Final Minutes of 6th BoA Meeting - 06th October,2006

Minutes of the 6th Meeting of the Board of Approvals held on 6th October 2006 under the Chairmanship of Shri Gopal K Pillai, Commerce Secretary, in Room No. 141, Udyog Bhavan, to consider proposals for setting up of Special Economic Zones.

A meeting of the SEZ Board of Approval was held on 6th October 2006 at 02.30 pm under the Chairmanship of Shri Gopal K. Pillai, Commerce Secretary to consider proposals for setting up new Special Economic Zones. The list of participants is enclosed. (Appendix I)

The Member Secretary informed the Board members that the Chairman of the Board, Shri Gopal K. Pillai has been elevated to the post of Commerce Secretary w.e.f. 01.10.2006 and the Central Government has approved that Commerce Secretary would be the Chairman of the SEZ Board of Approval. A notification to this effect has been issued on 05.10.2006.

Subsequently the agenda items were taken up for discussion and the Board made the following recommendations.

Agenda Item No. 1

A. Recommendations for Formal Approvals

Setting up of a sector specific SEZ for IT/ITES at
Ganga Malanpur, Near IIITM Gwalior, Madhya Pradesh by Madhya Pradesh State Electronics Development Corporation Limited (MPSEDC)
with an area of 20.24 hectares (Sl. No. 7):

The Board noted the Developer was in possession of the land. The State Government had also recommended the proposal. Accordingly, the Board decided to grant formal approval for setting up of a sector specific SEZ for IT/ITES at Ganga Malanpur, Near IIITM Gwalior, Madhya Pradesh by Madhya Pradesh State Electronics Development Corporation Limited (MPSEDC) over an area of 20.24 hectares.

Setting up of a sector specific SEZ for Electronic Hardware & software including ITES at Kancheepuram, Tamilnadu by M/s. Arun Excello Infra Pvt. Ltd. - 10.93 hectares (Sl. No.30):

The Board noted the Developer was in possession of the land. The State Government had also recommended the proposal. Accordingly, the Board decided to grant formal approval for setting up of a sector specific SEZ for Electronic Hardware & software including ITES at Kancheepuram, Tamilnadu by M/s. Arun Excello Infra Pvt. Ltd. over an area of 10.93 hectares.

Setting up of a sector specific SEZ for IT/ITES at
Eachanari, Coimbatore, Tamil Nadu by M/s. Span Ventures Pvt. Ltd. - 10.441
hectares (Sl. No. 37):

The Board noted the Developer was in possession of the land. The State Government had also recommended the proposal. Accordingly, the Board decided to grant formal approval for setting up of a sector specific SEZ for IT/ITES at Eachanari, Coimbatore, Tamil Nadu by M/s. Span Ventures Pvt. Ltd. over an area of 10.441 hectares.

Setting up of a sector specific SEZ for IT/ITES at Paiyanur, Tamilnadu
by M/s. Anush Infrastructure – 40.56 hectares (Sl. No.38):

The Board noted that the Developer was in possession of 26.71 hectares of land. The State Government had also recommended the proposal. Accordingly, the Board decided to grant formal approval for setting up of a sector specific SEZ for for IT/ITES at Paiyanur, Tamil Nadu by M/s. Anush Infrastructure over an area of 26.71 hectares.

Setting up of a sector specific SEZ for IT/ITES at No. 51, Sholinganallur Village, Old Mahabalipuram Highway, Tambaram Taluk, Kancheepuram District, Tamil Nadu by Haaciendaa Infotech and Realtors Private Limited - 26.62 hectares (Sl. No: 42):

The Board noted the Developer was in possession of the land. The State Government had also recommended the proposal. Accordingly, the Board decided to grant formal approval for setting up of a sector specific SEZ for for IT/ITES at No. 51, Sholinganallur Village, Old Mahabalipuram Highway, Tambaram Taluk, Kancheepuram District, Tamil Nadu by Haaciendaa Infotech and Realtors Private Limited over an area of 26.62 hectares.

