Reliance Industries Ltd., Mumbai – Ref. from PC-4(B) NC49/10 dt. 04.03.2010 F.NO.1/84/162/535/AM10 -DES-V Amendment in the description of export product Polyester Staple Fibre covered under DEPB S.No.A-556 of Chemicals Product Group – reg. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that PC-4(B) Section have requested for comments with regard to amendment in the description of export product Polyester Staple Fibre covered under DEPB S.No.A-556 (Product Group 62) of Chemicals Product Group. The Committee observed that Standard input output norms for “Polyester Staple Fibre/ Polyester Tow/ Polyester Tops/ Polyester Spun Yarn (PTA Route)” have been fixed under SION, A-1842, whereas DEPB rate at S.No. A-556 (Product Group 62) of DEPB Schedule has been fixed with the export description only for ‘Polyester Staple Fibre’. The Committee felt that for the same manufacturing process and the similar input requirement of both the items i.e Polyester Staple Fibre / Polyester Tow as per SION and as the Value Cap of the export item in the DEPB Schedule is already in existence, the description of export item should be amended to include ‘Polyester Tow’ also in DEPB

The Committee also perused that for Acrylic Staple Fibre/Acrylic Tow fixed at SION, A-1764, the DEPB rate has been fixed at S.No. A 532 (Product Group 62) for the export description Acrylic Fibre as well as Acrylic Tow. In view of this Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to recommend the case to DEPB Committee for amendment in the description of export item of DEPB S.No. A 556 (Product Group 62) to include ‘Polyester Tow’ also in DEPB Schedule alongwith Polyester Staple Fibre. PC-4 (B) Section may be informed accordingly.

Case No. 687

Reference from CAPAXIL in respect of M/s Ke-technical Textiles, Kolkata NC49/10 dt. 04.03.2010 F.NO.1/84/162/11/AM10 -DES-V Fixation of SION for Tubular Bag – reg. Decision: The Committee considered the case as per agenda and decided that a team of Norms Committee comprising officers of DGFT, DIPP, DC (MSME) and R.O of TC, Noida will visit the unit of applicant firm to study the manufacturing process for taking final view in the matter.

Firm may be informed accordingly.

Case No. 688

M/s Roy International, Kolkata NC49/10 dt. 04.03.2010 F.NO.1/84/50/760/AM06 -DES-V Re-fixation of input output norms in respect of Advance Authorization No.

PRO version 1010022904 dt. 24.02.2006. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. J.L.Bhandari, an authorized representative of the firm, who appeared for personal hearing in this case. Representative informed that this is the first advance authorization, wherein firm had applied for import of Undyed Polyester Yarn and export of Dyed Polyester Yarn indicating specific Qty. in different colours. Later on, for subsequent advance authorizations, they have been indicating the description of export item ‘ Polyester Yarn Dyed in varying colours’ instead of specifying colour-wise Qty. This fact has not been brought to the notice of NC earlier. In view of this, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to allow the amendment in the description of export item to read as “Polyester Dyed Yarn” in various colours taking lenient view in this case. R.A may issue EODC accordingly.

The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 689

M/s Chelsea Mills, New Delhi NC49/10 dt. 04.03.2010 F.NO.1/84/50/545/AM07 -DES-V Re-fixation of input output norms in respect of Advance Authorization No. 0510200771 dt. 12.03.2007 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in this case - for export item No. 1, fabric used is nearly 325 Gms/Pc as per NC decision & similarly fabric used in Kg terms for export product No. 2, 3 can be worked out from GSM & Sq mtrs/Pc allowed by NC. Pumice Stone is allowed 300 Grm/ kg of fabric.
