Supplementarv asenda for the meetins of the Boatd of Approval to be held on 9th Mav,2OO7 Item No. 1: Request of ADICORP for co-developer and for authorized operations in the multi product SEZ proposed to be developed by Mundra Port and Special Economic Zone Limited (MPSEZL) (formerly known as Gujarat Adani Port Limited). Mundra Port and Special Economic Zone Limited (MPSEZL) (formerly known as Gujarat Adani Port Limited) has been issued letter of approval on 12.4.2006 for developing a multi product SEZ in Gujarat. The SEZ has since been notified on 23td June, 2O06. The developer has now submitted its request for approval to ADICORP as co-developer of Mundra SEZ fiot providing infrashucture facilities and undertaking authorized operations. An agreement between the co- developer and developer has been provided. ADICORP has requested for authorized activities listed at Annexure -1. In view of the observations of the Department of Revenue, Board of approval decided to defer coruideration of the proposal, in its meeting held on 2.2.2007 and, 26.04.2007. The item is now fisted for coruideration. Item No. 2: Requeet of Mtmdra SEZ Integrated Textile and Apparel Park, co- developer in the multi product SEZ at Munfua SEZ, Kutch, Gujarat, for authorized operations The multi product SEZ in Kutctu Gujarat, proposed to be developed by Mundra Port and Special Economic Zone, was notified on'25.6.2006, over an area of 2406-75-92 hectares. Mundra SEZ Integrated Textile and Apparel park was appointed as co-developer for providing infrashucture facilties to the ur-rits in the SEZ, with emphasis on textile and apparel sector. The co-developer has now submitted a request for the authorized operations, which is at Annexure - 2. The request is submitted for consideration of BoA. Itern.No.3: Requeet of Mundra Port and sEZ Limited for increasing area of their multi product SEZ Mundra Port and Special Economic Zone Ltd. (MPSEZ) (erstwhile, Gujarat Adani Port Ltd.) and Mundra Special Economic Zone Ltcl. ltvf,nZl were issuecl Letter of Approval dated 12th April 2006 for settfug ttp of sEZ over area of 275g.79 lrectares and 1081.91 hectares respectively. 2406.7i92 l-rcctares area oI MISEZ was notified o. 23'd June 2006. With a merger, only one entity, i.e. MPSEZ existe and as per the High Court's order the entire liabilities and asseae, includlng the land ownecl by MSEZ has become the assets of MPSEZ with effect from the appointed date of 1.4.2006. The developer has informed that subsequent to the merger, the entire area of 3740;L0 hectares is legally under the possession of MPSEZ. The developer has sought approval for expansion ol MPSEZ notified area from 2406.7592 hectare to 3740.10 hectarea, which is stated to be contiguous. The request of the developer is submitted for consicleration. Item No. 4: Propoeal of Adicorp Mundra SEZ Infraetructure Private Limited (ADfCORP) for co-developer of Mundra SEZ tor providing eocial infrastructure Mundra Port and Special Economic Zone Limited (MPSEZL) (formerly known as Gujarat Adani Port Limited) has been issued letter of approval on L2.4.2O06 for developing a multi product SEZ in Gujarat. The SEZ has since been notified on 2id june, 2006. The developer has now submitted its request for approval to ADICORP as co-developer of Mundra SEZ fot providing infrastructure facilitiee and undertaking authorized operations. An agreement between the co- developer and developer has been provided. Item No. 5: Requeet from Gujarat Adani Port Llmited (GAPL) (now Mundra Port and Special Economic Zone Limited) to waive the requirement of no publie thoroughfare The proposal for setting up of Multi Product SEZ at Mundra, Gufara! by M/s. GAPL over an area of 2558.19 hectares was considered in the meeting of the Board of Approval held on 17th March 2005. Approval letter was issued on 12th APril 2O06. The approval was subject to the land of the SEZ being conHguous. While furnishing the information for notification, an area of 382.96 hectares, though in possession of the developer, was excluded ae a public road along side was breaking the contiguity with the rest of the land area. The developer has now informed that this road will be mainly used by the SEZ users and to some extent by the users of the Jetty built and operated by Gujarat Maritime Board (GMB) only and that the road in question will not hampet the functioning of SEZ. T\e developer has therefore requested to consider waiving the requirement of no public thoroughfare. This request was considered in the meeting of BOA held on12.6.2006 and was deferred as the notification for the SEZ was issued. The SEZ hae now been notified on23.6.2006. This request is being placed before the Board for consideration in terms of provisions of Rule 5(2) of the SEZ Rules, 2006. {

3 -r Item No.6:: Request of Mrle. GAPL (now Mundra Port and Special Economic Zone Limited) for demarcation of an area aa F-fv{z in the multi product sEZ at Mundra, Gujarat. The proposal for setting up of Multi Product SEZ at Mundra, Gujarat, by M/s. GAPL was considered in the meeting of the Board of Approval held on 17th March 2006. Approval letter was issued on 12tt'April 2006. The approval was subject to the land of the SEZ being contiguous. The developer has now requested for approval of setting up of FTWZ in an area oI 320-75-02 hectares as part of multi product sEZ at Mundra. The original application did not contain this request. The sEZ Rules 2006 notified in February 2006 provide for setting up FTWZ as a part of the Multi product sEZ. The developer has accordingly requested for sefting up FTWZ. Notification for the Multi produ ct SEZ at Mundra, Gujarat by M/ s. GApL, on an area of 2406-76 hectares, has been issued. 'rhe proposed area falis at s.No.6 oI the notification. The developer has also stated that the 20% area restriction (Rule 5(c) of the sEZ.RuleO for FTWZ as applicable to sector specilic sEZ is not app'licable to multi- product SEZs. The developer has made following further submissions: The already notified area of the SEZ is 2406-Zb-92 hect. 35% of the area will be developed as processing area. T Addendum to the Asenda for the meetin e of the BOA to be held on 9ft Mav 2007. In-principle approval was granted for setting up of multi-product SEZ on an area of 1390 hectares by Clty and Industrial Development Corporation of Maharashtra Limited (CIDCO). The approval letter was issued on 30.1.2002, which was subsequently amended vide letter dated '1,4.2.2002 thereby amending the area from 1390 hectarcs to 4377 hectares. In December, 2005 the approval was transferred in the name of a SPV i.e. "M/s. NMSEZ Development Company Private Limited". The developer has now subnritted an application for conversion of in- principle approval to formal approval for an area of 1250 hectares. This is listed as one of the agenda items (main agenda item number 7) in this meeting. A road and two railway lines pass through the SEZ location, which breaks the contiguity. Therefore, Contiguity relaxation in terms of sub- rule 2 of Rule 5, read with SEZ (Second amendment) Rules, 2007 is sought.
