The Committee considered the case as per agenda and noted that the decision of NC Meeting No.30/83 dated 24.10.2012 (Case No.58/26/83-ALCI/2012) was cancelled by Committee in its Meeting No.47/13 dated 20.02.2013, as firm had mentioned incorrect and misleading input as “glass fibre yarn rovings” in their application. As technical comments of DIPP also, inadvertently,

PRO version mentioned same input as in application, in minutes of meeting of NC dated 24.10.2012 same input got typed incorrectly. On noticing mistake and the fact that ‘yarn’ and ‘roving’ are two different items and firm has given ambiguous declaration, Norms Committee cancelled ad-hoc norms as given in Meeting of 24.10.2012. Committee also desired TA, DIPP, to re-examine the case and also advised to obtain from firm the production and consumption data duly certified by central excise, Based on the production/consumption data furnished by firm duly certified by the Central Excise, Committee decided to approve norms on the basis of written recommendation of Department of Industrial Policy & Promotion, vide their U.O.No. Nil dated 20.5.2013, as under:-

The Committee considered the cae as per agenda and noted that Technical Authority, DIPP, vide their U.O.No.7/100/2013/05- TSW dated 13.5.2013, have re-examined the case based on the clarification submitted by the firm vide their letter dated 26th March, 2013, along with declaration for export products, FDA Certificate, ARE-1, Export Invoice, Shipping Bill, raw material specification. Technical Authority, DIPP, also observed that in the advance license, the quantity of the product was given in Numbers and based on ARE-1, Export Invoice, Chartered Engineer Certificate, the following weight of export products has observed by TA, DIPP:-

TA, DIPP, has also obtained a copy of the approved formula from Drug Authority, declaration regarding import and export items and stated that the firm had claimed wastage of 0.50% on bulk raw materials, which is reasonable.

Taking into account all the facts and circumstances mentioned above, Committee decided to re-consider the case and approve norms, as under:-

The Committee considered the case as per agenda and noted that Technical Authority, DIPP, vide their U.O.No.7/100/2013- TSW/06 dated 10.5.2013, have re-examined the case based on the clarification submitted by the firm vide their letter dated 9th April2013, along with declaration for export items, FDA Certificate, ARE-1, Export Invoice, and Chartered Engineer’s Certificate. Committee further noted that in the advance authorization, the quantity of the export product is shown in Numbers, and based on the above documents, TA, DIPP, correlated the same and observed the following quantity:-

Committee also observed that in the approved formula from Drug Authority, the name of the chemical has been mentioned in generic name, but the firm has imported chemicals under trade name. From the international cosmetic ingredient dictionary and hand book, it is seen that the generic name, trade/brand names are given. TTA, DIPP, correlated the same before recommending norms.

Taking into account all the facts and circumstances mentioned above, Committee decided to re-consider the case and approve norms, as under:-

Committee further noted that in the advance authorization, the quantity of product was given in Numbers and net quantity of export item is given in the Shipping Bills, which is 12.86 grams packing.

TA, DIPP, has also obtained a copy of the approved formula from Drug Authority, declaration regarding export items and noted that the firm has claimed a wastage of 0.50% on raw materials which DIPP felt was reasonable.