The Board noted the Developer was in possession of 24.13 H out of the proposed land of 26.94 hectares. The State Government had also recommended the proposal. Accordingly, the Board decided to grant formal approval for setting up of a sector specific SEZ for for IT/ITES at Kalapatty Village, Coimbatore, Tamil Nadu by Bannari Techno Park Limited over an area of 24.13 hectares.

Setting up of a sector specific SEZ for Footwear at
SIPCOT Cheyyar Industrial Park in Mathur, Mangal Villages, Thiruvannamalai District, Tamil Nadu by Lotus Footwear Enterprises Ltd. - 111.34 hectares (Sl. No 60):

The Board noted the Developer is a 100% subsidiary of M/s. Growth Link Enterprises which are the largest subcontractor for NIKE shoes. It was also noted that they have proposed employment for 20000 persons 80% of which would be women. The developer was in possession of the land and the State Government had also recommended the proposal. Accordingly, the Board decided to grant formal approval for setting up of a sector specific SEZ for Footwear at SIPCOT Cheyyar Industrial Park in Mathur, Mangal Villages, Thiruvannamalai District, Tamil Nadu by Lotus Footwear Enterprises Ltd. over an area of 111.34 hectares.

at Coimbatore, Tamilnadu by Suzlon Infrastructure Limited

107.28 hectares (Agenda Item No. 4- Main Agenda):

The Board noted the Developer was in possession of the land and that the Development Commissioner MEPZ SEZ has gone through the land documents. The State Government representative also recommended the proposal. Accordingly, the Board decided to convert the in-principle approval granted earlier to formal approval for setting up of a sector specific SEZ for High tech. Engineering at Coimbatore, Tamilnadu by Suzlon Infrastructure Limited over an area of 107.28 hectares.

B. Recommendations for In-Principle Approvals

Setting up of a sector specific SEZ for Manufacture and export of Aluminium & Aluminium products along with 750 MW power plant at
Bargwan, District Sidhi, Madhya Pradesh by Hindalco Industries Limited - 2025 hectares (Sl. No. 11):

The State Govt. representative informed that the State Govt. recommends the proposal for in-principle approval. Accordingly, the Board decided to grant in- principle approval for setting up of a sector specific SEZ for Manufacture and export of Aluminium & Aluminium products along with 750 MW power plant at Bargwan, District Sidhi, Madhya Pradesh by Hindalco Industries Limited with an area of 2025 hectares. The entire requirement of 750 mw would be utilized within the SEZ.

Setting up of a Multi Product SEZ at Villages Budhania, Bada Bangarda, Limboda and Palakheri, Indore, Madhya Pradesh by Writers and Publishers Limited - 4050 hectares (Sl. No: 14):

the proposal for in-principle approval. While granting in principle approval the Board laid down the conditions that (i) the Developer may satisfy the criteria of minimum networth of Rs. 250 Crores required for Multi product SEZs; (ii)

finalise the proposed FDI component by the Swiss company Visa Minmetal AG prior to coming up for Formal Approval and (iii) that double crop agricultural land is within the limits prescribed for the purpose. Subject to
these conditions, the Board decided to grant in-principle approval for setting up of a Multi Product SEZ at Villages Budhania, Bada Bangarda, Limboda and Palakheri, Indore, Madhya Pradesh by Writers and Publishers Limited with an area of 4050 hectares.

Setting up of a sector specific SEZ for Multi product at Alwar District, Rajasthan by Adani Exports Limited - 10000 hectares (Sl. No: 23)

The State Govt. representative informed that the State Govt. had recommended the proposal for in-principle approval. The Board noted that the application was for 10000 hectares, but directed that initially the approval be granted for 1000 hectares only and that the developer may come back with expansion plans subsequently. Accordingly, the Board decided to grant in-principle approval for setting up of a sector specific SEZ for Multi product at Alwar District, Rajasthan by Adani Exports Limited with an area of 1000 hectares.

