Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in similar case of the firm adhoc norms have already been fixed by NC in its meeting held on 16.10.2008 against advance authorization No.3110033408 dated 04.04.2008 and such adhoc norms fixed shall be valid for one year. NC has already clarified that in such cases there is no need to refer the case to Norms Committee for ratification and R.A may decide the case on repeat adhoc norms basis. In view of this Committee decided to withdraw this case from agenda.

Ltd., Bangalore F.No. 01/84/50/468/AM-07/DES-V Ratification of input output norms against Advance Authorization No. 0710049487 dated 09.01.2007 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. S.Hariharan, Manager, who appeared for personal hearing. He explained the case alongwith sample in respect of export item No. 1 i.e Men’s shorts. The Committee observed that in this case export order is for single size (Style No. 7B1300), which has been mentioned in the invoices. As per CAD, CAM, design submitted by the firm, the consumption comes to 3.37 Sq mtrs./Pc. Since, applicant firm have sought the input Qty. @ 3.35 Sq mtrs/Pc, hence, Committee decided to allow the same i.e as applied by the firm.

Ltd., New Delhi F.No. 01/84/50/638/AM-04/DES-V Ratification of input output norms against Advance Authorization No. 0510113090 dated 29.12.2003 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and observed that this case has already been cleared by ALC in its meeting held on 03.02.2005 imposing size-wise specification in each export product. Committee in consultation with the representatives of technical authorities present in the meeting decided to waive size-wise specification mentioned in the description of each export products in this case. R.A may be advised to issue EODC accordingly in partial modification of its earlier decision. The Committee also decided that R.A may take a note that wherever size-wise specification is mentioned on the description of export product (average size for accounting), they should not insist on that average size.

M/s Drishti Apparels, Gurgoan F.No. 01/84/50/766/AM-09/DES-V Ratification of input output norms against Advance Authorization No. 0510122397 dated 31.03.2004 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Anil
PRO version Budhiraj, an authorized representative of the firm, who appeared for personal hearing before NC. He explained the case alongwith sample of various sizes. He explained that in this case export product is ‘Girls 100% cotton woven denim divided skort’ which is pleated frill (Skirt) of variable width. As per CAD, CAM, design submitted by the firm, the consumption comes to 1.20 Sq mtrs./Pc. Since, applicant firm have sought the input Qty. @ 1.15 Sq mtrs/Pc, hence, Committee decided to allow the same i.e as applied by the firm in partial modification of its earlier decision.

M/s Cliovenus Inc., Bangalore F.No. 01/84/50/451/AM-09/DES-V Ratification of input output norms against Advance Authorization No. 0710062736 dated 04.02.2009 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and observed that this case has already been cleared by NC in its meeting held on 12.03.2009 by allowing inputs with 28% wastage. Now firm have clarified that they are exporting dyed/twisted silk yarn, which is only one process before manufacture of fabrics. Hence, Committee in consultation with the representatives of technical authorities present in the meeting decided to re-fix the norms from earlier 28% wastage to 34% wastage in this case. R.A may work out the Qty. of inputs accordingly.

M/s Lumens India, Kolkata F.No. 01/84/50/352/AM-07/DES-V Ratification of input output norms against Advance Authorization No. 0210118753 dated 22.10.2008 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and went through the paper cutting, calculation sheet & photograph submitted by the firm. The Committee observed that applicant firm have neither mentioned the sizes of the export product nor the calculation sheet to arrive at the net content of export & import, in absence of which it is not possible to compute the requirement of inputs. For example, as regards export item No. 1 firm have simply mentioned 0.115 mts. without giving any justification for calculation arriving at the same. In view of this Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to maintain status quo in this case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that case is under examination of DC (MSME) and they have sought some information/documents from firm, which are still awaited. It was decided to await the same and defer the case for re-listing on 18.06.2009.

PRO version F.No. 01/84/162/36/AM-09/DES-V Ratification of input output norms against Advance Authorization No. 0310462421 dated 25.02.2008 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that as per CAD submitted seeking enhancement in the Qty. of inputs, the Qty. for XL size of export product No. 1 (Length- 3.18 mtrs., Width- 60” , Efficiency – 91.32%) comes at 4.83 Sq mtrs./Pc, which is much higher than the Qty. sought for (4.47 Sq mtrs/Pc). Hence, Committee felt that this CAD cannot be taken into account for any revision in the Qty. in this case. In view of this Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to maintain status quo in this case.

Case No.160
M/s Kartikeya International, Kanpur F.No. 01/84/162/604/AM-08/DES-V Fixation of SION for Top Mark Harness Sets. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that request for fixation of SION has come from only one firm in this case i.e from M/s Kartikeya International, Kanpur. SIONs are fixed on the basis of industry experience of at least 3-4 different firms, who are engaged in the same manufacturing process. In view of this Committee decided to reject the request of the applicant firm and to advise the applicant firm to apply their case under Para 4.7 and NC will fix the adhoc norms on repeat basis.
