taken up. Agenda Item No.1:- Confirmation of the Minutes of the 60°" Authority meeting held on 30.05.2023.
Decision: After deliberation, the Authority confirmed the Minutes of the meeting held on 30.05.2023 with consensus and directed following actions to be initiated :- (a) ADC (Finance) to follow up with the CBDT for retrospective IT exemption under section 10 (46) of IT Act and update in the next Authority meeting (b) Separate letter to be issued to CEO, MIDC seeking urgent reply in respect of gala in Multistoried Bldg. as the said gala was not allotted since 2008 .
Agenda Item No. 1A:- Provision of Funds for the Projects to be executed in Phase 01 of Sprucing Up of SEEPZ in FY 2023-2024. Authority was apprised that the budget for FY 2023-2024 was taken up in the 59" Authority meeting, wherein funds were provisioned for projects that were planned to be implemented in this financial year by way of finalization of the Budget Manual 2023-24. However, it has been noticed that the budget manual itself and classification of accounts in Chapter 5 is erroneous. The projects amounting to Rs. 7,22,71,645/- are to be carried out on priority basis and a detailed justification has been mentioned for which the funds need to be requisitioned.
Decision: After deliberation and detailed observations, Authority agreed to make provision of funds and the execution of the works will be only on approval of the proposal in the Authority meeting. The details of the projects are as under:

Agenda Item No. 2:- Proposal for provision of Rs. 50,00,000/- as contingency fund for the financial year 2023-24 for any unforeseen expenditure by the SEEPZ Administration.
Authority was apprised. that there are certain bills amounting pending .to Rs. 9,96,107/- which was purchaseto be released as there is insufficient funds under the concerned sub-head and no funds for Budget of chairs, printer cartridge, printer, water heater etc. as specified in the Agenda. Also in the manual there is no provision of any contingency fund which needs. exigency/emergency usage of funds. to be provisioned for any Decision: After deliberation Authority, approved the provision of Rs. 50,00,000/- as contingency fund for the financial year 2023-24 for any unforeseen expenditure by the SEEPZ Administration. expentiture : However any 9,96,107/under contingency fund to be approved by Authority. Also for release of ‘funds of Rs. in principle approval granted for re-appropriation of funds. Agenda Item No. 3:- Proposal for post facto approval for additional payment of Rs.29,30,811/- to M/s. D.B. Infratech for excess quantity of excavation work of Mega CFC sites.
: The Authority was apprised that there was a requirement of additional quantity of excavation of Mega CFC site wherein, Tender Evaluation Committee in the meeting held on 12.05.2023 had asked to provide the justification & Certification of M/s. Meinhardt (PMC- Part-A) and M/s. WAPCOS Ltd., PMC for statutory compliances, on the excess quantity for excavation work of Mega CFC. Based on the justification and certification on the excess quantity the TEC had recommended the release of excess payment and accordingly payment was made. Accordingly, this office had released payment of Rs.29,30,811/- to M/s. D.B. Infratech for excess quantity of excavation work of Mega CFC site.
Decision:_ After deliberation, the Authority accorded post facto approval for additional payment of Rs.29,30,811/- to M/s. D.B. Infratech for excess quantity of excavation work of Mega CFC site.
Agenda Item No. 4:- Project for Repairing of sewer line Manhole chambers by raising the height up to the road level and providing Fiber-reinforced plastic (FRP) Manhole covers along with the frame (Phase Il) at SEEPZ SEZ : repairedAuthority was apprised that the manhole chambers are in damaged conditions and need to be type with providing brick masonry work for raising the height of chambers and providing new FRP are heavy duty covers on the top of the manholes. At some locations, the additional manhole chambers to be constructed to minimize the length between two manhole chambers. DPR for the said work amounting to approx. Rs. 36,92,800/- was obtained from MIDC. Time limit for execution of werk is 03 months as per the DPR provided by MIDC.
There is no budget provision for the said work. However, a requisition was made to Finance (Accounts & Procurement) Divn. Accordingly it was conveyed on mail dt. 13.06.2023 that there is a provision of Rs. 12 crores under the “Capital Head” and as the classification is One major head, the provision can be made under the said head.