Setting up of a sector specific SEZ for Pharmaceutical based on Biotechnology at Hosur, Krishnagiri District, Tamil Nadu by BioPure HealthCare Private Limited - 365 hectares (Sl. No. 29):

the proposal for in-principle approval. The Board noted that the proposal was in joint venture with the State Government. Since the approval cannot be granted for two sectors, the Board directed that a firm commitment on the sector be sought. However, based on the views expressed by the State Government, the Board decided to grant in-principle approval for setting up of a sector specific SEZ for Pharmaceutical based on Biotechnology at Hosur, Krishnagiri District, Tamil Nadu by BioPure HealthCare Private Limited with an area of 365 hectares.

Setting up of a sector specific SEZ for FTWZ at Mannur Village, Sriperembdur Taluk, Kancheepuram Distt., Tamil Nadu by J. Matadee Eco Parks Pvt. Ltd - 40 hectares (Sl. No: 31):

the proposal for in-principle approval. The Board noted that there was Taiwanese collaboration involved in the project and that Formal approval can be considered only after the minimum required land is acquired by the Developer and is in possession. Accordingly, the Board decided to grant in-principle approval for setting up of a sector specific SEZ for FTWZ at Mannur Village, Sriperembdur Taluk, Kancheepuram Distt., Tamil Nadu by J. Matadee Eco Parks Pvt. Ltd with an area of 40 hectares.

Setting up of a sector specific SEZ for Light Engineering Sector at Seekinakuppam Village, Cheyyur Taluk, Kancheepuram District, Tamil Nadu by New Chennai Township Private Limited - 126.26 hectares (Sl. No: 48):

the proposal for in-principle approval. The Board noted that proposal involved financial support from Deutche bank to the extent of US $ 200 million for two SEZ projects to be promoted by the company and directed that before coming up for Formal approval, this arrangement may be firmed up. Further, the Board decided that approval be granted for Light Engineering sector SEZ and not for Auto ancillaries, which is a separate sector. Accordingly, the Board decided to grant in-principle approval for setting up of a sector specific SEZ for Light Engineering Sector at Seekinakuppam Village, Cheyyur Taluk, Kancheepuram District, Tamil Nadu by New Chennai Township Private Limited with an area of 126.26 hectares.

Setting up of a sector specific SEZ for Multi services at Seekinakuppam Village, Cheyyur Taluk, Kancheepuram District, Tamil Nadu by New Chennai Township Private Limited – 121.41 hectares (Sl. No.50):

the proposal for in-principle approval. The Board noted that proposal involved financial support from Deutche bank to the extent of US $ 200 million for two SEZ projects to be promoted by the company and directed that before coming up for Formal approval, this arrangement may be firmed up. Accordingly, the Board decided to grant in-principle approval for setting up of a sector specific SEZ for Multi services at Seekinakuppam Village, Cheyyur Taluk, Kancheepuram District, Tamil Nadu by New Chennai Township Private Limited with an area of 121.41 hectares.

Setting up of a sector specific SEZ for Textile and Apparel Park at District Krishnagiri, Tamil Nadu by Best and Crompton – 120 hectares (Sl. No.52):

the proposal for in-principle approval. The Board noted that there is a collaboration with an Indonesian company in this case. Accordingly, the Board decided to grant in-principle approval for setting up of a sector specific SEZ for Textile and Apparel Park at District Krishnagiri, Tamil Nadu by Best and Crompton with an area of 120 hectares.

Setting up of a sector specific SEZ for Multi Product at Perambalur
by Tamil Nadu Industrial Development Corporation (TIDCO) - 1225 hectares (Sl. No: ):

the proposal for in-principle approval. Accordingly, the Board decided to grant in- principle approval for setting up of a sector specific SEZ for Multi Product at Perambalur by Tamil Nadu Industrial Development Corporation (TIDCO) with an area of 1225 hectares.

