MEETING NUMBER : 35/82‐ALC4/2010 MEETING DATE : 30.11.2010 The Meeĕng No.35/82 in the year 2010‐11 to consider the cases under Duty Exempĕon Scheme (Chapter‐4) of Foreign Trade Policy, 2009‐14 pertaining to products falling in Chapter 29 and 30 was held on 30.11.2010 under the Chairmanship of Addl DGFT, Shri V.K. Shri Shyam Lal, FTDO At the outset, minutes of Norms Commiĥee Meeĕng No. 31/82 dated 09.11.2010, 32/82 dated 16.11.2010 and 33/82 dated 23.11.2010 were raĕfied by the Commiĥee.

M/s Biological E. Ltd. Norms Commiĥee Meeĕng No. 35/11 F.No.01/82/050/00099/AM11/DES‐III Meeĕng Date 30.11.2010 RLA F. No. 09/24/040/00442/AM10 Adv. Lic. No.0910040651 dated 27.01.2010 The representaĕves of the firm appeared for personal hearing before the Commiĥee. They informed the Commiĥee that the purity of Crude Heparine Sodium is between 92%‐98%. The firm with its representaĕon had furnished Cerĕficate of Analysis from foreign supplier. Representaĕves of the firm also explained that purity of import item varies from batch to batch and also that substanĕal import has been made. Representaĕve of Department of Pharmaceuĕcals menĕoned that the issue is under their consideraĕon and they would furnish their comments. However, the Commiĥee also decided to call for Central Excise cerĕfied producĕon and consumpĕon data from the firm and to defer the case for 25.01.2011.

No.0910040650 dated 27.01.2010 The representaĕves of the firm appeared for personal hearing and menĕoned that they had not made any import so far against the Advance Authorisaĕon and also that imports take place in batches. The technical members felt that in absence of purity of import item, it was not possible to fix norms as the product is such where low purity of import item changes combinaĕon of other items in the mixture. In such circumstances, the firm was asked to
furnish purity of import items alongwith Cerĕficate of Analysis from foreign supplier for each batch a├er substanĕal import is completed. The firm was also asked to produce producĕon and consumpĕon data cerĕfied by Central Excise. The Commiĥee decided to re‐open the case when the requisite informaĕon is made available by the firm.

M/s Merit Healthcare Pvt. Ltd. Norms Commiĥee Meeĕng No. 35/11 F.No.01/82/050/01690/AM09/DES‐III Meeĕng Date 30.11.2010 RLA F. No. 03/95/040/00909/AM09 Adv. Lic. No.0310509173 dated 25.02.2009 Commiĥee considered case as per agenda. The representaĕve of the firm appeared before the Commiĥee and explained the case. He informed the Commiĥee that approximately 1.13 mg of Lincomycin Hcl is equivalent to 1 mg Lincomycin capsule. The representaĕve of Department of Pharmaceuĕcals informed the Commiĥee that the DML submiĥed by the firm alongwith their applicaĕon does not contain conversion of Lincomycin Hcl. A├er detailed deliberaĕons and in consultaĕon with technical authority present in the meeĕng, Commiĥee advised the firm to get the DML amended from Drugs Control Authority to the effect that each capsule contains Lincomycin Hydrochloride equivalent to 500 mg Lincomycin and also to submit producĕon and consumpĕon data cerĕfied by Central Excise Authority. Accordingly, case was deferred for 25.01.2011.
