a. Proposal: - Application of M/s. KION India Pvt. Ltd., SEZ Unit located at EON Kharadi Infrastructure Pvt. Ltd.-SEZ, Phase - I for approval for Broad Banding of Additional Services without revision in projection.

Relevant Provision: As per 1st proviso to Rule No. 19(2) of SEZ Rules, 2006 [“Provided that the Approval Committee may also approve proposals for broadbanding, diversification, enhancement of capacity of production, change in the items of manufacturing or service capacity, if it meets the requirements of rule 18”].

d. Other Information: - • M/s.KION India Pvt. Ltd. granted LOA NO. SEEPZ-SEZ/EKIPL- SEZ/KIPL/53/2021-22 Dated 12.11.2021. • Location: : 6th &7th Floor, Wing-2 Cluster B, EON Kharadi Phase-I SEZ, Plot No. 1 Survey No. 77, MIDC Kharadi Knowledge Park, Pune-411014. • DCP of the unit is 21.04.2022 • LOA Validity up to 20.04.2027. • Reason for Broad Banding of Services: The unit has submitted that after considering the growth prospects, they wish to make changes to the business plans outlined in the project report submitted along with the initial application for setting up the new SEZ File No.S-SEZ-PRO0EON1/13/2022-JDCP I/4076/2024 69

unit. According to the revised business plan, the unit proposes to expand its operations by adding additional activities.

• Reason for No Changes in Export Projections on account of inclusion of additional services: The Unit vide letter dated 13.03.2024 has submitted that they have asserted that they will not able to meet their projected export targets due to a downturn in their global business affairs. To address the deficit and meet these export targets, they have decided to undertake additional activities from their SEZ Unit. Accordingly they have requested to incorporate additional activities in their LOA.

e. ADC Observation: - • Approval Committee may consider the proposal of the unit for Broad Banding of Additional Services without revision in projections, in terms of Rule 19(2) of SEZ Rules, 2006.

Ltd an IT/ITES unit located at Ground to 5th Floor, Wing 1, Cluster D, EON Free Zone MIDC Kharadi Knowledge Park Pune-411014 for approval w.r.t. sharing of IT infrastructure (network devices, server and Data connectivity link) with other SEZ units. b. Specific Issue on which decision of Approval Committee is required: -

Approval for sharing of infrastructure facilities with their other SEZ units namely, Tietoevry Fintech India Pvt. Ltd.(TFIPL) and Tietoevry Tech Services India Pvt. Ltd.(TTSIPL) located at Wing 1 Cluster D EON Kharadi Infrastructure Pvt. Ltd. under Rule 27(5) of SEZ Rules, 2006.

As per Rule 27(5) of SEZ Rules, 2006 which prescribes

“A unit may import or procure from Domestic Tariff Area, all types of goods and services, without payments of duty, taxes or cess for creating a central facility for use by units in Special Economic Zone and where such facility is created for software development, the same may also be accessed by software exporters of Domestic Tariff Area.”

Further, in the case of M/s. RBS Services India Pvt. Ltd. for sharing of central facility of Network infrastructure, duty exempted assets and common area of its unit located in IT/ITES SEZ of Gurgaon Infospace Ltd., MOC&I vide its letter No. K-43013(616)3/2018-SEZ dated 06.02.2019 has clarified the following;

"I am directed to refer to Noida SEZs letter No. 10/351/2010-SEZ dated 21.12.2018 on the subject mentioned above and to state that the request of M/s. RBS Services India Pvt. Ltd. has been examined in this department and it has been decided with the approval of the competent authority that the case appears to be falling clearly in the ambit of Rule 27(5) of SEZ Rules, 2006" d. a. Proposal: Monitoring of the performance of M/s. Sungard availability Service India Pvt. Ltd., an IT/ITES unit located at 2nd Floor, Wing 4, Cluster D, Plot No.1, S.No. 77, MIDC, Kharadi Knowledge park, Pune-411014 for the following period: Last Year of the 2nd Block Period i.e. FY 2021-22,
First Year of the 3rd Block Period i.e FY 2022-23. b. Sungard AS Group Holding Company in USA has gone into bankruptcy. Hence is unable to pay the dues to its vendors as per the ruling by US court on this matter. Sungard India has filed an application dated 12-05-23 to RBI through the AD bank for the write off and it is under process.

ADC’s observations:

  1. The Unit has achieved export revenue of Rs. 104.19 Crores as against projected export of Rs. 133.34 Crores and achieved cumulative NFE of Rs. 619.22 Crores which is 87.53% in last year of 2nd block period i.e. 2021-22 during FY 2017-18 to FY 2021-22.

  2. The Unit has achieved export revenue of Rs. 87.32 Crores as against the projected export of Rs. 120.09 Crores and achieved cumulative positive NFE of Rs. 85.61 Crores which is 98.03% in 1st year of 3rd Block period i.e. 2022-23 during FY 2022-23 to 2026-27.

  3. The Unit has achieved employment of 297 employees (Men-232, Women-65) as on 31.03.2023.

  4. The Unit is required to file the pending DSPF.

  5. Approval Committee may monitor the performance of the Unit, in terms of Rule 54 of SEZ Rules, 2006 for the following period : Last year of 2nd Block Period i.e 2021-22. (1 year) First year of 3rd Block i.e. FY 2022-23 (1 year)
