Minutes of the 36th meeting of the SEZ BOA held on 5th November 09
The thirty sixth meeting of the SEZ Board of Approval was held on 05.11.2009 under the chairmanship of Shri Rahul Khullar, Secretary, Department of Commerce in Room No. 141, Udyog Bhawan, New Delhi to consider proposals for setting up of Special Economic Zones and other miscellaneous requests in respect of notified/approved SEZs. A list of participants is enclosed (Annexure -1).
Addressing the Board of Approval members, the Chairman informed that so far 578 formal approvals have been granted for setting up of SEZs out of which 340 have been notified. He further informed that over Rs. 1,29,985 crores have been invested in the Special Economic Zones during this short span of time and direct employment of the order of 4,18,129 persons has been generated in the Special Economic Zones. During the first two quarters of the current financial year, total export of Rs.89,751 crores approximately has been made from SEZs.
Item No. 36.1: Delegation of powers to a sub-committee of BOA for considering matter such as authorised activities etc.
Department of Revenue was not in favour of setting up this committee as it felt that it would merely be duplicating the work of Board of Approval. Further they have also pointed out that detailed prior examination of proposals for the sub- committee meetings, which are proposed to be held once every week, may not be possible. They have also stated that any participation in such meetings, without proper detailed examination of agenda proposals may not be useful. They also pointed out that it is important that all the representative departments should be present for such meetings as also the Development Commissioners without which any decision may not be possible. BOA is the only forum which presents such a single window opportunity and hence Department of Revenue does not want any dilution of the existing arrangement. It was, therefore, decided by BOA that the decision on this issue be deferred.
Item No. 36. 2: Preparation of a default list of services, consumed outside the SEZ for authorized operations undertaken by the developers/co-developers/units in Special Economic Zones (SEZs), for the purpose refund of Service Tax.
On the request of Department of Revenue, the item was deferred as it was indicated that they would apprise the proposal in the Department of Revenue before it was considered by BOA.
Item No.36.3: Request of Cochin Special Economic Zone for expansion of the zone
DC, CSEZ indicated that the existing CSEZ is completely inadequate to cater the requirement of the demand from the industry. Accordingly, the land for increasing the SEZ area is proposed to be acquired. Initially, it was proposed that the contiguity condition may be relaxed as the proposed land is nearly 25 km. away from the existing CSEZ. However, on reconsideration, it is proposed that a new SEZ

be set up in the land being acquired. Given the fact that in Kerala, to get land is extremely difficult, it is proposed to set up a multi-product SEZ though the acquisition is proposed only between 150-180 acres. It was pointed out by the representative of Department of Revenue that if the matter is to be considered by the Board then the minimum requirement of the land and contiguity has to be met as prescribed by the SEZ Rules. However, it was observed that since the Zone is being set up by the Central Government and there is a demand for space for setting up of manufacturing units, the Administrative Ministry i.e. Department of Commerce will take a view on this issue.
ITEM NO. 36.4: SETTING UP OF SEZs:-
(A)
Decisions for Formal Approvals:
1.
Request for setting up of a sector specific Special Economic Zone for
IT/ITES SEZ at Coimbatore District, Tamil Nadu by M/s. Larsen & Toubro
Limited (L&T) – 11.0388 hectares (Item No. 36.4 –Sl. No. i):
The Board noted that the Developer was in possession of land. The State Government has also recommended the proposal. Accordingly, the Board decided to grant formal approval for setting up of a sector specific Special Economic Zone for IT/ITES SEZ at Coimbatore District, Tamil Nadu by M/s. Larsen & Toubro Limited (L&T) over an area of 11.0388 hectares.
Item No. 36. 5:
Requests for co-developers
BoA sanctioned approvals to the co-developers subject to the condition that particular terms and conditions of lease agreement will not have any bearing on the treatment of the income by way of lease rentals/down payment/premium etc., for the purposes of assessment under the prevalent Income Tax Act and Rules. The Assessing Officer, will have the right to examine the taxability of these amounts under the Income Tax Act. This is applicable for all the cases for co-developers mentioned below:-
(i) Request of M/s. Footwear Design & Development Institute for co-developer in the Footwear and Leather Products SEZ at Irungattukottai, Sriperumbudur, Tamil Nadu developed by SIPCOT
After deliberations, the Board decided to grant approval to request of M/s. Footwear Design & Development Institute for co-developer in the said SEZ for establishment of training institute of international standard in the area of footwear & leather products technology, design, testing & retail & fashion management in the Footwear and Leather Products SEZ at Irungattukottai, Sriperumbudur, Tamil Nadu developed by SIPCOT.
(ii) Request of M/s. Gujarat State Petronet Limited for co-developer in the multi product SEZ at Bharuch, Gujarat developed by M/s. Dahej SEZ Limited