Setting up of a sector specific SEZ for Engineering at NH-6, Uluberia- Haldia Corridor, District Howrah, West Bengal by SEZ Infrastructure Developers – 105 plus hectares (Sl. No.62):

the proposal for in-principle approval. The Board noted that the proposal involves FDI with a Singaporean company and directed that this arrangement may be firmed up before coming up for Formal approval. Accordingly, the Board decided to grant in-principle approval for setting up of a sector specific SEZ for Engineering at NH-6, Uluberia-Haldia Corridor, District Howrah, West Bengal by SEZ Infrastructure Developers with an area of 105 plus hectares.

Setting up of a sector specific SEZ for Multi product at Kalyanbill and Motiagacha sites at North 24 Parganas, West Bengal, by Videocon Realty & Infrastructures Limited – 1080 hectares (Sl. No: 73).

the proposal for in-principle approval. Accordingly, the Board decided to grant in- principle approval for setting up of a sector specific SEZ for Engineering at NH-6, Uluberia-Haldia Corridor, District Howrah, West Bengal by SEZ Infrastructure Developers with an area of 1080 hectares.

Setting up of a sector specific SEZ for Electronics at Suryapur Mouza at North 24 Parganas, West Bengal by Videocon Realty & Infrastructures Limited – 144 hectares (Sl. No: 75).

the proposal for in-principle approval. The Board noted that the investment envisaged is only Rs. 240 crores which was below the minimum criteria fixed and directed that the Developer should have a minimum investment of Rs. 250 crores. The Board further noted that the application was for Electronics and IT Hardware including ITES and after discussions and consultation with the State Government representatives decided to modify the proposal for Electronics Goods sector. Accordingly, the Board decided to grant in-principle approval for setting up of sector specific SEZ for Electronics at Suryapur Mouza at North

24 Parganas, West Bengal by Videocon Realty and Infrastructures Limited with an area of 144 hectares.

Setting up of a sector specific SEZ for Multi product at Uluberia, Sankrail, Bagnan and Amta West Bengal, by Videocon Realty & Infrastructures Limited – 1000 hectares (Sl. No: 76):

the proposal for in-principle approval. Accordingly, the Board decided to grant in- principle approval for setting up of a sector specific SEZ for Multi product at Uluberia, Sankrail, Bagnan and Amta, West Bengal, by Videocon Realty & Infrastructures Limited with an area of 1000 hectares.

Setting up of a sector specific SEZ for Multi product at Haldia, Purba Medinipur, West Bengal, by New Kolkata International Development Private Limited – 5000 hectares (Sl. No. 80).

The State Govt. representative informed that this is a Salim Group project which has a net worth of Rs. 4573 Crores and the State Govt. recommends the proposal for in-principle approval. Accordingly, the Board decided to grant in- principle approval for setting up of a sector specific SEZ for Multi product at Haldia, Purba Medinipur, West Bengal, by New Kolkata International Development Private Limited with an area of 5000 hectares.

Setting up of a sector specific SEZ for Chemicals at Nandigram, Purba Medinipur, West Bengal, by New Kolkata International Development Private Limited – 4000 hectares (Sl. No: 81).

The State Govt. representative informed that this is a Salim Group project which has a net worth of Rs. 4573 Crores and that the State Govt. recommends the proposal for in-principle approval. Accordingly, the Board decided to grant in- principle approval for setting up of a sector specific SEZ for chemicals at Nandigram, Purba Medinipur, West Bengal, by New Kolkata International Development Private Limited with an area of 4000 hectares.

