Minutes of NC-V meeting held on 26.03.2015.

The meeting No.47/AM-15 for the licensing year 2014-15 to consider the cases under Duty Exemption Schemes (Chapter-4) ) was held on 26.03.2015 Room No.11 of DGFT under the Chairmanship of Shri K.C. Rout, Addl. DGFT. The following officers were present:-

At the outset the Minutes of NC-V Meetings No.45/AM-15 dated 12.03.2015 were taken up for ratification. As there was no amendment to the same, the above referred minutes were adopted for implementation by the Committee without any amendment. The agenda for meeting No.47/AM-15 dated 26.03.2015 was taken up for discussion and the decision taken in respect of each case is enumerated below:-

(9) Ratification of input output norms in respect of Annual Advance Authorization No. 0710095646 dated 29.05.2013.

Now the firm vide their letter dated 27.01.2015 has stated that<br>they had imported 100% Polyester Printed Fabric GSM 115 and 100% Polyester Dyed Fabric GSM<br>100 (S.No. 1&2) of licence import item list for export of 34850 Nos. of Girls Dress made of 100%<br>Polyester Printed fabric GSM 115with 100% Polyester Dyed fabric, GSM 100 (S.No. 1 of licence<br>condition Sheet). Since the buyers have reduced the garment order quantity from 34850 Nos to<br>20500 Nos. and they had canceled the remaining garment order quantity i.e. 14350 Nos. cancelled.<br>As per their buyers revised order quantity they had fulfilled the export obligation. i.e. 20500 Nos of<br>Girls Dress. They were left with fabric of 31570 Sqms of 100% Polyester Printed fabric, GSM 115<br>and 21812 SQMs of 100% Polyester Dyed fabric GSM100. Further stated that they had tried to re-<br>export the above mentioned left over fabrics to their foreign supplier. But they refused to take back<br>the fabrics. They have approached their foreign buyer and requested them to provide orders. As per<br>their request they have placed 9368 Nos of Ladies dress made of 100% Polyester Printed fabric,<br>GSM 115 and10640 Nos of Ladies Shirt (full sleeve made of 100% Polyester Dyed fabric GSM 100.<br>As stated by the firm they have now taken the licence EOP extension upto 31.05.2015 to effect<br>above export under AA stated above. They have requested to re-fix the norms (change of export<br>items) for SI. No. | of licence condition sheet to enable them to fulfill export obligation of the above<br>licence. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the case. This matter was earlier examined by the committee in its meeting held on 09.10.2014 and ratified the authorization issued in this case. Now the firm has requested to allow 1.79 Sqm /pe fabric instead of 1.36 Sqm/pc. Since any justification for enhancement is not given by the firm. The committee decided to ask the firm for justify the CAD with sample to enable us to process the matter. The case stand defer for re-listing on 23.04.2015. (11)

Fixation of input output norms in respect of Advance Authorization No. 0510386965 dated

Decision: The committee considered the case as per agenda alongwith other relevant papers. The firm has requested for ratification the Lubricating agent on net to net basis as per earlier decision as referred in this case because the O/o the Textile Commissioner did not ratified lubricant agent in this case so far. It is noted that the case was earlier examined by the committee in its meeting held on 04.10.2007 and ratified the authorization issued in this case as detailed below: “Decision: The Committee considered the case as per agenda alongwith other relevant papers decided to ratify the Advance authorization issued in this case by allowing Polyester Staple Fiber with 5% wastage and for fixation of norms for remaining item of import i.e. Lubricating Agent, case may be referred to TC, Mumbai. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.”’

The committee decided to ask TC, Mumbai for a report of the case. It was decided to defer the case for 23.04.2015.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the applicant firm has not mentioned the export item in his documents submitted to DGFT for fixation of adhoc norms. The committee heard Mr. Rajesh Kumar Saha, Plant Head and Mr. Dilip, Exim Manager of the firm in its meeting held on 05.03.2015. They explained the case in detailed. But in absence of product wise wastage of all export items in all processing stages it was not possible for the committee to calculate the requirements of the firm in this case. Therefore the representatives of the firm were suggested to submit the same to enable us to process the matter further. The firm vide their letter dated 11.03.2015 submitted total stage wise wastage. The technical members of the committee felt that the product wise wastage is must in this case. Therefore it was decided to ask the firm for the same and defer the matter for relisting on 23.04.2015.

M/s Naser Bali (Gloves) Pvt. Ltd.

Decision: Vide their letter dated 10.09.2013 M/s Naser Bali (Gloves) Pvt. Ltd requested for Fixation of Standard Input Output Norms (SION) for ‘Golf Gloves’ made of knitted fabric. Vide our letter dated 09.10.2013 the firm was asked to submit four years consumption data of 3-4 different firms of same product (i.e. Golf Gloves made of knitted or crocheted fabrics). The firm vide their letter dated 16.05.2014 stated that no other firm is manufacturing Golf Gloves of knitted or crocheted fabric. The Apparel Export Promotion Council (AEPC) has also recommended for fixation of the SION as requested by the firm. As recommended by Apparel Export Promotion Council (AEPC) vide their letter dated 11.03.2015 other firm has neither te 6 lb _-

approached them for recommendation letter for fixation of SION nor other firm have applied advance authorization under para 4.7 (for ad-hoc norms) for export product Golf Gloves made of knitted or crocheted fabric. It is stated that the input outputs for Golf Glove made of leather and in combination of textile materials are already existence at SION G-18. The Committee in consultation with the members presented in meeting recommended to fix new Standard Input Output Norms (SION) in Leather product Group as detailed below:
