Meeting No. 17/87-NC-7/2010 of NORMS COMMITTEE (NC-7) dealing with ‘Plastic & Rubber Products’ scheduled to be held on 28.07.2010 (held on 04.08.2010) under the Chairmanship of Dr. L.B. Singhal, Jt. DGFT, Udyog Bhawan, New Delhi-110011. Following officers attended the Meeting:

MANUAL CASES

Case No. A-71

Request: Fixation of adhoc norms for the export product “Fender Type Long Chain Net Type Harnessing Rubber Fender of different sizes”.

Decision: The firm was asked to furnish information regarding "Production / Consumption data for Exports made in weight terms and raw material consumed duly certified by Central Excise” vide DGFT letter dated 12.02.2010 (as asked by DIPP vide D/L dated 28.01.2010) followed by reminder on 27.04.2010 for submission of information within 30 days.

        The Committee noted that the above information is still awaited from the firm even after lapse of more than 90 days.

Therefore, the Committee decided to call the firm for Personal Hearing on 18.08.2010. In case the Personal Hearing is not attended on scheduled date alongwith the requisite information, the Committee would be constrained to reject the case with direction to firm to pay the Customs duty and applicable interest for regularization of the licence.

Decision: The firm was asked to furnish following information vide DGFT letter dated 18.09.2009 (as asked by DIPP vide D/L

i) Qty. of different raw material required to manufacture 100 kg. of each of the export product; ii) Percentage com Decision of Rubber Compound in terms of various inputs used against manufacture of export product; iii) Type and specification of carbon to be imported whether it is carbon black or otherwise; iv) Material of construction for chain to be imported; v) GSM of nylon cord fabric; and vi) Last 2 years production of item of export under reference and corresponding consumption of various raw material (year – wise) duly certified by Central Excise Authority.

The Committee noted that the above information is still awaited from the firm even after lapse of more than 90 days. Request: Fixation of wastage norms for export product ‘Plastic Moulds used for Packing Carbide Blades’ in respect of M/s. Bhukanvala Tools Pvt. Ltd. - Referred by SEZ/ BOA in DOC. Decision: This case was earlier considered by Norms Committee – I in its Meeting No. 52/AM10 held on 30.03.2010 wherein it was decided to transfer the case to DES-VII Section.

Copy of application was earlier sent to D/o C&PC on 25.02.2010 by DES-I Section. The case was examined by D/o C&PC and the firm was asked to submit certain information vide D/L No. 46011/18/2010-PC.II dated 16.04.2010 issued by D/o C&PC. The firm vide letter dated 12.05.2010 submitted their reply which was found to be incomplete in regard to “Production / Process wastage generated during the last three years operation period of the unit or if the unit has not started production during the last three years, details for the corresponding period of production / process wastage duly certified by Office of the Development Commissioner, Kandla, SEZ”.

        Hence, D/o C&PC has again asked for the above information vide D/L No. 46011/18/2010-PC.II dated 22.07.2010.