Setting up of a sector specific SEZ for Electronics Industry at

the proposal for in-principle approval. It was noted that their proposed investment is less than Rs. 250 Crores and the Board directed that they must ensure a minimum investment of Rs. 250 Crores. Accordingly, the Board decided to grant in-principle approval for setting up of a sector specific SEZ for Electronics Industry at between Barrackpur-Barasat Road & Kalyani Express Highway

in North 24 Parganas District in West Bengal, by Salarpuria Properties Private Limited with an area of 208.5 hectares subject to the condition that minimum investment of Rs. 250 Crores shall be made.

Setting up of a sector specific SEZ for Auto component at Kharagpur, West Bengal, by Bengal Srei Infrastructure Development Limited – 200 hectares (Sl. No.85)

The State Govt. representative informed that the State Govt. recommends the proposal for in-principle approval. Accordingly, the Board decided to grant in- principle approval for setting up of a sector specific SEZ for Auto component at Kharagpur, West Bengal, by Bengal Srei Infrastructure Development Limited with an area of 200 hectares.

B. Decisions for Deferment:

Consideration of rest of the proposals was deferred on the basis of lack of clear State Government Recommendations on land availability or the type of land envisaged, lack of clarity on the net worth and other financial details of the promoters, sector proposed etc. The list of deferred and withdrawn proposals is placed at Annexure I.

Agenda Item No. 2

The Board approved the request of M/s. Riverbank Holding Private Limited in Bata India Limited IT/ITES SEZ at Bata Nagar, West Bengal.

Agenda Item No. 3

As regards the ratification of approval granted for the activity of water supply of Apparel Park, SEZ, Phase II in the Indore SEZ , the Member Customs remarked that the SEZ Act, 2005 does not cover activities outside the SEZ and that the Board can grant approvals only with regards to the activities undertaken within SEZ. The State Government representatives argued that equipment up to source must be allowed duty free as water has to be drawn from the source. The Board, however, approved activity of water supply to the extent established within the notified area of the SEZ.

Agenda Item No. 5 to 9

The Member Customs and Member CBDT informed that the list of authorized operations is still pending approval of the Finance Minister and suggested that the approval of authorized operations may be deferred till such time the approval is received. The Chairman requested for an early decision as the work in several SEZs is held up due to non approval of authorized operations.

E. Supplementary Agenda:

Item No. 2: Request of M/s GIDC for transfer of formal approval in the name of Dahej SEZ Limited

The request of M/s GIDC for transfer of formal approval in the name of Dahej
SEZ Limited was placed before the Board of Approval and approved.

Item No. 3: Request of M/s Sanghi Industries Limited for changing the name of the Company to M/s Sanghi SEZ Private Limited.

The Board took note of the request of M/s Sanghi Industries Limited for changing the name of the Company to M/s Sanghi SEZ Private Limited.

Table Agenda:

Request for approval for conversion of Reliance, Jamnagar notified sector specific zone as Multi-product SEZ and relaxation of contiguity:

It was noted that M/s Reliance Infrastructure Limited were granted approval for setting up of an SEZ in an area of 440.08 hectares and notified as an SEZ on 19.4.06. The Board, in its meeting on 17th March, 06 had also granted in principle approval to the Developer for expansion of the sector-specific SEZ as and when the minimum area of 1000 hectares is acquired by the Developer.

It was informed that M/s. RIFL are now in possession of the additional land of 784 hectares and had sought formal approval for a Multi product SEZ. However,
since there was a thoroughfare comprising of two rail lines and two roads on the area under possession, the Developer had sought relaxation of the contiguity principle, for which they had agreed to make requisite arrangements, to the satisfaction of the Board.

When this issue was raised in the BoA meeting held on 28th September, Member (CBDT) raised the issue whether the Board of Approval is authorized to grant relaxation under the SEZ Rule 5.2 (a) – 3rd provision and the representative of the Ministry of Law agreed to come back with his views in this meeting.
However, in the absence of the views of the Ministry of Law in this meeting and as required by Member, CBDT, it was decided to obtain the views of the Ministry of Law on file and take a decision in the next BoA meeting.
