Decision: RLA, Mumbai was asked to furnish their comments in respect of the request dated 09.03.2011 received from firm regarding excess import of item No. 3 at SION H-3. RLA, Mumbai vide letter dated 19.09.2011 has stated that on the receipt of letter dated 09.03.2011 from the firm, the position of the case was reviewed and it was noticed that there was a calculation mistake on the part of their office and the import made by the licence holder was within the eligibility and there was no excess import in the matter. Accordingly, the licence was redeemed on 11.03.2011 and the firm was also informed. The Committee considered the letter dated 19.09.2011 received from RLA, Mumbai and decided to withdraw the case and inform the firm accordingly.

Decision: The Committee considered the request of firm for inclusion of Import Item No. 5 - High Density

PRO version Polyethylene (HDPE) which was not considered by Norms Committee in its Meeting No. 45/87-ALC1/2008 held on 18.02.2009 and it was observed that HDPE is a Packing Material. However, since licence has already been expired, no fresh import can be allowed unless licence is revalidated by Policy Relaxation Committee (PRC). Hence, the Committee decided to examine it on file (i) whether import of HDPE has already been done within the validity of licence or not; and (ii) whether the request is for regularization or for fresh import. The case may be placed again before Committee with complete facts.