Agenda Item No. 6:- Strengthening and resurfacing of internal roads including repairs to footpaths/paver blocks in SEEPZ SEZ premises & SEEPZ colony premises.
Authority was apprised that the proposal of strengthening and resurfacing of internal roads including repairs to footpaths/ paver blocks in SEEPZ premises & residential colony was placed before the 59th Authority meeting held on 05.04.2023 & 12.04.2023 with a tentative estimate amounting to approx Rs. 15,00,00,000/-. Authority granted in-principle approval and also directed Dy. Engineer, MIDC to provide the DPR alongwith the DSR rates on urgent basis and to specifically mention about the warranty period of the newly constructed roads and estimate should include the repair of four main concrete roads wherever necessary. MIDC submitted the Detailed Project Report with an estimated cost of Rs. 15,82,00,000/- the said work and the cost of Rs. 1,00,58,200/- includes Service road from SDF-I to Mega CFC and resealing of joints in concrete road from gate no. 1 to well chowk to Multistoried Bldg. amounting to Rs. 47,96,400/- Internal road near NEST 01 and resealing of joints in concrete road from well chowk to garbage plot amounting to Rs. 52,61,800. The timeline for completion of the work is 6 months. It was also apprised that there is a budget provision for Rs. 38/- lakhs for repair of main road in Sector 4 which was planned to be carried out by SEEPZ Administration in the wake of Mega CFC. However, since MIDC being the Special Planning Authority had mentioned that they would strength and refurnish the CC road, and asphalt road other than sector 4, hence, it was decided that MIDC would execute all the work.
MIDC will carry out the work in 2 Phases as under :

Agenda Item No. 7:- Structural and civil repair works of SEEPZ fire station bidg.[ Sector -V1]
Authority was apprised that the work of Structural and civil repair works of SEEPZ fire station building was taken up in the 59th Authority meeting held on Sth and 12th April 2023 and the Authority approved the proposal and requested to obtain the DPR. MIDC submitted the PPR for the work of “Structural and civil repair works of SEEPZ fire station building”.[ Sector —VI ], amounting to Rs.48.03 lakhs inclusive of 5% contingencies and 12.50% ETP charges respectively. The timeline for completion of the work is 6 months. There is a provision of Rs. 40.00 Lakhs for the above work and the balance provision of approx. Rs.10.00 lakhs is to be made in the budget. Hence, a requisition was made to Finance (Accounts & Procurement) Divn. Accordingly it was conveyed on mail dt. 13.06.2023 that there is a provision of Rs. 12 crores under the “Capital Head” and as the classification is one major head, hence the provision can be made under the said head. Decision: After deliberation, Authority approved the budget provision as justified in Agenda no. 1 A and Structural and civil repair works of SEEPZ fire station bldg to be executed by MIDC. ,
Agenda Item No. 8:- Repairs and renovation works in dry waste and wet waste Management Area along with the new Investment powder storage area.
Authority was informed that the Sector 2 consists of the majority of the waste management infrastructure including dry waste segregation area, wet waste processing zone i.e Biogas Plant and the investment powder storage area. These three locations have been under heavy weathering due to constant effluent release and deposit from the outlet chambers of jewelry processing factories. The total cost estimate for the aforementioned work is of Rs. 65,15,647/- The project will be executed as per the SOP for Works developed by SEEPZ Administration.
There is no budget provision for the said work. However, a requisition was made to Finance (Accounts & Procurement) Divn. Accordingly it was conveyed on mail dt. 13.06.2023 that there is a provision of Rs. 12 crores under the “Capital Head” and as the classification is one major head, hence the provision can be made under the said head.

Agenda Item No. 9:- Approval for repairing & painting work of Steel Racks & Cupboards at Record Rooms of SCB, BOI & BFC buildings and office Sector—I. SEEPZ-SEZ.
Authority was informed that in 58th Authority meeting held on 09.01.2023 that there are approx 500 steel racks in Bank Of India basement, BFC basement and SCB 1° floor record room which are in damaged conditions and some were found in corroded condition which need to be repaired and painted with 2 coat of steel Primer and 2 coat of Polyurethane Painting (PU paint) and approved the said proposal of approx. cost of Rs. 9,23,200/-. It was also informed that tender was floated on CPPP and on evaluating the technical and financial quote, the lowest quote was Rs. 7,56,376/- which was presented to the Tender Evaluation Committee. As the cost of the project was higher, TEC had suggested to explore cost through Local Purchase Committee. The quotes were received and the lowest quote thus received was Rs. 4,84,202/- which is less than the quote on CPP portal. The timeline for completion of the work is 45 days. There is a provision of Rs. 5,00,000/- for the above work.

