Request: Review of NC’s decision taken by NC in its Meeting No. 10/AM12 held on 08.06.2011 against five advance authorizations.

Decision: Various cases of the M/s Diab Core Materials Pvt. Ltd., Chennai were discussed in Norms Committee. In these cases NC had already fixed norms after providing PH to firm based on information provided by the firm as per the comments of D/o C&PC. Subsequently, the firm has sent various representations pointing out that wastage norms are not sufficient. These representations were forwarded to D/o C&PC.

  1.     D/o C&PC vide its OM No. 46011/16/2009-PC.II dated 22.12.2011 has informed that the representation were examined

on volume basis and the detailed comments indicating comprehensive mathematical calculations for arriving at the duty free import entitlement is enclosed herewith. However, it is seen that the mathematical calculation was not enclosed with the OM of D/o C&PC.

PRO version 3. These cases were discussed in NC with the Technical Representative of D/o C&PC, who pointed out that the firm has not provided information either on weight to weight or volume to volume basis because of which it is not possible to fix/revise wastage norms.

  1.     Accordingly, it was decided to ask firm to submit following information within 15 days in respect of their past application as

well as in their present application:

(a) In respect of every application a copy of Advance Authorization should be sent. The detailed mathematical calculations for import and output material on the basis of which the firm has arrived at wastage and import quantity should also be indicated. Simultaneously wherever NC has already fixed norms, a copy of NC’s decision may also be sent for a purpose of better correlation.

(b) Firm should clearly indicate specific item of export, import (whether PVC Foam Blank or PVC Rigid Block) with technical specification including area / volume.

(c) Size / dimensions, area etc. of import products giving mathematical calculations, size and area in subsequent stage of conversion in the case of Foam Blank to PVC Rigid Block, and in the final export item i.e. PVC Sheet in terms of size and total area (cubic meter/sq. meter) with detailed mathematical calculations for the input and output material at each stage alongwith technical justification for yield / wastages for each of the export item.

  1.     The Committee considered all the above three requests of firm and it was observed that  earlier the norms were fixed on the

basis of 4.7 application and in that application, the wastage applied for by the firm was lower and also the firm did not apply for the packing material. The Committee after deliberation came into the conclusion that the norms only can be fixed on the basis of 4.7 application, that is, as applied for by the firm and no other benefit can be given apart from that. Hence, the Committee decided to reject the request no. 1 and 2.

  1.       With regard to request no. 3, the Committee noted that the firm has metnioned that RLA, Mumbai has already carried out

amendment in the Advance Authorization : change of ITC HS Code of Export Product. The Committee has no objection to it.
