The Committee considered the case as per agenda and noted that the case has been re-examined by the Technical Authority, Department of Industrial Policy & Promotion, based on the reply/clarifications/documents furnished by the firm, vide letter dated June 5, 2013, enclosing hard copy of application, License Copy, a Declaration for export & import items, FDA Certificate, A.R.E. – 1, Export Invoice, Shipping Bill, raw material specification.
Technical Authority, Department of Industrial Policy & Promotion, observed that the unit of export item is mentioned in numbers, whereas in shipping bills /Export invoice/ARE-1 (duly authenticated by central excise), it is mentioned in grams. After obtaining all corroborative evidences from the firm, it is observed that the weight of one number of export item No. 1 is 10.30 grams, and export item No.2 & 3 are 1.73 grams and export item No.4 & 5 are 6.70 grams.
Committee also observed that the firm has submitted a copy of approved formula from Drug Authority, declaration regarding import and export items and they have claimed 0.50% wastage on bulk raw materials which, in the opinion of Technical Authority, Department of Industrial Policy & Promotion, appears to be reasonable. However, component is allowed on net to net basis.
Taking all the facts and figures into consideration, Committee decided to re-consider the case and approved norms, as recommended by Technical Authority, Department of Industrial Policy & Promotion, vide their U.O. No. 7/100/2013-TSW/1334 dated 2.8.2013, as under: -