After deliberations, the Board decided to grant approval to request of M/s. Gujarat State Petronet Limited for co-developer in the said SEZ for developing gas pipeline infrastructure for transmission of gas in the multi product SEZ at Bharuch, Gujarat developed by M/s. Dahej SEZ Limited.
(iii) Request of M/s. Mapletree Mauritus 2 Limited for co-developer in the IT/ITES SEZ at Kharadi village, Mulshi Taluka, Pune District, Maharashtra developed by M/s. Eon Kharadi Infrastructure Private Limited
After deliberations, the Board decided to grant approval to request of M/s. Mapletree Mauritus 2 Limited for co-developer in the said SEZ for develop, manage, operate and maintain a built up area of approx 1.8 million sq. feet (1800000 sq. feet) in the IT/ITES SEZ at Kharadi village, Mulshi Taluka, Pune District, Maharashtra developed by M/s. Eon Kharadi Infrastructure Private Limited
Item No. 36.6: Request for change of sector/broad-banding the sector
(i) Request of M/s. Span Ventures Private Limited for change/broad banding of sector
“After deliberations, the Board decided to approve the request of M/s. Span Ventures Private Limited for change of sector from ‘IT/ITES SEZ’ to ‘electronics hardware and software, including ITES SEZ.”
(ii) Request of M/s. Enfield Exports Limited for change of sector from IT/ITES to Non-conventional energy including solar energy equipment/cell sector at Udupi Kanksa, Panagarh, Dist. Burdwan, West Bengal
After deliberations, the Board decided to approve the request of M/s. Enfield Exports Limited for change of sector from IT/ITES to Non-conventional energy including solar energy equipment/cell.
(iii) Request of M/s. Pune Embassy Projects Pvt. Ltd. for change/broad banding of sector
After deliberations, the Board decided to approve the request of M/s. Pune Embassy Projects Pvt. Ltd. for change/broad banding of sector from IT/ITES to Electronic Hardware and Software including ITES.

(iv) Request of M/s. Manyata Promoters Pvt. Ltd. for change of sector by including Electronic Hardware and Software in the present sector specific SEZ for IT/ITES at Bangalore, Karnataka
After deliberations, the Board decided to approve the request of M/s. Manyata Promoters Pvt. Ltd. for change/broad banding of sector from IT/ITES to Electronic Hardware and Software including ITES.
Item No. 36.7: Withdrawal of approval
The Board observed that the under-mentioned cases for withdrawal of formal approvals will be subject to the certification by DC that these SEZs have not availed of any concessions/duty benefits.
(i) Withdrawal of formal approval granted to M/s. Gremach Infrastructure Equipments & Projects Ltd. for sector specific SEZ for Metal at Gadhinglaj Dist. Kolhapur, Maharashtra
The Board decided to approve the request of M/s. Gremach Infrastructure Equipments & Projects Ltd. for withdrawal of formal approval.
(ii) Withdrawal of formal approval granted to M/s. ETL Infrastructure Services Ltd. for sector specific SEZ for Services at Chenglepet, Kancheepuram District, Tamil Nadu
The Board decided to approve the request of M/s. ETL Infrastructure Services Ltd. for withdrawal of formal approval.
(iii) Withdrawal of formal approval granted to M/s. SPEL Semiconductor Ltd. for sector specific SEZ for IT/ITES at No 5, CMDA Industiral Estate Maralmalai Nagar Kanchipuram District, Tamil Nadu
The Board decided to approve the request of M/s. SPEL Semiconductor Ltd. for withdrawal of formal approval.
(iv) Withdrawal of formal approval granted to M/s. Nitesh Estates Pvt. Ltd. for sector specific SEZ for IT/ITES at Mangalore, Karnataka
The Board decided to approve the request of M/s. Nitesh Estates Pvt. Ltd. for withdrawal of formal approval.
(v) Withdrawal of formal approval granted to Maharashtra Industrial Development Corporation for sector specific SEZ for Bio Technology at Jalna Industrial Area, Jalna, Maharashtra
The Board decided to approve the request of Maharashtra Industrial Development Corporation for Withdrawal of formal approval.