Agenda Item No. 10:- Approach and Methodology for undertaking Structural Safety, Fire and Life Safety, Lift Safety and Electrical Safety Works in SEEPZ, SEZ
Authority was apprised that the proposal of planned Approach including Methodology for undertaking the Works necessary in making SEEPZ Infrastructure Compliant with various Statutory requirements was sent to MOC&I on 02.02.2023 & 19.04.2023 with a copy to PPD. The PPD reverted on 20.04.2023. The detailed methodology was apprised to the members and conveyed that all the work were carried out as per the rule provision so as Mega CFC & NEST 1 & 2.
Decision: After deliberation, Authority held the view that a letter should be sent to the Ministry with a request to forward the same to Public Procurement Divn., Ministry of Finance is to be taken on record and it was agreed that the methodology adopted is as per the compliance of GFR.
Agenda Item No. 11:- Update regarding status of the sector wise projects under the Sprucing Up of SEEPZ Initiative and intimation regarding projects to be undertaken for rejuvenation of SEEPZ in phase wise manner.
Authority was apprised that the projects being undertaken by SEEPZ Administration for the planned sprucing up of SEEPZ is distributed over four phases of works. Each phase focuses on different aspects for the Sprucing up of SEEPZ. The rejuvenation of SEEPZ SEZ Infrastructure shall be completed subject to the implementation of all the Spruce Up SEEPZ Phases. Decision: After deliberation, Authority noted the work to be executed in Phase-l. However no major structural repairs will be executed in Phase-ll, Ill & IV, instead old bldgs. will be demolished and new bldgs. will be constructed.

Authority was apprised that SEEPZ SEZ presently has a provision of Sewage Treatment Plant and Septic Tank admeasuring an area of 6164 sq. mtr. and the detailed capacity is 2.5 MLD and presently is partially functional and in order to keep the STP functional interim repairs amounting to Rs. 2,90,000/- needs to be carried out on priority.

Authority was apprised that the annual maintenance contract for functionality of STP is Rs. 1,65,000/- per month. Also there has been an outstanding which is to be paid to service provider. The total outstanding amount till May 2023 is Rs. 54,91,200/-. The payment has not been made as the service provider had not executed the contract agreement. The contract agreement was taken up in the 49°" Authority meeting for execution and regularization of agreement.

Agenda Item No. 13 :- Proposal of outstanding payment towards AMC of biogas plant — M/s. Aviplast. Authority was apprised that a total of Rs. 47,88,938/- needs to be paid in the form of outstanding waspayment due tothe existing service provider on boarded from April 2019. The release of pending dues also approved in the earlier 59" Authority meeting. Decision: After deliberation, Authority approved the proposal for release the payment amounting of Rs. 47,88,938/- to M/s Aviplast and directed the Estate Manager to monitor the functioning of the bio-gas plant and include in his report. “t Agenda Item No. 14 :- Proposal for operationalization of the unit viz. M/s. B. V. Star & M/s. B. V. Jewels with 2 Separate entry & exit in plot no. 55. sealing Authority was apprised that M/s. B.V. Jewels vide letter dt. 03.02.2023 had requested. for destart of factory premises and requested to grant No objection to customs authorities so that they can their operations, generate revenue and employment. They have mentioned that as the case is settled by Hon’ble Supreme Court and they have paid the entire amount, they requested for de-sealing the premises for operations. The details regarding eviction proceeding under PP Act, 1971 for both M/s. B.V Star & M/s. B.V Jewels and Litigation under custom issues was apprised to the Authority. Details regarding correspondence regarding renewal of LOA and outstanding dues of Rs. 89,17,830/- to be paid by M/s. BV Star was also intimated to the Authority.
Decision: After deliberation Authority examined the proposal and approved the proposal subject to following directions:

(a) Operate as per High Court order with 2 separate entry & exit in Plot no. 55 ie. 1% @ 2" floor to be operated by B.V. Star and 3% & 4" floor by B.V. Jewels.

(b) Proposal of operation to be placed in the Approval Committee and on approval, LOA to be issued for one year only for both the Units and to monitor their performance for a year and iffound satisfactory in terms of Rule 19 6 (b) of SEZ Rules 2006, continue their operations for further period of 4 years for the block period of 5 years

(c) Lease rent of the plot to be charged as per the prevailing rate (d) Sub-lease agreement to be executed after one year of monitoring the performance (e) Obtain NOC from Customs Authorities. (f) Pay the outstanding rental dues till date.
Authority also observed that as High Court has granted ad-interim relief on the eviction order and thus SEEPZ SEZ Authority cannot evict the Units. Therefore Authority is of the Opinion to permit the Unit to operate for increase of exports from SEEPZ and generation of more employment.

