~ | Agenda for the meeting of the Board of Approval scheduled for 26th April, 2007 at 10.00 A.M., to consider miscellaneous requests in respect of notified SEZs. * . Item No.1 Request of M/s. Bharat Petroleum Corporation Limited (BPCL) as codeveloper in port based SEZ at Puthuvypeen, Cochin developed by Cochin Port Trust
Approval was accorded to the proposal for development of SEZ by Cochin Port Trust Puthuvypeen, Eranakulam District over an area of 285.8413 hectares. The SEZ has since been notified on 2.11.2006. M/s. Bharat Petroleum Corporation Limited has submitted an application for co-developer of the said SEZ. Pursuant to the agreement between Cochin Port Trust and Bharat Petroleum Corporation Limited, Bharat Petroleum Corporation Limited has been granted an area admeasuring 70 hectares from the total area earmarked for the development of the SEZ. A copy of the agreement has also been enclosed with the application form. The request of the developer was considered in the meeting of the Board of Approval held on 2.2.2007 and it was noted that precise activities that would be carried out by BPCL as a co-developer in this SEZ were not very clear. It was decided to defer this item and to call the representatives of BPCL at the next meeting of the BoA. The item is now listed for consideration.
Item No.2 Request of authorized operations in the textile SEZ at Hassan, Karnataka proposed to be developed by KIADB.
The SEZ was notified on 5.10.2006 on an area of 233.307 hectares. The request for authorized operations is at Annexure -1
Item No.3 Request from M/s. Shriram Properties & Infrastructure Limited for increasing the area of the IT/ITES SEZ at Chennai from 10 Hectares to 23.45 Hectares.
The said SEZ has been notified on 28.9.2006. The developer has now informed that they own additional land of 13.45 hectares adjacent to their SEZ, which is contiguous in nature. The total area of the SEZ becomes 23.45 hectares.
The proposal was considered in the meeting of the Board held on 2.2.2007, wherein it was noted that it was not clear as to whether the additional area of 13.45 hectares was already in the possession of the developer at the time of the notification. The Board decided that the concerned Development Commissioner may carry out verification and submit a report. Accordingly, the BOA decided to defer this item. Accordingly, a report has been called from the Development Commissioner. The item is now listed for consideration of BoA.

Item No.4 Request of Cochin SEZ for inclusion of five items as authorized operations for the SEZs designated as port based SEZs
Board of Approval, in its meeting held on 2.2.2007, approved the proposal of M/s. Petronet LNG Limited (PLL) as a co-developer of port based SEZ at Puthuvypeen, Cochin proposed to be developed by Cochin Port Trust. Following authorized activities were approved by the Board:-

Office space 2. Power (including power back up facilities) 3. Fire protection systems with sprinklers, fire and smoke detectors.

Foods services including cafeteria, food court(s), restaurants, coffee ships, canteens and catering facilities.
-
Security offices, police posts, etc. at entry, exit and other points within and along the periphery of the site.
-
clinic/ medical centres.
Cochin SEZ has furnished a proposal for inclusion of following five items as authorized operations for the special class of SEZ designated as port based SEZ, which according to them are in the interest of smooth operations of port based / airport based SEZs

Berthing facilities for handing of ships

Landing facilities for aircrafts. 3. Cargo removal facilities whether liquid, dry, bulk or containerized.

Storage facilities for import/export cargo whether liquid, dry, bulk or containerized.
- 5, Other operations ancillary to handling of ships or aircrafts.
The developer has also submitted that the PLL, in its application submitted request for developing “Infrastructure facility which includes facilities such as port, jetties, storage tanks and inter-connecting pipelines for liquids and gases, re-gasification and distribution of gas and other ancillary, incidental and related facilities as may be required in relation thereto.” The developer, in its application, also sought approval for carrying out specified authorized operations integral to the above mentioned infrastr4ucture facility and also other operations viz design, engineering, procurement, construction, development, operation and maintenance of LNG port and re-gasification terminal for providing import and re-gasification services for LNG and marketing and distribution of the re-gasified LNG therefrom and/or any related future expansion in this respect. The developer has submitted that these requests were not taken into account. The developer has requested for approval of the BoA to these activities. The earlier proposal of the PLL, which was submitted for consideration of the BoA is at Annexure - 2