(vi) Withdrawal of formal approval granted to M/s. Enfield Realtors Limited for sector specific SEZ for Bio-technology at Kanksa, Pangarh, Dist. Burdwan, West Bengal
The Board decided to approve the request of M/s. Enfield Realtors Limited for Withdrawal of formal approval.
(vii) Withdrawal of formal approval granted to M/s. Mridul Infrastructure Private Limited for setting up of Textile sector at Tehsil Rajpura, District Patiala, Punjab
The Board decided to approve the request of M/s. Mridul Infrastructure Private Limited for Withdrawal of formal approval.
(viii) Withdrawal of formal approval granted to M/s. Vividha Infrastructure Private Limited for setting up of a sector specific SEZ for Engineer sector at Tehsil Rajpura, District Patiala, Punjab
The Board decided to approve the request of M/s. Vividha Infrastructure Private Limited for withdrawal of formal approval.
(ix) Withdrawal of formal approval granted to, M/s. Abhijeet MADC Nagpur Energy Ltd., a co-developer in the multi product SEZ being developed by M/s Maharashtra Airport Development Company Limited (MADC)
The Board decided to approve the withdrawal of the formal approval as co- developer granted to M/s Abhijeet MADC Nagpur Energy Ltd. and also noted that they are converting into a unit in which case their imports till now will be accounted for calculation of NFE, as a unit.
(x) Withdrawal of formal approval granted to M/s. Brigade Enterprises Ltd. for co-developer in the sector specific SEZ for IT/ITES developed by M/s. Infopark at Kakkanad, Kerala.
The Board noted that the developer has since then withdrawn his request for withdrawal of the formal approval.
Item No. 36.8: Requests for extension of validity of formal approvals
The Board decided to grant extension of validity of formal approvals in each case for one year beyond the validity.
(i) Request of M/s. Gitanjali Gems Limited for extension of the validity period of formal approval beyond 24th October 2009 for Gems & Jewellery SEZ at Village Chiravat in Raigad Distt., Maharashtra.

(ii) Request of M/s. Jubilant Infrastructure Limited for extension of the validity period of formal approval beyond 20th August 2009 for Chemicals SEZ at Vilayat GIDC, Ta. Vagra, Dist. Bharuch, Gujarat.
(iii) Request of Gujarat Industrial Development Corporation (GIDC) for extension of the validity period of formal approval beyond 12th July 2009 for EHTP/IT/ITES SEZ at Gandhinagar, Gujarat.
(iv) Request of Gujarat Industrial Development Corporation (GIDC) for extension of the validity period of formal approval beyond 11th July 2009 for Apparel sector SEZ at Ahmedabad, Gujarat.
(v) Request of M/s. Bannari Techno Park Private Limited for extension of the validity period of formal approval beyond 24th October 2009 for IT/ITES SEZ at Kalapatty village, Coimbatore, Tamil Nadu.
(vi) Request of M/s. Electronics Technology Parks-Kerala for extension of the validity period of formal approval beyond 19th January 2009 for IT/ITES SEZ at Attipra village, Trivandrum Taluk, Trivandrum district, Kerala.
(vii) Request of M/s. Arun Excello Infrastructure Pvt. Ltd. for extension of the validity period of formal approval beyond 24th October 2009 for Electronic Hardware and Software including ITES SEZ at Vallancheri village, Chengalpet Taluk, Kancheepuram District, Tamil Nadu
(viii) Request of M/s. L&T Hitech City Limited for extension of the validity period of formal approval beyond 21st June 2009 for IT/ITES SEZ at Kesarapalli, Gannavaram Mandal, Krishna District, Andhra Pradesh.
Item No. 36.9: Request for increasing / decreasing area
(i)
Request of M/s Coimbatore Hi-tech Infrastructure Ltd. for increase in area
in the sector specific SEZ for IT/ITES at Keeranatham village near Coimbatore,
Tamil Nadu
After deliberations, the Board decided to approve the request of M/s. Coimbatore Hi-tech Infrastructure Ltd. for increasing the area by adding 3.93.5 hectares to the already notified SEZ area of 47.32 hectares thereby making the total area of the SEZ to 51.25.5 hectares.
(ii) Request of M/s Enfield Energy Limited for increase in area of the Non- Convectional Energy including Solar Energy Equipment/Cell SEZ at Kanksa, Panagarh, Dist. Burdwan, West Bengal
After deliberations, the Board decided to approve the request of M/s. Enfield Energy Limited for increasing the area by adding 11.42 hectares to the already