Agenda Item No. 16 :- Engagement of Fire & Life safety Consultancy for SEEPZ-SEZ.
Authority was apprised that as per the Maharashtra Fire Prevention and Life Safety Measures Act, 2006, it is mandatory to make the fire system operational for which it is necessary to engage FLS Consultancy for audit of entire premises. The Tender was uploaded on CPP portal, however only one bidder was qualifying. Hence the same is being re-tendered on CPP Portal.
Decision: After deliberation, Authority approved the engagement of Fire & Life safety consultancy for SEEPZ-SEZ.
Agenda Item No. 17 :- Extension of AMC for Air Conditioner Service in SEEPZ-SEZ to M/s. Penguine Enterprises.
Authority was apprised that Annual Maintenance services for Centralized AC in SEEPZ-SEZ, was awarded to M/s Penguine Enterprises for a period of two year from 29.03.2021 to 29.03.2023 vide work order no. GEMC-511687787043202 dated 15.03.2021 and it expired on 29th of March, 2023. Draft RFB Document is under reiteration before the Tender Evaluation Committee and will be floated on GeM portal latest by 26.06.2023.
Decision: After deliberation, Authority approved to extend the services of M/s. Penguine Enterprises for AMC for Centralized AC in SEEPZ-SEZ. Estate Manger to initiate procedure of new tender prior to three months before expiry of all existing tenders.

On completion of the last day of submission of the bids, SEEPZ SEZ received 69 bids. The technical bids viz. 69 nos. thus received were scrutinized and documents were called for on GeM: portal. Vendors have furnished the shortfall of documents and the same was scrutinized and placed before the Tender Evaluation Committee for approval before financial bid Opening wherein 18 bids were technically qualified.. However, complaints were received related to one of the bidder on address proof verification which was verified subsequently... On opening financial bids 17 bids were found,L1 and on randomization M/s. GDX Facility was selected L1 as per GeM. However, as complaints were received related to M/s. Authority was apprised that, MIDC had submitted the DPR amounting Rs. 23,01,000/- for providing temporary 80M3 plasto storage tank, pumps and G.I. pipeline for temporary water supply to SDF V Building. This office vide letter dated 08.12.2022 issued Administrative approval amounting to Rs. 23,01,000/- to the MIDC. During execution work some: modifications-were essential for ensuring their warranty on tanks and a requirement of additional provisions needs to be incorporated in the DPR w.r.t. revision of items of Rs. 3,27,200/-. Accordingly, the DPR for the work was revised to Rs. 26,28,200/-.

Authority was apprised that a sub-security committee has been formed vide office order No. 143/2023, dated 18.04.2023 for Study of Work Measurement Study report of Noida Special Economic Zone and detailed report/recommendation regarding requirements/applicability of security guards in SEEPZ under the chairmanship ofJoint Development Commission, SEEPZ-SEZ. A detailed report is being prepared on the need for the security of SEEPZ and the available security system. A preliminary report has been submitted and it is in process for updation. Also detailed report is being prepared on Requirement of permanent security cadre. Detailed report will be sent to MoC&l after seeking observation of Authority.
Decision: - After deliberation, Authority directed that a detailed letter to be sent alongwith report to MOC&lI for reconsideration for filling of 13 posts of Govt. Security Guards in SEEPZ-SEZ.
Table Agenda Item No. 04 :- Proposal for roll back of penalty to Rs.1/-per Sq.mtr. per annum for delay in execution of Sub-lease deed in respect of units - Representation by SGJMA and SEEMA.
Authority was apprised that SEEPZ Authority vide circular No. SEEPZ-SEZ/EMS:TEN:AGR:200809:8500 dated 06.08.2010 had increased w.e.f 16.08.2010 penalty for delay in submission of Registered Sub-lease deed by units to the SEEPZ authority from Rs. 1/- per sq. mtr. per annum to Rs..100/- per sq. mtr. per annum. Their request for levying only token penalty considering circumstances of the delay was considered in the 56th meeting of SEEPZ Authority held on 29.11.2022. Vide letter dated 20.06.2023, SGJMA and SEEMA have stated that the Government of Maharashtra has notified on 09.06.2023 the stamp duty exemption to SEEPZ units in respect of sub-lease deeds executed with SEEPZ Authority.

SGJMA & SEEMA have made a submission for waiver of penaity of retrospective period as stamp duty exemption has been granted. However, it was also apprised that -State Govt. has not clearly mentioned as to whether agreement for retrospective effect canbe exécuted or not.
Decision: - After deliberation Authority held’ a’ view: to constitute ‘a sub-committee comprising of members from Trade, SGJMA, SEEMA and SEEPZ Officials to examine the issue of waiver of penalty with retrospective effect and also directed to check as to whether sub-lease agreement will be executed for retrospective period also.
to In addition to the above proposals it was approved by Authority that SEEPZ Administration needs hire an expert Civil Engineer as Additional Estate Manager for monitoring the on-going projects and also one CA to be onboarded for monitoring all transactions of Authority and for co-ordination with all concerned in financial matters of Authority.