Item No.5 Request of ADICORP for co-developer and for authorized operations in the multi product SEZ proposed to be developed by Mundra Port and Special Economic Zone Limited (MPSEZL) (formerly known as Gujarat Adani Port Limited). Mundra Port and Special Economic Zone Limited (MPSEZL) (formerly known as Gujarat Adani Port Limited) has been issued letter of approval on 12.4.2006 for developing a multi product SEZ in Gujarat. The SEZ has since been notified on 23rd June, 2006. The developer has now submitted its request for approval to ADICORP as co-developer of Mundra SEZ for providing infrastructure facilities and undertaking authorized operations. An agreement between the codeveloper and developer has been provided. ADICORP has requested for authorized activities listed at Annexure -3.
In view of the observations of the Department of Revenue, Board of approval decided to defer consideration of the proposal, in its meeting held on 2.2.2007. The item is now listed for consideration. Item No.6 Request of M/s. Sanghi SEZ Private Limited for conversion of their IT/ITES into Multi product SEZ
IT/ITES SEZ at Ranga Reddy in the State of Andhra Pradesh, proposed to be developed by M/s. Sanghi SEZ Private Limited, has been notified, covering an area 202.04 hectares. The developer has now submitted an application for conversion of their existing IT/ITES SEZ into a multi product SEZ, on an area of 1081 hectares. The proposed area is stated to be contiguous. Request of the developer is submitted for consideration.
Item No.7 Request of Manyata Promoters Private Limited to allow denotification of the notified Manyata SEZ
IT/ITES SEZ at Bangalore, Karnataka proposed to be developed by Manyata Promoters Private Limited, was notified on 16.11.2006, on an area of 22.34 hectares. The developer has now submitted that, as per the revised development plans, they wish to add 1.860 hectares and exclude a total of 3.09 hectares, resulting in a net exclusion of 1.238 hectares out of the SEZ notified area. In this regard, the developer has submitted that this would not impact the contiguity of the SEZ and it meets all the other criteria laid down under the SEZ legislative provisions. The request of the developer is submitted for consideration. A report has been called from the Development Commissioner.

Item No.8 Request of Mundra SEZ Integrated Textile and Apparel Park, codeveloper in the multi product SEZ at Mundra SEZ, Kutch, Gujarat, for authorized operations The multi product SEZ in Kutch, Gujarat, proposed to be developed by Mundra Port and Special Economic Zone, was notified on 23.6.2006, over an area of 2406-75-92 hectares. Mundra SEZ Integrated Textile and Apparel Park was appointed as co-developer for providing infrastructure facilities to the units in the SEZ, with emphasis on textile and apparel sector. The co-developer has now submitted a request for the authorized operations, which is at Annexure - 4. The request is submitted for consideration of BoA.
Item No.9 Approval for conversion of Reliance, Jamnagar notified sector specific zone as SEZ for multi product and contiguity relaxation
Sector specific SEZ for petroleum and Petrochemicals in Jamnagar, Gujarat by M/s. Reliance Infrastructure Limited (RIFL) has been notified on 19.4.2006, on an area of 440.08 hectares (1087.44 acres). It may be noted that Board of Approval, in its meeting held on 17.3.2006 granted formal approval to the SEZ on an area of 440 hectares with an in-principle approval for its expansion into a multi product SEZ as and when the minimum area of 1000 hectares is acquired by the developer.
The developer has now informed that RIFL is in possession of additional land of 733.70 hectares (1813 acres), thereby making the total area at 1173.60 hectares (2900 acres).
The developer has further stated that there is a thoroughfare comprising two rail lines and two roads on the land area in their possession. The developer has confirmed that they shall maintain contiguity by dedicated security gates/ Over bridges/under pass. They shall also fence the land as per the provisions of the SEZ Rules.
The developer has now sought approval for the following:

¢ Contiguity relaxation in terms of 3rd proviso to clause (a) to sub- rule 2 of Rule 5 since the total area exceeds 1000 hectares.