notified SEZ area of 10.12 hectares thereby making the total area of the SEZ to 21.54 hectares.
(iii)
Request of M/s Mayar Infrastructure Development Pvt. Ltd. for increase in
area in the sector specific SEZ for Biotechnology at Gurgaon, Haryana
After deliberations, the Board decided to approve the request of M/s. Mayar
Infrastructure Development Pvt. Ltd. for increasing the area by adding 2.59 hectares
to the already notified SEZ area of 12.4928 hectares thereby making the total area of
the SEZ to 15.08 hectares.
Item No. 36.10: Request for de-notification
(i) Request of M/s. Lahari Infrastructure Ltd. for de-notification of notified Services SEZ at Kondakal village, Shankarpally Mandal, Ranga Reddy District, Andhra Pradesh
After deliberations, the Board decided to approve the request of M/s. Lahari Infrastructure Ltd. for de-notification of notified sector specific SEZ for services at Kondakal village, Shankarpally Mandal, Ranga Reddy District, Andhra Pradesh subject to DC’s certificate that the developer has refunded all the tax/duty benefits including service tax exemption availed of by the developer under the SEZ Act.
Item No. 36.11: Requests for Authorized Operations
BoA considered the proposals for authorized operations and while sanctioning the approvals, they were subject to the development guidelines approved by EGoM in its meeting dated 24th October 2008, which was noted by the members of the BoA, and State Government Representatives in its meeting held on 8th December 2008. Accordingly, the DCs will ensure that the authorized operations are in line with the guidelines.
(i) Request of M/s. DLF Utilities Limited for authorized operations as co- developer, in the IT/ITES SEZ at DLF Cyber City, Gurgaon, Haryana, developed by M/s. DLF Cyber City Developers Limited
The BoA perused the proposal and after deliberations, the Board decided to defer the proposal and directed that the DC Noida and DC/Director, STPI must jointly inspect the premises of the developer to appreciate the proposal made by them. In case the proposal falls under the default list of authorized operations, the DC will dispose it off suitably.
(ii) Request of M/s. Arshiya International Limited for authorized operations in the FTWZ SEZ at Village Sai, Taluka Panvel, District Raigad, Maharashtra

(v) Request of M/s. GHI Finlease and Investments Limited for authorized operations in the IT/ITES SEZ at Sohna Tehsil, Distt. Gurgaon, Haryana
The BoA perused the proposal and noted that the areas proposed for the various authorized operations require inputs from the DC Noida and DC/Director, STPI and after deliberations, the Board decided to get the inputs from them, after their joint inspection, before taking any further decision. Accordingly, the proposal was deferred.
(vi) Request of M/s. Rathinam Arumugam Research & Educational Foundation for authorized operations as co-developer, in the IT/ITES SEZ at Coimbatore, Tamil Nadu, developed by M/s. Span Ventures Private Limited
The BoA perused the proposal and noted that the areas proposed for the various authorized operations require inputs from the DC MEPZ and DC/Director, STPI and after deliberations, the Board decided to get the inputs from them, after their joint inspection, before taking any further decision. Accordingly, the proposal was deferred.
(vii) Request of M/s. Dahej Hospitality Pvt. Ltd. for authorized operations as co- developer, in the Multi Product SEZ at Bharuch, Gujarat developed by M/s. Dahej SEZ Limited
The Board noted that there are two co-developers approved for hospitality services in the Dahej SEZ. It directed the DC, Dahej to study both the proposals and sent the recommendations which could be considered by the Board. Accordingly, the proposal was deferred.
(viii) Request of M/s. Wipro Limited for authorized operations in the IT/ITES SEZ at Gautam Budh Nagar, Noida, Uttar Pradesh

