A៻�er hearing the firm, the Commiោ�ee informed firm that they are impor៝�ng Hydrogen Generator and Compressor which are capital goods in nature which cannot be imported under advance authoriza៝�on and supplying these equipments directly as Hydrogen Genera៝�on Plant. The total CIF value of Rs.2.25 crore, the total value of Hydrogen Generator and Compressor itself is Rs.1.89 crore. If the items are imported and supplied as it is, the benefit of Deemed Export is not admissible as per of Policy Circular No.50 dated 28.12.2011. The Commiោ�ee informed the firm in the mee៝�ng that the benefit of Advance Authoriza៝�on is not admissible to them in this case. Accordingly, the Commiោ�ee rejected the case and closed the case on the part of NC. Simultaneously, the Chairman, NC‐I has drawn the aោ�en៝�on of the firm to Custom No៝�fica៝�on No.12/2012 dated 17.3.2013 wherein it is permiោ�ed to import goods for Mega Power Projects without payment of custom duty and suggested the firm to explore the possibility of clearing the goods under zero custom duty under this custom no៝�fica៝�on subject to compliance of condi៝�ons as given in this no៝�fica៝�on. 4