e Approval for conversion of sector specific SEZ into multi product SEZ by inclusion of additional area of 733.70 hectares by subsuming the already notified SEZ over an area of 440.08 hectares (Rule 5 (2) of the SEZ Rules) .
Subsequently, the developer i.e. M/s Reliance Infrastructure Limited requested that they are in possession of additional land admeasuring to 784 hectares, instead of 733 hectares requested earlier. They have requested for formal approval of 1224.08 (3024.75) hectares instead of 1173.60 hectares earlier.
Keeping in view the fact that contiguity may be broken on account of public thoroughfares, pathways, railway, water bodies etc. in large stretches of land, a provision was incorporated in the SEZ rules with the intention to provide powers to the Board of Approval for relaxing the condition of contiguity, “on merits, on case to case basis” for multi product SEZ. However, CBDT in DoR expressed a view that whereas BoA has power to relax the requirement of contiguity clause in SEZs for multi product SEZ, it does not have similar power to relax the requirements of “no public thoroughfare and vacancy” in the SEZ. The matter was referred to Law Ministry for opinion who agreed with the observations of the CBDT, stating that if administrative Ministry wishes, appropriate amendments can be brought in the SEZ Rules. Since the intention was to provide powers to the BoA for relaxation in the contiguity in multi product SEZs, necessary amendments have been brought in the SEZ Rules, vide notification dated 16t March, 2007. The proposal is now submitted for consideration of BoA.
Item No. 10 Request of Infosys Technologies Limited for co-developer in the Mahindra SEZ proposed to be developed by Mahindra World City Developers Mahindra SEZ was notified on 15.12.2006. Infosys Technologies Limited has submitted a request for co-developer status for developing 129 acres (52.21 hectares) of land within the SEZ. The land is under 29 years lease with Mahindra World City Developers. A copy of the co-developer agreement and MOU signed between the Infosys Technologies Limited and the Mahindra World City Developers has been provided. The requested of the co-developer is submitted for consideration. Item No.11 Request of Mundra Port and SEZ Limited for increasing area of their multi product SEZ Mundra Port and Special Economic Zone Ltd. (MPSEZ) (erstwhile, Gujarat Adani Port Ltd.) and Mundra Special Economic Zone Ltd. (MSEZ) were issued Letter of Approval dated 12 April 2006 for setting up of SEZ over area of 2758.19 hectares and 1081.91 hectares respectively. 2406.7592 hectares area of MPSEZ was notified on 23"¢ June 2006. Notification in respect of MSEZ has not been issued till now.
Mundra Special Economic Zone Ltd. has since been merged with Mundra Port and Special Economic Zone Ltd. as per the honorable Gujarat High Court Order, With a merger, only one entity, i.e. MPSEZ exists and as per the High Court's order the entire liabilities and assess, including the land owned by MSEZ has become the assets of MPSEZ with effect from the appointed date of 1.4.2006. The developer has informed that subsequent to the merger, the entire area of 3740.10 hectares is legally under the possession of MPSEZ. The developer has sought approval for expansion of MPSEZ notified area from 2406.7592 hectare to 3740.10 hectares, which is stated to be contiguous. The request of the developer is submitted for consideration.

Item No. 12: Proposal of Adicorp Mundra SEZ Infrastructure Private Limited (ADICORP) for co-developer of Mundra SEZ for providing social infrastructure
Mundra Port and Special Economic Zone Limited (MPSEZL) (formerly known as Gujarat Adani Port Limited) has been issued letter of approval on 12.4.2006 for developing a multi product SEZ in Gujarat. The SEZ has since been notified on 23" June, 2006. The developer has now submitted its request for approval to ADICORP as co-developer of Mundra SEZ for providing infrastructure facilities and undertaking authorized operations. An agreement between the codeveloper and developer has been provided.
Item No. 13: Request from Gujarat Adani Port Limited (GAPL) (now Mundra Port and Special Economic Zone Limited) to waive the requirement of no public thoroughfare
The proposal for setting up of Multi Product SEZ at Mundra, Gujarat, by M/s. GAPL over an area of 2658.19 hectares was considered in the meeting of the Board of Approval held on 17 March 2006. Approval letter was issued on 12 April 2006. The approval was subject to the land of the SEZ being contiguous.
While furnishing the information for notification, an area of 382.96 hectares, though in possession of the developer, was excluded as a public road along side was breaking the contiguity with the rest of the land area. The developer has now informed that this road will be mainly used by the SEZ users and to some extent by the users of the Jetty built and operated by Gujarat Maritime Board (GMB) only and that the road in question will not hamper the functioning of SEZ. The developer has therefore requested to consider waiving the requirement of no public thoroughfare.
This request was considered in the meeting of BOA held on 12.6.2006 and was deferred as the notification for the SEZ was issued. The SEZ has now been notified on 23.6.2006.
This request is being placed before the Board for consideration in terms of provisions of Rule 5(2) of the SEZ Rules, 2006.
Item No. 14: Request of M/s. GAPL (now Mundra Port and Special Economic Zone Limited) for demarcation of an area as FTWZ in the multi product SEZ at Mundra, Gujarat.
The proposal for setting up of Multi Product SEZ at Mundra, Gujarat, by M/s. GAPL was considered in the meeting of the Board of Approval held on 17th March 2006. Approval letter was issued on 12 April 2006. The approval was subject to the land of the SEZ being contiguous.

The developer has now requested for approval of setting up of FTWZ in an area of 320-75-02 hectares as part of multi product SEZ at Mundra. The original application did not contain this request. The SEZ Rules 2006 notified in February 2006 provide for setting up FTWZ as a part of the Multi Product SEZ. The developer has accordingly requested for setting up FTWZ.
Notification for the Multi product SEZ at Mundra, Gujarat by M/s. GAPL, on an area of 2406-76 hectares, has been issued. The proposed area falls at S.No.6 of the notification.
The developer has also stated that the 20% area restriction (Rule 5(c) of the SEZ Rules) for FTWZ as applicable to sector specific SEZ is not applicable to multiproduct SEZs. The developer has made following further submissions:

(i) The already notified area of the SEZ is 2406-75-92 hect. (ii) 35% of the area will be developed as processing area. (iii) |Minimum processing area based on the above, works out to 842 hect. (iv) Request for expansion of the SEZ area and exemption from public thorough fare has already been submitted to Government.