The BoA perused the proposal and noted that the areas proposed for the various authorized operations require inputs from the DC SEEPZ and DC/Director, STPI and after deliberations, the Board decided to get the inputs from the DC SEEPZ and DC/Director, STPI, after their joint inspection, before taking any further decision. Accordingly, the proposal was deferred.
(xii) Request of M/s DLF Cyber City Developers Limited for authorized operations in the IT/ITES SEZ at DLF Cyber City District, Gurgaon, Haryana
The BoA perused the proposal and noted that the areas proposed for the various authorized operations require inputs from the DC NSEZ and DC/Director, STPI and after deliberations, the Board decided to get the inputs from them, after their joint inspection, before taking any further decision. Accordingly, the proposal was deferred.
Item No. 36.12: Request of M/s. Navi Mumbai SEZ Private Limited for relaxation of conditions of LoA.
DGEP said that the Chief Commissioner of Customs, Mumbai has submitted a report according to which, the proposal is not to be supported as there will be dilution of the earlier approval which itself was a dilution for the normal proposals in terms of providing contiguity. It was noted by BOA that to get 2000 hectares of contiguous land is a very tall order. In these days of economic depression, it is important that the investor’s interest is sustained in this key infrastructure. It is preferable that the issue is resolved through dialogue. Accordingly, BOA directed

that DC SEEPZ and DC, Navi Mumbai SEZ must have a meeting with the Chief Commissioner of Customs, Mumbai to work out a feasible solution.
Item No. 36.13: Request for additional gates
(i) Request of M/s. Vikas Telecom Limited for approval of multi entry/exit points in their Electronic Hardware and Software including IT/ITES SEZ at Bangalore, Karnataka
BOA directed DC/Director, STPI to conduct an inspection to ascertain the actual requirement of additional gates based on which BOA can consider the proposal. Accordingly, the proposal was deferred.
Item No. 36.14: Grant of second extension of in-principle approval.
BOA granted second extension in respect of M/s Nasik Mult-Services SEZ Ltd. and M/s SEZ Infrastructure Developers from the date of the expiry of the last extension.
(ii) Grant of third Extension of in-principle approval.
The Board Noted that under the existing SEZ Rules, there is no provision for
grant of third extension in respect of in-principle approvals, though there is a
proposal for amending the rules which may take some time. However, keeping in
view that the three SEZs under consideration are multi-product SEZs and the fourth
one is an engineering sector SEZ, acquisition of land has been a major constraint.
Accordingly, the BOA decided to grant de novo approval from the date of expiry of
the last extension subject to these developers filing Form ‘A’ and also getting the
concerned State Government’s recommendations.
(i) Mumbai SEZ Limited, Khopta, District Raigad, Maharashtra (ii) Mahindra World City, Karla, Maharashtra (iii) Tamilnadu Industrial Development Corporation Ltd, District Krishnagiri, Tamilnadu. (iv) Pune high-tech Infra Engineering Pvt. Ltd., District Satara Maharashtra.
Item No. 36.15: Request for 1st extension of the validity period of in-principle approval
(i) Request of M/s. LMJ Warehousing Pvt. Ltd. for extension of the validity of in-principle approval of the FTWZ SEZ at Kandla, Gujarat

It was noted by BOA that the developer had submitted the proposal for extension of the in-principle approval after the expiry of the approval date. It was decided to grant further extension of one year from the date of expiry of the approval condoning the delay in submission of the request for extension.
Item No. 36.16: Request of M/s. SE Forge Ltd., a unit in sector specific SEZ for Engineering by M/s. Suzlon Engineering SEZ at Vadodara, Gujarat for granting special permission for carrying out job work processing from DTA unit of Government/Defence undertaking
The proposal was approved on file in view of the pressing urgency of the M/o Defence to progress urgent unavoidable preparatory work of the ATV Programme and also due to the fact that Department of Revenue had agreed to the proposal subject to certain conditions. The decision was ratified by the BoA.
