DIRECTORATE GENERAL OF FOREIGN TRADE DESVI (FOOD & MISC) Minutes of the meeting No. 04/13 of NCVI held on 10.05.2012. Meeting No. 04/13 for the licensing year 201213 to consider cases under Duty Exemption Schemes (Chapter4) of Foreign Trade Policy 200914 pertaining to Misc. & Food Products was held on 10.05.2012 under the Chairmanship of Ms. Shubhra, Jt. The firm earlier represented to the GRC against the decision of the Norms committee and the GRC had directed that a wastage of 5% may be allowed provided it is satisfied that identical item as quoted in this AA has been sanctioned and exports completed . Further , it is directed that if the firm has not fulfilled EO , penalty as per rule may be charged. 3. Thereafter, the matter was reconsidered by the Norms Committee and on review has reiterated the earlier decision. 4. In the present request , the firm has submitted as under: (a) A change in the management and structure of the company / staff dealing with this case which resulted in disruption of norml work. As a result of amalgamation, the name of the company was changed from Amalgam Food & Beverage s Ltd. to Innovative Foods Limited. (b) The company became a sick unit and had to be registered with BUFR, copy submitted with our letter dated 13.10.2010. Consequently , the new management was busy in attending matters related to BIFR which were very essential for the survival of company. (c) The company also could not attend the personal hearing before the Norms Committee or provided the data earlier due to the above reasons 5 The firm has been declared defaulter by RA, Cochin although exports have already been completed . The firm has requested that ratification may be allowed on net to net basis so that the authorization may be closed and regularization of the exports could be completed .
The case was considered by the committee as per agenda. The committee noted the comments furnished by the MFPI vide their O.M No 66/DGFT/ 2010 dated 30.4.2012. The Committee went through the detailed documents, pictures and justifications.