(v) The additional area of the SEZ consequent upon approval of expansion will be 1350 hect.

(vi) With the additional area getting notified , processing area of the SEZ will increased to more than 1600 hect and the proposed FT&WZ area of 320 hect will be within 20% limit.
The request is placed before the Board for consideration in terms of provisions of Section 6 of the SEZ Act 2005 read with Rule 1lof the SEZ Rules 2006.
Item No. 15: Request of M/s DLF Assets Private Limited for co-developer in the IT/ITES SEZ at Silokhera, Haryana to be developed by DLF Limited
IT/ITES SEZ at Silokhera, Haryana to be developed by DLF Limited was notified on 6th December 2006 on an area of 12.06 Hectares. The area of the SEZ was increased to 14.97 hectares, vide notification dated 19th March 2007. M/s DLF Assets Private Limited has submitted a proposal for co-developer in the said SEZ. A Memorandum of Understanding for co-developer agreement and addendum between DLFL and DAPL has been provided. A list of the authorized operations proposed to be carried out by the co-developer ie. M/s. DLF Assets Private Limited is at Annexure - 5.
Item No. 16: Authorised operations in respect of IT/ITES SEZ at Ernakulam, Kerala by M/s Infopark
The above SEZ was notified on 28th September 2007. The request for the authorized operations is submitted for consideration of the Board of Approval is at Annexure - 6.

Item No. 17: Request of Ascendas Mahindra IT Park Private Limited for authorized operations in IT/ITES SEZ of Mahindra World City, Chennai Approval has been granted to M/s Ascendas Mahindra IT Park Private Limited for co-developer in the IT/ITES SEZ of Mahindra World City, Chennai. The request of the co-developer for carrying out authorized operations is at submitted for consideration and approval is at Annexure - 7.
Item No. 18: Request of Kandla SEZ for extension of validity of approvals of units for processing of worn/used clothing
Kandla SEZ has 13 units for processing of worn/used clothing. The zone has informed that out of these 13 units, some of the units are completing the five year approval period and have, therefore, applied for extension of validity. These units employ 4000 persons during last 5 five year, these units have made physical export of Rs. 246.08 crores. As regular meeting of the Board of Approvals could not be held since 27th October, 2006, this issue could not be placed before BOA. An agenda item was listed for one of the units in 10% January, 2007 BOA, which was postponed. Considering the employment and exports made, the validity period of these units has been extended upto 30.6.2007. Ex-post-facto approval of BOA is now solicited.
Item No.19: Request of GIDC for authorized operations in IT/ITES SEZ at Gandhinagar
The above SEZ was notified on 27*' October 2007. The request for the authorized operations is submitted for consideration of the Board of Approval is at Annexure - 8.
Item No. 20: Request of Royal Palms (India) Pvt Ltd. for increasing the area of the SEZ from 10.10 hectares to 21.80 hectares.
IT / ITES SEZ at Mumbai, Maharashtra proposed to be developed M/s. Royal Palms (India ) Pvt Ltd. was notified on 11 January,2007. The developer has now submitted a request for increasing the area of the proposed SEZ by adding land to the extent of 11.70 hectares, thereby making the total area of the SEZ as 21.80 hectares. The developer has informed that both, the already notified area and the additional area are under the same survey no., viz. survey no.169 the developer has also informed that the additional area is :

The request of the developer is submitted for consideration.
- Ttem No. 21: Request of M/s. M.L. Dalmiya and Company Limited for approval of boundary wall and the entry/exit points at Kolkata IT Park SEZ.
As per SEZ Rules, there are specified entry/exit point in a SEZ. The developer has informed that during the course of detailed planning, it was observed at least 4 to 5 entry/exit points would be required in the Kolkata IT Park. These are required on account of following reasons:

(i) The area of the SEZ is 120 acres. Lesser number of entry/exit points may lead to traffic bottlenecks.
-
(ii) Since large number of personnel are employed in the SEZ (60000 personnel), their entry by buses and car would lead to swear traffic disorder.
-
(iii) In the event of fire hazard, evacuation of such a large number of people in a smooth manner can only be possible if there are five entry/exit points.
-
(iv) Presence of bridges/culverts can cause traffic bottlenecks unless there are five entry/exit points.
Item No. 22: Request of M/s. Bommidala Enterprises Limited, a Cigarette manufacturing company in MEPZ SEZ
M/s. Bommidala Enterprises Limited, a Cigarette manufacturing company in MEPZ SEZ has sought approval for setting up of manufacturing unit in the MEPZ SEZ for export of cigarettes. The company has stated that they will be exporting 100% of their production from their SEZ and will not sell any of the produce to the DTA.
