisaging FOB value of exports of Rs. 13.78 Crores, FE outgo of Rs.
8.23 Crores and NFE of Rs. 5.55 Crores over a period of 5 years with
employment generation of 10 individuals (07 Men & 02 Women).
िनणय: िवचार-िवमश के बाद, सिम.त ने एसईजेड िनयम, 2006 के िनयम 17 और 18(5) के अनुसार
परीण और V.त:थापन सेवा ग.तिव.धय; के !लए एक नई एफटीडh'यूजेड इकाई :थािपत करने के !लए
मेसस ए(से(स सलाई चेन Vाइवेट !लिमटेड के V:ताव को :वीकार कर !लया।
 
Decision : After deliberation, the Committee accepted the
proposal of M/s. Accex Supply Chain Private Limited for setting up
a new FTWZ unit for Service activities in terms of Rule 17 & 18(5)
of SEZ Rules, 2006. 
अय को धoयवाद rापन के साथ बैठक समाs हुई।
