under Letler of Approval (LoA) No. 81208/2021-NDRFTWZ dated 03.05.202'1 . was engaged in FTWZ operations at NDR SEZ. lnvestrgations by DRI revealed misuse of the IEC of l,4/s Samyga lnternational by the Appellant to imporl and clear goods withoul the knowledge of the actual IEC holder. Consequenlly, a Show Cause Nolice was issued by the Development Commissioner, and alter due proceedings, the LoA was cancelled by the Unit Approval Commillee (UAC) on 18.11.2024. Subsequently. a proposal lor a new FTWZ unit by the same party (lhe inslant Appellant) at New Chennai Township SEZ was also rejected by lhe UAC. From the submissions on record, the Board noled that adequale opportunity was provided to the Unit lhrough issuance of SCN as well as lor submissions/personal hearing and that the Order-in"Original is a reasoned and speaking order. Furlher, the violalions by lhe said Unit were upheld in adjudication order No. '1 10493 daled 27 .11 .2024. passed by Customs authorities. Evidence brought oul by the DC shows multiple inslances of IEC misuse and unaulhorized imporls. Ivlisuse of IEC and clearance of goods wilhout the IEC holder's knowledge contravenes Rule 18(5) of SEZ Rules and lnstruclion No.60 of DoC. ol the Guidelines lor Operalional Framework of FTWZ and Warehousing Units in SEZs, issued by DoC vide lnstruction No. 117 daled 24.A9.2024. 129.9(iv) Appeat tiled by M/s. Jiwanram Sheoduttrai lndustries Limited under the provision ol Section l6(4) o, the SEZ Act, 2005 against the Order- in-Original dated 17.10.2024 passed by DC, FSEZ. The Board heard lhe appellant. DC, Falta SEZ was duected to review the progress of the Unit from time to time. 129.9(v) Appeal filed by M/s. Varsur lmpex Pw. Ltd. in KASEZ under the provision ot Section 16(4) ol the SEZ Act,2005 against lhe Order-in-Original dared 10.09.2024 passed by Dc, KASEZ. The Board heard the appellant. The Board noled that BetelnuvArecanut and Pepper are highly sensitive smuggling due lo high tarill value and duty slructure of 1 10ol, plus IGST. Furlher, there is lhe condition of Minimum lmport Price (MlP) on the commodities. All ol this makes it a lucrative commodity for smuggling and diversion. Various cases in the recenl past have been booked by DRI and SllB in relation lo Arecanut/Betelnut diversion and smuggling aclivilies involving various SEZ units due to high BCD on them. The board observed that the Approval Committee in its 195th UAC meeling deliberaled on the issue and unanimousiy decided to withdraw all approvals for warehousitrg ol Eelel Nuls and Pepper by SEZ units solely providing warehousing services on behalf of clients under powers conferred to it under Section 14(1)(f) ot SEZ Act, 2005. The Board directed the DC. to inform the Development Commissioner's otlice within seven days of any finalized or shipped cargo or transaclions relaled to these commodities, with only those reported within this period considered for clearance to ensure a conlrolled and smooth phase-out while addressing existing commitments- The Board furlher observed thatonly the permissions for warehousing Betelnut/Arecanut and Pepper have been revoked from the respective Unit's Le er of Approval (LoA), while all other permissions in the LoA remain intacl. The disallowance ol Betelnuts/Arecanuts and Pepper imporl for warehousing in Kandla SEZ is seen as a measure to curb misuse of the SEZ scheme, prevent smuggling, and align operalions with the SEZ Act's obieclives. Atter due deliberations.

and Pepper imporl for warehousing in Kandla SEZ is seen as a measure to curb misuse of the SEZ scheme, prevent smuggling, and align operalions with the SEZ Act's obieclives. Atter due deliberations. the Board concluded that DC, Kandla SEZ has been duly authorised under the SEZ laws to keep a strict watch on high-risk commodilies and restrict dealing rn sensitive com, nodilies by FTWZ units and warehousing units. l,4oreover, the Board also suggested that the list of commodities allowed for operalions as per LoA may be reviewed regularly by the Unit Approval Committee based on the risk perception of the various commodities in lhe said Zone. The Board funher underlined that the UAC of Kandla SEZ withdrew the approvals granted for the said commodities being sensitive, for all warehousing units in the entire jurisdiction of KASEZ without prejudice to lhe appellant. Hence, the Board found no reason to inlerfere with the decision of the DC and UAC to withdraw the permission to storelwarehouse sensitive commodilies in the said Warehousing Unit from the tist of authorised activities as per the LoA issued to the appellant, and afler deliberations. upheld the deciston of the UAC.
