The matter was considered by Norms Committee –VI in its meeting No. 28/12 held on 05.1.2012 taking into account the provisions relating to DFRC Scheme , SION E42 ( as amended by PN 23 dated 10.09.2003) and Policy Circular No. 31 dated 18.10.2005. Under the DFRC Scheme, DFRC issued to the firm is allowed transferability.. Under SION E42 .actual user condition is applicable only to the import item ‘Diesel/ Kerosene”. In the wake of representations received on import of Coal under DFRC Scheme , it has been clarified vide DGFT Policy Circular No 31 dated 18.10.2005 that wherever coal has been allowed as one of the inputs in SION i.e when its consumption is directly related to the manufacturing of the export product and not for generation of power, it should be treated at par with other inputs which are transferable under DFRC. Norms Committee reiterated the policy position as clarified in the said policy circular to state that actual user condition is not applicable to the input item “Coal”
