Amendments in the Hand Book of Procedures(Vol.I),2004-2009

TO BE PUBLISHED IN THE GAZETTE OF INDIA EXTRAORDINARY (PART­I, SECTION­I) GOVERNMENT OF INDIA MINISTRY OF COMMERCE AND INDUSTRY DEPARTMENT OF COMMERCE DIRECTORATE GENERAL OF FOREIGN TRADE   PUBLIC NOTICE NO.  112 (RE­2007)/2004­2009 NEW DELHI, DATED THE      15th February 2008               In exercise of powers conferred under Paragraph 2.4 of the EXIM policy 2002­2007 (RE2003), the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures, Vol. I (RE2003):   1.      The words ‘/job worker’ appearing in the second sentence of Para 3.2.6A – III stands deleted and the following is added at the end. “However, RA concerned can list the Job­Worker(s), upon request made as per Annexure A to this Public Notice, at any time during the validity of duty free credit entitlement certificate.  Acronyms used for duty free credit entitlement certificate are ‘DFCEC’ or ‘DFCE’ scrips, which means ‘duty credit scrip’ issued under the scheme.”   2.      In the Para 3.2.6A – VI, the second sentence is replaced as under. “Over and above the extended validity granted automatically, vide Public Notice No 28 (RE­2007)/2004­09 dated 24.07.2007; maximum two revalidations, for one year each from date of expiry, are allowed. Application for revalidation may be made within 2 months of expiry, on the letter head of the applicant, to RA concerned.”   3.      In Appendix 17D, the Application Format for DFCE Scheme for Status Holders 2003­04,  the words ‘/job worker’ appearing in the second sentence of Sr. No. 10 of Appendix 17D as well as in the column 2 of the table in Sr. No 10 of Appendix 17D stands deleted.     4.      In Appendix 17D, the Application Format for DFCE Scheme for Status Holders 2003­04,  Sr. No. 10A, as in Annexure A to this Public Notice, is added after Sr. No. 10 of Appendix 17D, for listing of Job Workers on the duty credit scrips.       This issues in Public interest.   Sd/­ (R.S. Gujral) Director General of Foreign Trade and Ex­Officio Additional Secretary to the Government of India (Issued from F.No.01/94/180/308/AM07/PC­I)

Annexure A to Public Notice No 112 (RE­2007)/2004­2009 dated: 15th February 2008   Application for Listing of Job­Workers – Annexure to Appendix 17D (Sr. No. 10A of Appendix 17D, application form for DFCE for Status Holders Scheme 2003­04)   10A: Listing of Job­Worker(s) for the purpose of conversion of permitted imports into possible resultant products, when imports are made for ‘own use’.   Note: The beneficiary status holder (Manufacturer Exporter or Merchant Exporter) can utilize full value of duty credit scrip issued to him for his ‘own use’. Beneficiary may decide to make any possible resultant product for utilizing the imports permitted under the Scheme, when imported for ‘own use’. Job­Workers can be used for conversion of imports permitted under the scheme into any possible resultant products. Upon conversion in the factory of Job­Worker, the resultant product can be sold in the open market, upon payment of duties as applicable to the resultant product; including to the conversion unit (i.e. job worker).
