At the outset the Minutes of NC-V Meetings No.09/AM-16 dated 04.06.2015 and 10/AM-16 dated 11.06.2015 were taken up for ratification. As there was no amendment to the same, the above referred minutes were adopted for implementation by the Committee without any amendment. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the case has already been examined by the Norms Committee in its meeting held on 19.08.2010 and the decision taken by the Committee is reproduced below:

“Decision: The committee considered the case as per agenda along with other relevant papers and heard Shri Sunil Jain, an authorized representative of the firm, who appeared for personal hearing before Committee. He explained the case along with sample and relevant details. The sample was checked and

observed that sizes are larger than the normal range of coverall. The Committee felt that higher requirement of inputs asked for is justified in this case. Therefore, Committee after deliberations in consultation with the representative of technical authorities present in the meeting decided to ratify the Advance Authorisation issued in this case as applied by the firm. The sample received in this case was handed over to the representative of the firm. The GSM should match in both import and export.”

Now on the query raised by the RA, Kolkatta for specific mentioned of the GSM of the fabric on the export on the export shipping bills the firm have requested to consider their case without insisting for GSM in the export documents. Further the firm has stated that due to limitation of space, every technical detail may not have been possible to be mentioned by the customs authorities and hence alternatively, they clearly stated “fabric as per list attached” which effectively means that, the aforesaid fabric used was of the detail and description in terms of the item list attached to the Adv. Authorisation. As stated by the firm they already imported the fabric in the month of July 2009 and completed their exports within a short span of 3-6 months as soon as they completed the production.

Since the authorization issued in this has already been ratified by the Norms Committee in its meeting held on 19.08.2010, at this stage there is no role of the committee. In view of above committee decided to advise RA, Kolkatta to take appropriate action as per documents submitted by the firm in this case.

NC 12/AM-16, dt. 25.06.2015 | File No.01/84/50/000154/AM-10/DES-V Re-fixation of adhoc norms in respect of Advance Authorization No. 0210133247 dated 03.11.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the above said authorization has already been ratified by the Norms Committee in its meeting held on 08.11.2012 with a condition that the GSM of the fabric should match in both Import and Export. Now the firm has requested to consider their case without insisting for GSM in the export documents. The firm has further stated that at the time of issuance of License, GSM of the fabric was not categorically stated, hence neither at the time of clearance of imported goods and nor at the time of exports the same was mentioned in any of the documents or was insisted upon, although other technical specification of the fabric as given in the license was clearly stated in all import & export documents. The norms were decided in November 2012 where as their exports towards fulfillment of their export obligation was over in March 2010.

As the authorization issued in this has already been ratified by the Norms Committee in its meeting held on 08.11.2012, at this stage there is no role of the committee. In view of above, the committee decided to advise RA, Kolkatta to take appropriate action as per documents submitted by the firm in this case. }
